<p>JS welcomed Cllrs Mrs May Haines &amp; Neil Sorton, Janet Kilminster, who had kindly stepped in as Minutes Secretary, and all those present.</p>
<p><strong>Apologies: </strong>Apologies received from Terry Stewart, Carol &amp; Mike Parkin, Stan Alfert, Michael Bond &amp; Roy Pointer</p>
<p><strong>Accuracy: </strong>After receiving no comments, JS said that he would sign the Minutes as a true and accurate record of the meeting held on 09 NOVEMBER 2011.</p>
<p><strong> </strong></p>
<p><strong>2. MATTERS ARISING </strong></p>
<p><strong>Poole Pottery/Old Orchard/Quay Thistle Hotel sites update: </strong>JS</p>
<p>reported&#8230;</p>
<p>1.            <span style="text-decoration: underline;">Quayside (former Dolphin Quays</span>) development – No new developments</p>
<p>2.            <span style="text-decoration: underline;">Former Poole Pottery &amp; Swan Inn site</span> – ditto</p>
<p>3.            <span style="text-decoration: underline;">Quay Thistle Hotel site</span> – ditto</p>
<p>4.            <span style="text-decoration: underline;">Old Orchard House. 39-61 High Street</span> – ditto</p>
<p>5.            <span style="text-decoration: underline;">Land at West Quay Road</span> <em>– </em>WH reported that Neptune Consultants had requested a meeting with the Community Working Group as they were looking at the possibility of re- engaging to progress the development of the West Quay Road site after the first planning application had been turned down. Neptune wished to talk about where they had gone wrong and, maybe, what they could do to fix things in the future. The CWG gave them some thoughts and ideas which they said they would look at; discussions would also be held with other community groups. Therefore Neptune have now gone away to think about whether they do nothing or come back to the table, it is hoped that another meeting will be held in the New Year, when Neptune will have a better idea of whether they will re-submit or just walk away altogether.</p>
<p><strong> </strong></p>
<p><strong>Planning Enforcement, TPOs/Tree replacements – update:</strong></p>
<p><span style="text-decoration: underline;">147 Banks Road<em>(Damage to five Corsican pines</em></span><em>)</em> – The Hearing at Bournemouth Crown Court on 18/11/11 was adjourned and it is likely that any new date will be some months hence, given the volume of work the Court Service is handling and the fact that Mr Lee has a</p>
<p>separate application for Legal Aid to be considered which is likely to take a few months in itself.</p>
<p><span style="text-decoration: underline;">Heavytree Road</span> <em>(Unauthorized felling of the 12m Scots pine as</em> <em>reported in the Daily Echo dated 23/06/10) –</em> Case has been adjourned until 23/01/12 at Poole Magistrates Court at 09.30 for consideration of committal proceeding to the Crown Court.</p>
<p><strong>Other current Planning Enforcement Issues</strong></p>
<p><span style="text-decoration: underline;">The Cherry Orchard, Dover Road </span>(Retrospective application to erect entrance gates) – A letter of objection has been lodged on behalf of the Association as Code 3 of the Branksome Park Conservation Appraisal and Management Plan stipulates that gates should “be of an open design to enable glimpses along driveways.</p>
<p><span style="text-decoration: underline;">Victoria Education Centre </span>(St ALdhelm’s Road entrance) – The school has carried out some suitable planting and erected a chain link fence.</p>
<p><span style="text-decoration: underline;">23 Ravine Road</span> &#8211; The Council has yet to receive any papers in relation to the appeal against the conviction for the unauthorized felling on 12/08/11. It is expected that the Crown Court will fix a hearing so that the merits of any out of time application can be heard and a decision</p>
<p>reached as to whether Hunter Tree Care Ltd should be allowed to appeal the original decision</p>
<p>C<strong>ommunity Working Group (CWG): </strong>JS will circulate the Minutes of the<strong> </strong>meeting held on 15/11/11 with the Minutes of this meeting. Next meeting on 1st Feb 2012</p>
<p><strong>Council Budget 2012/13 &amp; Council&#8217;s Budget Monitoring report:</strong></p>
<p>William Mutlow reported that the Council was now forecasting a £371,000 deficit for the year. The significant variances from the original Budget include a reduction in Parking Services Fee Income and additional pressures relating to Adult Social Care. The Medium Term Financial Plan forecasts deficits of £5m, £7m &amp; £5m for the Financial Years 2012/13, 2013/14 &amp; 2014/15.</p>
<p><strong>Public Rights of Way:</strong></p>
<p><span style="text-decoration: underline;">Westminster Road end of Dalkeith Road</span> – No new developments.</p>
<p><span style="text-decoration: underline;">Buccleuch Road to Lakeside Road</span> – ditto</p>
<p><span style="text-decoration: underline;">Bessborough Road</span> – ditto</p>
<p><span style="text-decoration: underline;">Footpath 82 Spur</span> – ditto</p>
<p><strong> </strong></p>
<p><strong>Pinecliff Gardens (Sunken garden): </strong>WH reported that work had now ceased until early spring, recently a kind offer of rockery plants had been<strong> </strong>received from David Reeves (Known to many in St Aldhelms Parish as MacAdam the gardener). David not only donated the plants but he planted them up as well which means we now have about half of the eastern rockery finished. Thanks were also given to Stan Alfert for his kind donation of Japanese Anemone plants, these have also been planted in the sunken garden.</p>
<p>JS thanked WH for all the work that he had done.</p>
<p><strong> </strong></p>
<p><strong>Public Liability Insurance (PLI) </strong>– JS said that the Association&#8217;s use of the Parish Centre is covered by its policy with BCTV which was taken out to cover the Association’s work at the Sunken Garden.</p>
<p><strong> </strong></p>
<p><strong>Poole Council&#8217;s Efficiency Review Programme: </strong>JS reported that the new Asset Management Plan is due to be considered in detail at an extra            <strong>JS </strong>meeting of the Council Efficiency &amp; Effectiveness Overview &amp; Scrutiny committee on 26/03/12.</p>
<p><strong>Localism Bill &amp; National Planning Policy Framework: </strong>JS said that the            <strong>JS/TS </strong>Localism Act now has Royal Assent and will soon become law. The Council is currently considering its implications.</p>
<p><strong>Offshore Wind Farm – JS r</strong>eported that the item in the Association&#8217;s last Minutes had prompted a response from Jack Melling, Account            <strong>RP/S </strong>Manager, Mistral on behalf of Eneco to say that&#8230; “We have absolutely no problem with people voicing their opposition against the plans. However, we would like to state that there is full planning and public consultation on the proposals. The formal consultation process on the proposed Navitus Bay Wind Park starts early next year, with Eneco holding public exhibitions across Dorset, Hampshire and the Isle of Wight to provide members of the public with more information. There will also be an opportunity to provide feedback on the plans, which will be recorded as part of the planning process.</p>
<p>These public exhibitions will be advertised in the new year on the website &lt;http://www.navitusbaywindpark.co.uk&gt; and we urge members of the Branksome Park, Canford Cliffs &amp; District Residents Association to attend one of the events if possible.</p>

<p><strong>Lindsay Road and St Aldhelm’s Road Junction: </strong>PT reported that Poole is making a joint Bid with Bournemouth Borough Council &amp;            <strong>PT </strong>Christchurch District Council for a share of the Dept of Communities &amp; Local Government Local Sustainable Transport Fund. If successful, the project will be broken down into four sections, of which Section 1 covers Poole Town Centre to County Gates (Frizzell gyratory). The three Authorities will have to make some contribution themselves.</p>
<p>Lindsay Road is getting busier and traffic getting faster and the junction of Lindsay Road and St Aldhelm’s Road is quite an important one for cyclists and pedestrians alike and it is getting more and more difficult for crossing and really does need looking at.</p>
<p>JS suggested that members need to make their views and concerns known to the chairman of the Economy Overview &amp; Scrutiny Committee, Cllr Clements.</p>
<p><strong>Application to register Baiter and Whitecliff Recreation Ground as a   town green – </strong>Consideration is being given to designating this site as Queen Elizabeth II Fields site. A report setting out the criteria for selecting sites for designation of sites as Queen Elizabeth II Fields &amp; consideration of four proposed sites is to be presented at the</p>
<p>Environment Overview and Scrutiny Committee meeting on 5 January 2012</p>
<p><strong>Compton Acres </strong>– The proposed meeting has yet to be arranged but is<strong> </strong>likely to be next month.</p>
<p><strong>Beach Hut policy </strong>– JS reported that 37 Beach Hut tenants attended last night&#8217;s Cabinet meeting. Members approved Public Consultation from Beach Hut License Fee Holders, Waiting List and the general public. The point was raised that, as the waiting list is currently closed, they should not preclude those who might aspire to being able to hire a hut annually.</p>
<p>An Inaugural meeting of the Poole Beach Huts Association is to be held on 1st February 2012 at 7.45 for 8pm prompt start at Merley Community Centre, Harrier Drive, Merley, Nr Wimborne BH21 1XE</p>
<p><strong>3.            NEW HOUSING DEVELOPMENT </strong></p>
<p><strong> </strong></p>

<p>Other current planning issues</p>
<p><strong>4 Nairn Road </strong><em>(Construction of a detached 4 bedroom house with integral double garage. Amended plans received 05.09.2011and 20.09.2011) </em>–Application granted at the Planning Committee meeting on</p>
<p>17/11/11.</p>
<p><strong>35 Bingham Avenue </strong><em>(Demolition of the rear of the existing semi- detached house and garage and the construction of a new two storey extension to the rear of the property and detached garage) – </em>Letter of objection lodged on behalf of the Assn on 13/10/11.</p>
<p><strong>11 Compton Drive </strong><em>(Remodeling of existing house and erection of a new detached dwelling) </em>– Application granted at the Planning Committee meeting on 17/11/11.</p>
<p><strong>8 Shore Road </strong><em>(Demolition of existing dwelling, erection of three duplex apartments with underground car parking) </em>- Application refused on 28/10/11.</p>
<p><strong>5 Excelsior Road </strong><em>(Demolish existing buildings and erect 1 No 4 bed house with integral garage) </em>– Amended plans lodged on 25/10/11 and application to be determined at the Planning Committee meeting on 26/01/12.</p>
<p>60A Kings Avenue (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council&#8217;s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Tree work/Planning conditions.</p>
<p><strong> </strong></p>
<p><strong>4.            REPORT RE CANFORD CLIFFS &amp; PENN HILL AREA COMMITTEE MEETING (07/12/11) Chairman&#8217;s Note: </strong>I, inadvertently, omitted to include a report on this meeting. The Agenda included discussion of two Traffic Regulation Orders, one relating to a Highwood Road Disabled Bay and the other to Langdon Road traffic.</p>
<p>Proposed improvements to Alexandra Park were also discussed.</p>
<p><strong> </strong></p>
<p><strong>5.            ACCOUNTS TO DATE </strong>– JS reported that the total Assn. funds as at 30th November amounted to £32,531.90.</p>
<p><strong> </strong></p>
<p><strong>6.            ANY OTHER BUSINESS</strong></p>
<p>BPCCRA 2012 AGM – JS gave advance notice that the AGM will be held on the last Saturday in April (28th) at Canford Cliffs Village Hall.</p>
<p>Block Management Consortium meeting – WH reported that the next meeting is to be held on 24th January 2012 at 6.00pm at the Wessex Hotel, West Cliff Road, Bournemouth BH2 5EU. WH said that he would let JS have a copy of the Agenda for circulation with the Minutes of this meeting.</p>
<p>There being no further business the meeting closed at 8.00 pm and concluded with Mulled wine &amp; Mince pies.</p>

<p><strong> </strong></p>
<p><strong>2. MATTERS ARISING Poole Pottery/Old Orchard/Quay Thistle Hotel sites update: </strong>JS reported&#8230;            <strong> </strong></p>
<p>1.            Quayside (former Dolphin Quays) development – JS said that his attention had been drawn to the Private Eye No.1300 dated October 28 2011, which included a piece about Dr Gerald Smith. Dr Smith was the &#8216;mastermind&#8217; behind the Dolphin Quays development. At Dr Smith&#8217;s Confiscation Hearing at Inner London Crown Court on 13/11/07, HHJ Roberts determined the time for payment as 12 months and, in default, HHJ Roberts ruled that Dr Smith&#8217;s current eight year sentence should be extended by a further eight years. The final sentence of the piece in Private Eye says that Dr Smith is not exactly unknown at the offices of a company based at London&#8217;s Centre Point, so if this is to be believed, he must be out on licence.</p>
<p>2.            Former Poole Pottery &amp; Swan Inn site – ditto</p>
<p>3.            Quay Thistle Hotel site – ditto</p>
<p>4.            Old Orchard House. 39-61 High Street – ditto</p>
<p>5.            Land at West Quay Road <em>(Mixed use regeneration and new public quayside</em></p>
<p><em>to include; the demolition of a listed gate post and all existing buildings on site; the redevelopment of the site with 373 residential units provided in six apartment blocks with basement parking and courtyard) – </em>Application was refused at special Planning Committee meeting on 01/11/11.</p>
<p><strong> </strong></p>
<p><strong>Planning Enforcement, TPOs/Tree replacements – update:</strong></p>
<p><span style="text-decoration: underline;">147 Banks Road <em>(Damage to four Corsican pines)</em></span><em> </em>– On 20 October 2011 at<em> </em>Bournemouth Magistrates Court, Alistair Barrington Collier and Harvey Lee were<em> </em>found guilty of five offences of causing or permitting protected trees to be destroyed.</p>
<p>Sentencing will take place on 18 November 2011 at Bournemouth Crown Court.</p>
<p><strong>Chairman&#8217;s Note: </strong>A bankruptcy order was made against Harvey Lee on 07/11/11<strong> </strong></p>

<p>An appeal against a Tree Replacement Notice was heard today and the appellant informed the Inspector that he had lodged an appeal against the Magistrate&#8217;s decision. Whilst this is &#8216;by right&#8217;, an appellant has to lodge this within three weeks of the Court Hearing and it will now be down to the Authorities to decide if an out-of-date appeal will be accepted. Heavytree Road <em>(Unauthorised felling of the 12m Scots pine as reported in the Daily Echo dated 23/06/10) – </em>Case to be heard at Poole Magistrates Court on 12/12/11.</p>
<p>C<strong>ommunity Working Group (CWG): </strong>The next meeting will take place on 15/11/11.</p>
<p><strong>Council Budget 2012/13 &amp; Council&#8217;s Budget Monitoring report: </strong>William Mutlow reported that the Council was forecasting a £938,000 deficit for the year but after various actions to mitigate this, the pressure at the end of September was reduced to £402,000. This was mainly due to a reduction in Adult Social Care and Transportation Services. This is still a very fluid situation.</p>
<p>NS added that there are continuing pressures in Children’s Services. For instance, the estimate of children in care has been increased from 135 to 145.</p>
<p>JS said that the Medium Term Financial Plan has a £1.5m 3 year (2011 to 2014) target for the Employee Cost Efficiency Review Programme. £1m will be delivered through the Trade Unions acceptance of proposed changes from 2012/13 but a residual £0.5m remains to be delivered if the target is to be reached.</p>

<p><strong>Pinecliff Gardens (Sunken garden): </strong>WH reported that he has had an offer of another donation towards the sunken gardens. He went on to say that some of existing plants have been stolen, and another of the benches has been vandalised and burnt. Both these incidents have been reported to the Council.</p>
<p><strong>Public Liability Insurance (PLI) </strong>– JS said that he had recently been informed by a representative of the Church&#8217;s insurers that non-church organisations using the Parish Centre should have PLI cover. He will investigate if the PLI insurance which the Association has taken out in connection with work carried out at the Sunken Garden covers the Parish Centre too.</p>
<p>Hazel Clifton pointed out that the Canford Cliffs Village Hall PLI policy covers for users of the Hall. Stan Alfert felt that this should apply to the Parish Centre policy too.</p>
<p><strong>Poole Council&#8217;s Efficiency Review Programme: </strong>JS reported that the Head of Property Services and Asset Management has left the Council&#8217;s employment and the functions of this Unit have been split in two. Property Services is being taken over by Transportation Services and Asset Management is being taken over by Financial Services There is a 3rd element – their business support team, which will be redesigned to fit in with the existing teams in the other two Service Units.</p>
<p>The next Council Efficiency and Effectiveness Overview and Scrutiny Committee is fixed for 23/11/11</p>
<p><strong>Localism Bill &amp; National Planning Policy Framework: </strong>No new developments. <strong>Chairman&#8217;s Note: </strong>Since the meeting, I&#8217;ve received the following Press release&#8230;</p>
<p><strong>“</strong>The Localism Bill, which includes measures for major reform of the planning system in England, is now waiting for Royal Assent, having completed its scrutiny by Parliament.</p>
<p>Court Hearing on 12/08/11 and the Magistrates found the case proven.</p>

<p>The legislation abolishes regional strategies, establishes new plan-making in the shape of neighbourhood plans, creates a new duty on neighbouring planning authorities to “cooperate” on issues which cross council boundaries, brings in compulsory pre-application scrutiny and abolishes the Infrastructure Planning Commission, paving the way for the commission&#8217;s functions to be carried out by a new unit in the Planning Inspectorate and decisions to be made by minsters who are democratically accountable to the public.</p>
<p>When the commission is abolished next April, decisions on nationally significant infrastructure projects like power stations and new reservoirs will be considered by a yet-to-be established Major Infrastructure Planning Unit in the Inspectorate, which will make a recommendation to the relevant Secretary of State who will make the final decision.</p>
<p>During the final consideration of the Bill in the Commons, Decentralisation Minister Greg Clark insisted there was now considerable political consensus over much of the legislation.</p>
<p>He told the Commons, which approved all the most recent Lords amendments: “It is important to say that we want to see more planning, not less. We feel that over time the imposition from above has stood in the way of local communities expressing their own vision of the future of their community. That is what we want to give them a greater chance to do. At the heart of that is the need to achieve sustainable development. Section 39 of the Planning and Compulsory Purchase Act 2004 provides a duty on those preparing local plans to do so with the aim of contributing to the achievement of sustainable development. Amendment 370 extends that principle to neighbourhood planning, with an explicit condition that it should contribute to the achievement of sustainable development. The duty to co-operate will require that public bodies should co-operate effectively on sustainable development.”</p>
<p>Mr Clark also made it clear that although sustainable development was not defined on the face of the Bill it would be in the National Planning Policy Framework, the final version of which is planned for publication in April 2012.”</p>
<p><strong> </strong></p>
<p><strong>Offshore Wind Farm – </strong>RP reported that the saga of the NAVITAS Wind Farm rumbles on. Construction is due to start in 2016 or 2017. The Royal Yacht Squadron at Cowes on the Isle of Wight has now added their voice to the opposition. RP is worried that there is no co-ordination between Dorset and Hampshire and this is needed in order to make some headway into opposing this proposed Wind Farm which will be implemented by the Government without any Planning or Public Consultation at all. RP requests that through our Ward Councilors there is continuing dialogue with our local MP and any further bodies who could help.</p>

<p><strong>BPCCRA Autumn Magazine: </strong>JS said that the Autumn 2011 magazine had been</p>

<p><strong>Chairman&#8217;s Note: </strong>Since the meeting, I have been, belatedly, informed of a meeting held on 27/10/11 between the Head of Leisure Services, Cllr Mrs Judy Butt, Head of Legal &amp; Democratic Services, a legal officer and three representatives of the Parkstone Bay Association to seek a way forward.</p>
<p><strong> </strong></p>
<p><strong>Green Waste scheme – </strong>A fortnightly collection service will be offered to all households in Poole running from March-November.</p>
<p>Only those households choosing to opt-in to the scheme would pay for the service. The charge will be £31 a year, although those residents who sign up by 31 March 2012 will receive a 30% discount for the first year of the scheme. Registration is due to commence on 1st December 2011.</p>
<p>JS said that he would include, in the Minutes, an extract from a note from Cllr Mrs            Dion, the Portfolio Holder responsible for Environmental Services</p>
<p>“There will be no prioritising areas and anyone who signs up sooner rather than later can expect a full bin collection service beginning in March next year. People who sign up towards the end of the discount period (i.e. March 31st 2012) may face a bit of a delay, but officers are working on the exact timings. Therefore all Branksome Park residents have equal opportunity to sign up for the scheme. They also have the option to have more than one bin if they wish, but each is charged the same.</p>
<p>It will only be those residents who do not opt in to the scheme that will face a further choice of whether to home compost (and, as you say, much is not compatible with composting) or to take their green waste to the recycling centre. Whilst there is not law against bonfires, it does risk upsetting neighbours when people habitually burn and the consumer protection services receive many complaints each year for that reason.</p>
<p>We will not be &#8216;policing&#8217; black bins by any means, but the point about allowing green waste in small black bins only a) is designed to encourage people to swap large black bins for smaller ones, and means that people in flats or very small gardens who would not use a green bin, do not feel penalised or discouraged from putting what would be a very small amount of green waste in their black bin (such as an old bunch of flowers or a few weeds). We do want, however to discourage people from filling large black bins full of green waste on a persistent basis. These residents will be written to reminding them of alternative options, and if they still persist, may face not having their bin emptied and, ultimately, perhaps having it swapped for a small one.”</p>

This was the same as the            <strong>further </strong>presentation to the Budget Consultation meeting with Residents’ Associations            <strong>action </strong>mentioned at the last meeting.</p>

<p>Magazine Advertising Manager – JS said that he was very sorry to report that, after six years in the role, Bob Young has indicated that he would like to step down as Magazine Advertising Manager but is willing to be responsible for the Spring 2012 magazine, if the Association has been unable to find a replacement in the meantime.</p>
<p>Campaign for Tree Management – JS reported that a petition is being circulated for ‘Tree Management’ by the Council. JS has been sent a copy but the name of the originator is not shown.</p>
<p>RP pointed out that there is a clear argument for responsible Tree Management by the Council as a number of trees are adding nothing to the environment, whilst still being under a TPO. There appears to be no forward planning for replacing the trees that are coming or have come to the end of their life.</p>
<p>SA pointed out that there are several categories to be considered; private land, Council land, Conservation Area, areas covered by TPOs and that it would be extremely difficult to put all this under one Tree Management plan.</p>
<p>JS said that, because the Council was facing severe financial constraints, he was wondering how members would feel about offering to help the Council financially to prosecute ‘tree cases’? This provoked a lively discussion but, at the end of the day, it was agreed that the Association should not get involved.</p>
<p><strong> </strong></p>
<p>Thursday&#8217;s Environment Overview and Scrutiny Committee &amp; Report of the Chairman of the Beach Hut Working Party &#8211; A new policy is to be discussed at tomorrow&#8217;s meeting whereby it is proposed to grant 5 or 10 year leases and to impose these on existing licensees. This is not going down well with some existing licensees.</p>
<p><strong>Chairman&#8217;s Note: </strong>At the EO &amp; SC meeting, Cllr Mrs Haines made the point that no consultation had taken place with current beach hut owners and those on the waiting list. The Allotment Review Working Party looked at allotments and invited current plot holders as well as those on the wait list to seek their views and it worked really well.</p>
<p>The decision has to go to Cabinet and then to the Full Council so current Beach Hut licensees can still make representation to Cabinet members about their concerns.</p>
<p>If current Beach Hut licensees are interested in forming a Poole Beach Hut Association to oppose the new proposals, they should contact Bob Lister &lt;boblister@orange.net&gt;</p>
<p><span style="text-decoration: underline;">4 Nairn Road <em>(Construction of a detached 4 bedroom house with integral double garage. <p><span style="text-decoration: underline;">BPCCRA 2012 AGM</span> – Hazel Clifton asked if the Association had fixed the date for next year&#8217;s AGM. JS said that the Association would normally hold this on the 2nd Saturday in May <strong>Chairman&#8217;s note: </strong>HC has subsequently contacted JS and informed him that Canford Cliffs Land Society is holding its AGM on 12th May 2012 and the following Saturday            <strong>JS</strong></p>
<p>(19th May) it is the Craft/Motor Neurone Fair. It has been suggested that the Association hold its AGM on the last Saturday in April (28th), as the Village Hall is free on that date.</p>
<p><span style="text-decoration: underline;">Bulb planting in the pocket park between Bessborough Road and Haven Road</span> – The CCLS is planting bulbs on the weekend 19/20th November between 10 &#8211; 12 midday. Everyone is welcome to join them. Please bring a trowel with you.</p>

<p>It seems that the LPA has decided that it is not in the public interest to pursue the boundary treatment at 55 Canford Cliffs Road and 2 Compton Avenue &amp; 93 Lilliput Road.</p>

<p style="text-align: left;">147 Banks Road (Damage to four Corsican pines) – Next Court Hearing fixed for 17 -19th October 2011 at Bournemouth Magistrates Court.</p>

<p style="text-align: left;">23 Ravine Road (Unauthorized tree work) The Magistrates found the case proven but, as it was the defendant&#8217;s first offence, he was given a Conditional Discharge for two years and has to make a contribution towards the Council&#8217;s costs of £3,000, spread over 15 months. The Magistrates accepted the Council&#8217;s case that the two felled trees were in existence at the time of the Area TPO in 1966, as a &#8216;ring count&#8217; showed that the tree was at least 56 years old.</p>
<p><strong>Community Working Group (CWG):</strong></p>
<p style="text-align: left;">The Minutes of the meeting on 10/08/11 will be circulated with the Minutes of this meeting</p>
<p style="text-align: left;">WH had submitted a question about the number of new closeboarded gates being introduced in Branksome Park and the Conservation Officer has confirmed that the Conservation Area Management Plans normally require gates of open design, in order to retain glimpses of properties and landscape behind, and to respect the openness of the area and enhance local distinctiveness. There is no reason for these provisos to be deleted.</p>
<p style="text-align: left;"><strong>Council Tax 2011/12 &amp; Council&#8217;s Budget Monitoring report:</strong></p>
<p style="text-align: left;">William  Mutlow reported that the Council is forecasting a £697,000 deficit for  the year, a £35,000 improvement on the July figure. The Council  continues to face challenges because of the reduction in Government  grants etc. which required savings of £14.97m in the 2011/12 Budget. An  example of increased pressures being street lighting where cost to the  Council is likely to have gone up by 23%. There have been savings as a  result of the Efficiency Programme, but this is not a one-off effort,  but will carry on over the next two years or so.<br />

<p style="text-align: left;">A meeting with Residents&#8217; Associations to discuss the 2012/13 Budget has been fixed for 10/10/11 at 2:00pm in the Committee Suite and JS &amp; WH plan to attend.</p>
<p style="text-align: left;"><strong>Poole Partnership </strong>– JS said that he has still to contact Sylvia Webster, Neighbourhood Manager, Bourne Estate and it was agreed that he would take no further action but leave Ms Webster to contact him.</p>

<p style="text-align: left;"><strong>Public Liability Insurance (PLI) </strong>– Nothing to report</p>
<p style="text-align: left;"><strong>Poole Council&#8217;s Efficiency Review Programme:</strong> JS reported that Asset Management Plan is undergoing significant review at the moment and will be reported in public to the Council Efficiency and Effectiveness Overview and Scrutiny Committee on 27/11/11.</p>
<p style="text-align: left;"><strong>Localism Bill:</strong> The Council has promised to give a presentation on the Localism Bill once it has been enacted.</p>
<p style="text-align: left;">Ts reported on the proposed National Planning Policy Framework which will be the biggest change since the Second World War. This is generating a tremendous mount of controversy. There are major concerns from the National Trust and Campaign to Protect Rural England, who feel that these new proposals do not contain adequate protection for the countryside/Green Belt. The biggest worry is that the Planning Inspectorate, when the developer appeals to them, is likely to override the local council democratic decision. The word &#8217;sustainable&#8217; is rather ambiguous in that there is no specific definition of what &#8217;sustainable development &#8221; is, and developers are likely to take advantage of this.</p>
<p><strong>Offshore Wind Farm </strong>– NS has received a letter from Robert Syms MP about the Navitus Bay Wind Park and read the following extract from this&#8230;</p>
<p>•    Conor Burns MP and I did meet with the Secretary of State for  Energy, Chris Huhne MP last week. We raised concerns about the impact on  the Tourist Trade and about the views our constituents would have of  the new development. The Secretary of State listened to our concerns but  did not make any great comments as the application hasn&#8217;t yet gone in.  We expressed the view that we preferred the Wind Farm to be farther out.  The key question was whether the water was shallow enough if the Wind  Farm was placed farther out to sea.<br />
•    Local Authorities will be consulted by the Infrastructure Planning  Commission or its successor about the application, there has been no  change to the process.<br />
•    I personally am not keen on Wind Farms but it is the policy of the  Government to build more. My view is I would prefer to get on with  building more nuclear power stations.<br />
•    There are no national statistics I am aware, of about accidents or break- downs about Wind Farms.</p>
<p style="text-align: left;">TS also drew member&#8217;s attention to the draft Dorset Renewable Energy Strategy . This advocates that Dorset should erect 180 industrial wind turbines across the County (excluding the AONBs) higher than Salisbury Cathedral – over 400 feet high. Dorset is producing less than 1% of electricity from wind farms, and as the government has made a commitment to Brussels that it will produce 15% of electricity from renewable energy by 2020, they are putting pressure on Dorset to produce more.<br />
TS went on to say that there is a Council seminar on September 15 to discuss this. NS pointed out that this seminar is to discuss the whole question of renewable energy, not solely windfarms.</p>
<p style="text-align: left;"><strong>Lindsay Road and St Aldhelms Road Junction </strong>– No further developments</p>
<p style="text-align: left;"><strong>BPCCRA Autumn Magazine</strong> – JG hopes to get the magazine out by 21st October which means delivery week commencing 17th. Allowing three weeks for printing, that means everything to Marquee Print by 23 September.</p>
<p style="text-align: left;"><strong>Clubhouse and Tennis Courts at the Wilderton Road</strong> – JS understands that the current concessionaires have a seven year contract but are looking for a 21 year lease.</p>
<p style="text-align: left;"><strong>Private Sewer Transfer </strong>– JS was not able to persuade a representative from Wessex Water to come and explain the ins and outs of what was going to happen.</p>
<p style="text-align: left;"><strong>3.    NEW HOUSING DEVELOPMENT</strong><br />
Keith Alcroft reported that he had been contacted about the following two applications but could find no good planning reasons to object ..<br />
<strong>15B Bury Road</strong> (Demolish the existing bungalow. Replace with 5 bedroom family home. Improvements to landscape) – Application registered 22/08/11.</p>
<p style="text-align: left;"><strong>11 Compton Drive </strong>(Remodelling of existing house and erection of a new detached dwelling) – Application registered 24/08/11.<br />
NS said that he had been contacted about <strong>8 Shore Road</strong> (Demolition of existing dwelling, erection of three duplex apartments with underground car parking) and has been &#8216;red-carded&#8217; the application, unless the Planning Officer is minded to refuse.<br />
JS said that the Land Registry entry shows that the Borough of Poole has a charge over this property&#8230;<br />
3 (08.09.2008) RESTRICTION: No disposition of the registered estate is to be registered without a certificate signed by the applicant for registration or his conveyancer that written notice of the disposition was given to The Borough of Poole, Financial Services at P O Box 722, Civic Centre, Poole, Dorset BH15 2YE being the person with the benefit of an Interim charging order on the beneficial interest of Stephen Lee Gray made by the Poole County Court on 18 July 2008.</p>

<p style="text-align: left;">60A Kings Avenue (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council&#8217;s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.</p>
<p style="text-align: left;"><strong>5.    ACCOUNTS TO DATE</strong> – JS reported that the total Assn. funds as at 31st August amounted to £34,298.95.</p>
<p style="text-align: left;"><strong>6.    ANY OTHER BUSINESS</strong></p>
<p style="text-align: left;"><strong>Newtown &amp; Parkstone Area Committee meeting on 07/09/11</strong> – William Mutlow said that he had attended this meeting. One thing that came up at the meeting was the purpose of the Area Committees and that this should not be just talking about ‘yellow lines’ but there should be other more meaningful discussions, with the Open Forum&#8217; being held at the beginning of the meeting rather than the end.<br />
&#8216;Yellow lines&#8217; are currently prominent on the Agenda of all Area Committee meetings as the Council are attempting to introduce parking restrictions throughout the Borough in answer to emergency service and refuse collection vehicles reporting difficulties in getting through some residential roads due to parking both sides. These are proving controversial.<br />

JS welcomed Cllrs Neil Sorton &amp; Mrs May Haines and all those present.<br />
<strong>Apologies: </strong>Apologies received from Terry Stewart (Funeral), Stan Alfert (New Grandson), Michael Bond, Bob &amp; Phyllis Young, Chris Stracey &amp; Ken Sanson.</p>
<p><strong>Accuracy: </strong>After receiving no comments, JS said that he would sign the Minutes as a true    JS and accurate record of the meeting held on 13 JULY 2011.</p>
<p style="text-align: left;"><strong>2. MATTERS ARISING </strong></p>
<p style="text-align: left;">Poole Pottery/Old Orchard/Quay Thistle Hotel sites update: JS reported&#8230;<br />
1.    Quayside (former Dolphin Quays) development – No new developments</p>
<p style="text-align: left;">2.    Former Poole Pottery &amp; Swan Inn site – ditto</p>
<p style="text-align: left;">3.    Quay Thistle Hotel site – ditto</p>
<p style="text-align: left;">4.    Old Orchard House. 39-61 High Street – ditto</p>
<p style="text-align: left;">5.    Land at West Quay Road (Mixed use regeneration and new public quayside to include; the demolition of a listed gate post and all existing buildings on site; the redevelopment of the site with 373 residential units provided in six apartment blocks with basement parking and courtyard) – Amended plans lodged on 07/06/11.</p>
<p style="text-align: left;"><strong>Planning Enforcement, TPOs/Tree replacements </strong>– update:<br />
19 Mornish Road (Tree replacement) – The property remains unsold. Any prospective purchaser will be advised of the legal requirement to plant a replacement tree to a specification detailed in the tree replacement notice<br />

<p><strong>Current planning enforcement issues</strong><br />
147 Banks Road (Damage to four Corsican pines) – Next Court Hearing fixed for 17 -19th October 2011 at Bournemouth Magistrates Court.<br />
Victoria Education Centre (St Aldhelms Road entrance) – The school has carried out some suitable planting and erected a chain link fence.<br />
2 Compton Avenue &amp; 93 Lilliput Road (Boundary treatment) – No new developments.<br />
Land adj. to 20A Chaddesley Glen (Land be reinstated) – &#8211; thditto<br />
23 Ravine Road (Unauthorized tree work) Court Hearing adjourned to 12th August 10am Bournemouth Magistrates Court, Stafford Road</p>
<p><strong>Community Working Group (CWG): </strong>WH attended this afternoon&#8217;s CWG meeting but said that there were no Agenda items particularly effecting the Association and the    WH Minutes of the meeting will be circulated as soon as these were available.</p>
<p>JS said that his question about the open metal gates proviso in the Branksome Park Conservation Area Character Appraisal and Management Plan had not found its way onto the Agenda. If it is felt that this is no longer relevant, then it should be deleted. Having provisos which are ignored in practice undermines the authority of the Conservation Area Management Plan.<strong></strong></p>

<p>Footpath 82 Spur –JS reported that the RMYC has just lodged a planning application (Construct an extension to the existing marina basin. Removal of part of hardstanding and provision of public footpath to foreshore) which it is hoped will resolve the problem of Footpath 82 Spur.<strong></strong></p>
<p><strong>Possible Charitable Status for Assn:</strong> Mike Parkin reported that he has been in touch with a colleague who runs a multi-million pound autistic charity and the conclusion from this exchange was that it would be too much hassle on the part of the Association for relatively little reward – that is assuming that the Association is granted charitable status, which is not at all sure. There was some discussion on this amongst the members and the general conclusion was that it would present the Association with too much trouble for little reward. It was agreed that this item to be deleted from further consideration at this time.<br />
Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden): JS reported that the official opening of the new Treasure island play area above Canford Cliffs chine takes place tomorrow at 2.00pm. Chairman&#8217;s Note: I attended this event along with other members of the Association, our three Ward Councillors and a large group residents with their children. The official opening was a great success, Congratulations to all involved with this project.<br />
WH reported that all was going well with the Sunken Garden, and that he would soon be ready for an injection of money from the Association for replanting. He estimated that initially he would need £500/750. JS asked the members for a show of hands to approve that this amount would be made available, and it was duly passed with no objections up to the value of £750..<br />
CP asked for a vote of thanks to WH for his work on this project, both in getting it off the ground and his physical efforts at the working group each week. This was recognised by the Chairman who thanked WH.<strong></strong></p>
<p><strong>Poole Council&#8217;s Efficiency Review Programme:</strong> JS reported that it was announced last Friday that Councils must publish lists of their assets. A review of the Corporate Asset Management Plan is to be presented at the Council Efficiency and Effectiveness Overview and Scrutiny Committee meeting on 22/09/11.</p>
<p><strong>Localism Bill:</strong> WH said that this subject was discussed at the CWG meeting he had been at today. This Bill is going through its third reading at the present time and is constantly changing.</p>
<p><strong>Council Tax 2010/11 &amp; Council&#8217;s Budget Monitoring report</strong>: nothing to report as there has not been any Cabinet meetings since the Association&#8217;s last meeting.</p>
<p><strong>Public Liability Insurance (PLI)</strong> – Jan Robins said that she had had some experience in this matter through her involvement with the National Trust and agreed to seek advice about this on behalf of the Association.</p>
<p><strong>Hedge at Kenilworth Court </strong>– MH doesn’t think this is worth pursuing any further as she is not getting any response to her letters.</p>
<p><strong>Offshore Wind Farm</strong> – Roy Pointer reported that, as far as he can see, the Government have powers to enable this to go ahead. It is proposed that 200+ windmills will be erected West of the Isle of Wight. NS reported that the Councillors for Canford Cliffs Ward have been in touch with Robert Syms (MP). Mr. Syms and other concerned local MPs have asked for a meeting with the Secretary of State for Energy. If the Wind farm can be seen from the mainland, they will ask for the turbines to be sited further offdhore. There followed a lot of discussion amongst the members, mainly in opposition to the turbines both from an aesthetic and economical point of view. NS offered to ascertain the latest position on this and the statistics on the number of failures of existing turbines from Robert Syms.<br />
Lindsay Road and St Aldhelms Road Junction – No further developments</p>
<p><strong>3.    NEW HOUSING DEVELOPMENT</strong><br />
JS reported that Keith Alcroft had not been contacted about any planning application during the course of the month but the following applications had been determined.<br />
47A Lindsay Road (Erection of a Class C2 care home for the elderly with associated car parking) – Application granted on 21/07/11. 63 Haven Road (Outline application to erect four detached houses with parking/garaging provisions and formation of vehicular accesses (existing dwelling to be demolished) – application allowed by Planning Inspector on appeal on 19/07/11.<br />
24 Ravine Road (Overhang on right hand side of garage is 800mm but should be 200mm) – retrospective application (APP/11/00330) lodged on 24/03/11. The house has not been built in accordance with the plans and the conditions have not been fulfilled. There is a new planting plan dated 13/07/11. The letter concludes with &#8216;We believe that the site will now be abundantly planted and full canopy closure should be achieved within two to three years&#8217;.<br />
Other current planning issues<br />
5 Excelsior Road (Demolish existing buildings and erect 1 No 4 bed house with integral garage) – Application was registered on 11/05/11 and has been &#8216;Red-carded&#8217;. Amended plans lodged on 04/08/11. 8 Shore Road &#8211; BPCCRA will continue to monitor possible tree work application. An entrance has been created on the Haven Road side of this property. This property is up for sale at &#8216;offers&#8217; in excess of £2m.<br />
60A Kings Avenue (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council&#8217;s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.<br />
<strong>4.    REPORT RE CANFORD CLIFFS AND PENN HILL AREA COMMITTEE</strong> (27/07/11) – In the absence of Terry Stewart, JS reported that there had been a lengthy discussion on Traffic Regulation Order objections. May Haines gave a verbal report on Pinecliff Sunken Gardens and Canford Cliffs Pocket Park. The report on the Localism Bill had to be deferred as Cllr Mrs Judy Butt was unwell.<br />
<strong>5.    ACCOUNTS TO DATE </strong>– JS reported on behalf of Paul Fearnley, Hon Treasurer, that Santander have, once again, been unable to provide downloads of their bank statements. PF was told me that this has been a problem since April following the integration of Alliance &amp; Leicester and Santander. There is an incompatibility between the two systems and so far this has not been resolved.<br />
As PF does not have a paper statement to hand he has been unable to finalise the cash flow for this month.<strong></strong></p>
<p><strong>6.    ANY OTHER BUSINESS</strong></p>
<p><strong>Clubhouse and Tennis Courts at the Wilderton Road </strong>– JS reported that the Council intends to market a lease for the operation of the Branksome Park Tennis Courts and associated Pavilion premises as is. The successful tenderer will have to be a tennis operator who may be granted a lease for a period longer than seven years, dependent upon the successful proposal to operate the sporting facility.<br />
The facility will still be used for the local provision of tennis and the Council will work closely with the chosen provider to ensure the community is well catered for in their programme.<br />
The adjacent Bowls Club is unaffected. Extract from note from Head of Leisure Services to Cllr Sorton<br />
The tennis facilities at Leicester Road have been operated under license from the Council by a private company for many years. We are required to re-tender periodically and we are hoping to find an  operator to run the facility for public recreation and invest in its  maintenance and improvement and pay us as well.<br />
To get all of that we will need to offer a long lease and technically  that is a &#8216;disposal of open space&#8217; although the Council will retain  ownership.</p>
<p><strong>BPCCRA Autumn Magazine </strong>– JS asked for material for the magazine by the middle of next month.</p>
<p><strong>Poole&#8217;s Sustainability and Energy policies (PCS31, 32 and 35) </strong>– JG, who is building his own house, listed the costs of ensuring ‘Level 3’ is met, and doesn’t think the Local Authority is fully aware of this.    For instance, the cost of getting the necessary certificates for a single house can be between £2,000 and £8,000.. JS said if JG send him details of his concerns, he would arrange frod this mater to be raised at the next CWG meeting.</p>
<p><strong>Proposed article for Poole News </strong>- MH said that she has had an enquiry from the Editor of Poole News as to whether there would be any interest in putting an article in Poole News about what the Association is doing at the &#8216;Sunken Garden&#8217; This was agreed and MH said that she would follow this up.</p>
<p><strong>Sewers</strong> &#8211; Roy Pointer wondered if members were aware of the change in responsibility of the maintenance of sewers by local water companies. RP suggested that the Association should ask for a representative from Wessex Water to come and explain the ins and outs of what was going to happen. It was agreed that this was a good idea.<br />

<p style="text-align: left;"><strong>2. MATTERS ARISING </strong></p>
<p style="text-align: left;">Poole Pottery/Old Orchard/Quay Thistle Hotel sites update: JS reported&#8230;</p>
<p><span style="text-decoration: underline;">1.    Quayside (former Dolphin Quays) development</span> – No new developments</p>
<p style="text-align: left;"><span style="text-decoration: underline;">2.    Poole Pottery factory buildings in Sopers Lane</span> – The Planning Inquiry to decide on the appeal by Metnor (Sopers Lane Ltd) into the refusal of the Borough of Poole to allow an 80-bed care home to be built on this site will take place on 05/04/11 at the Civic Centre at 10am and is expected to last for three days.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">3.    Former Poole Pottery &amp; Swan Inn site</span> – No new developments</p>
<p style="text-align: left;"><span style="text-decoration: underline;">4.    Quay Thistle Hotel site </span>– ditto</p>
<p style="text-align: left;"><span style="text-decoration: underline;">5.    Old Orchard House</span>. 39-61 High Street – ditto</p>
<p style="text-align: left;"><span style="text-decoration: underline;">6.    Land at West Quay Road </span>(Mixed use regeneration and new public quayside to include; the demolition of a listed gate post and all existing buildings on site; the redevelopment of the site with 440 residential units provided in six apartment blocks with basement parking and courtyard) – No new developments</p>
<p style="text-align: left;"><strong>Planning Enforcement, TPOs/Tree replacements </strong>– update:</p>
<p style="text-align: left;">JS reported&#8230;</p>
<p><span style="text-decoration: underline;">1 Cliff Drive</span> (Addition of four additional windows where there was one large one before) retrospective application refused on 14/01/11.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">2 Compton Avenue &amp; 93 Lilliput Road</span> (Boundary treatment) –An Enforcement Order is to be issued shortly.</p>
<p><strong>Other current planning enforcement issues</strong></p>
<p style="text-align: left;"><span style="text-decoration: underline;">17 Over Links Drive</span> (Application to demolish existing and erect 2 detached houses granted on 31/01/08 but number of conditions should have been complied with before this development commenced) – No new developments.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">19 Mornish Road </span>(Tree replacement) – ditto</p>
<p style="text-align: left;"><span style="text-decoration: underline;">55 Canford Cliffs Road</span> (Removal of the gates, railings, fence and hedge, and the erection of a low stone wall with planting behind) – ditto</p>
<p style="text-align: left;"><span style="text-decoration: underline;">24 Ravine Road </span>(Overhang on right hand side of garage is 800mm but should be 200mm) – Retrospective application refused on 26/10/10. A revised application, for the whole development as it is being constructed with the over-hang, but requiring a detailed arboricultural impact assessment on the trees be included was requested on 29/12/10.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">Land adj to 20A Chaddesley Glen</span> (Land be reinstated) -</p>
<p style="text-align: left;"><strong>Community Working Group (CWG):</strong> JS reported that he had attended the CWG meeting on 26/01/11 and the Agenda included&#8230;</p>
<p style="text-align: left;">•    Membership of the group – This is to be decided at the Annual Meeting on Wed 9th March 2011, Conference Room, Civic Centre 6pm. WH will attend this meeting.</p>
<p style="text-align: left;">•    Prosecutions – There may be more news to report shortly •    Public Art – A report is to be presented at the Communities Overview and Scrutiny Committee meeting on 29/03/11. JS said that, if anyone was interested, he can providea copy of the draft report.</p>
<p style="text-align: left;">•    External decoration/design to properties in Conservation Areas – This related to shops in the High Street and an Article 4 Directive is being considered JS will circulate the Minutes when these are available.</p>
<p style="text-align: left;"><strong>Poole Beaches and Coastal Defences:</strong> This item is to be deleted from the Agenda until there is something new to report.</p>
<p style="text-align: left;"><strong>Council Tax 2010/11 &amp; Council&#8217;s Budget Monitoring report:</strong> WM reported on the Council Budget Monitoring (1 April 2010 &#8211; 31 December 2010)<br />
The Council are in the process of identifying savings and a lot of  information has recently been released. Based on its projections at the  end of December, the Council expect an underspend as at 31st March 2011  of £523,000. However, there are several claims which may impact on this.  There will be pressure from potential additional costs for Adult Social  Care and there are extraordinary costs in the planned reorganisation of  the Council which will include a large amount for redundancy. There  will also be possible additional costs of £410,000 per annum for the  Pension Scheme. There are still substantial savings which need to be  made as there is a budgeted deficit for 2012/13 and 2013/14 and possibly  thereafter. The bottom line is that, although there will be no increase  in Council Tax for the forthcoming year, 2011/12, there may be increase  for 2012/13<br />
RP asked if there were any analysis carried out as to the age of people  made redundant as this has a bearing on the costs. Neither JS nor NS  know the answer to this.<br />
WM pointed out that there are other major pressures which will impact on a balanced budget in future years.</p>
<p style="text-align: left;"><strong>Poole Partnership:</strong> – JS said that he would be attending the State of the Area Debate (an annual meeting of the Council jointly organised with Poole Partnership) on 07/03/11 to “continue to build on the discussions”, following &#8216;A Partnership Response to the cuts in Poole&#8217; meeting on the 24/11/10.</p>
<p style="text-align: left;"><strong>Public Rights of Way:</strong></p>
<p style="text-align: left;">Westminster Road end of Dalkeith Road – No new developments.</p>
<p style="text-align: left;">Buccleuch Road to Lakeside Road – ditto</p>
<p style="text-align: left;">Bessborough Road – ditto</p>
<p style="text-align: left;">Footpath 82 Spur –Sandbanks Boatyard &amp; Marina Co. Ltd. did not appeal against the Definitive Modification Order to add Footpath 82 Spur. Further developments are awaited</p>
<p style="text-align: left;"><strong>Possible Charitable Status for Assn:</strong> JS has still to set up a small Sub-Committee to look at this.</p>
<p style="text-align: left;"><strong>Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden):</strong> JS reported that WH had written to Legal &amp; Democratic Services confirming the Assn&#8217;s agreement to the heads of terms.</p>
<p style="text-align: left;"><strong></strong>The Assn&#8217;s proposal is to maintain the eastern and western rockeries, together with the eastern and western sunken gardens.<br />
Once the agreement has been formalised, work will commence on the eastern rockery, which will be cleared and replanted with alpine and rockery plants, then progress to the western rockery, following completion of which a plan will be designed for the sunken gardens.</p>
<p style="text-align: left;">CD reported that the Council are hoping to formalise the agreement by  the end of February and that the project is gathering momentum.</p>
<p style="text-align: left;"><strong>Public Liability Insurance (PLI)</strong> – JS is pursuing.</p>
<p style="text-align: left;"><strong>Poole Council&#8217;s Efficiency Review Programme:</strong> The Medium Term Financial Plan (MTFP) 2011/12 to 2013/14 presented at last night&#8217;s Cabinet meeting referred to &#8220;delivering targeted savings totalling £5.385m in new savings and efficiencies in support of the MTFP&#8221; with £560k of one-off funding set aside to support the Programme and no proposals to increase this further during 2011/12.<br />
JS said that he will include the calculation of the £5.385m in the Minutes but there appears to be no Action Plan with timelines to achieve these savings. He has written to Cllr Mrs Haines about this in her capacity as Chairman of the Council Efficiency &amp; Effectiveness Overview &amp; Scrutiny Committee</p>

<p><strong>Localism and Decentralisation Bill: </strong></p>
<p>JS said that a plain English guide  describing the main measures of the Localism Bill under the following  four headings has been published.</p>
<p>new freedoms and flexibilities for local government new rights and powers for communities and individuals reform to make the planning system more democratic and more effective reform to ensure that decisions about housing are taken locally<br />
This runs to 21 pages and is available via the Dept. for Communities &amp; Local Government website</p>

<p><strong>3.    NEW HOUSING DEVELOPMENT</strong></p>
<p>JS reported that Keith Alcroft had, once again, not been contacted about any planning application during the course of the month.<br />
JS had been contacted today about <span style="text-decoration: underline;">63 Haven Road </span>(Outline application to erect four detached houses with parking/garaging provisions and formation of vehicular accesses (existing dwelling to be demolished)- subject to &#8216;Written representations&#8217; appeal (APP/Q1255/A/11/2145209). Interested party comments required by 14/03/11. The Canford Cliffs Land Society do not want to see the houses as they would have an access onto Bessborough Road which we see to be undesirable. The flats we can live with as there are flats all the way down Haven Road now, but at least the garden space at the rear would be retained.<br />
<span style="text-decoration: underline;">3 Maxwell Road</span> (Demolish existing building and erect 1 pair of semi-detached 4 bed houses) – Officer&#8217;s recommendation to refuse over-turned by Planning Committee at their meeting on 20/01/11.</p>
<p>Martin Heath informed the meeting that he had been tracking this  planning application and was surprised at the Planning Committee’s  decision to grant. He described the sequence of events and some of the  issues of the case.    These included the Red Carding procedure where a  resident who is aware that the Planning Officer is likely to recommend a  refusal, asks a Councillor for the application to go to the Planning  Committee, the length of the consultation period and whether the  Committee were swayed by the Agent’s exaggerated claim of neighbour  support.    He also noted that no reason for the decision, which was  contrary to the Case Officer’s recommendation, is recorded in the  meeting minutes.<br />
After MH’s report, there was some discussion on ‘red carding’ and the Ward Councillors present gave their opinions.<br />
It was suggested that these issues be raised at the next meeting of the Community Working Group.</p>
<p><strong><span style="text-decoration: underline;">Other current planning issues</span></strong></p>
<p><span style="text-decoration: underline;">Land at 8 Buccleuch Road </span>(Creation of 1 No. new dwelling with 2 No. off road parking spaces) Cllr Sorton has red-carded this application, if the planning officer is not minded to refuse this.</p>
<p><span style="text-decoration: underline;">7 Ventry Close</span> (Erection of 1no. dwelling and rationalisation of garage accommodation to no 7 Ventry Close) – Application registered on 15/10/10. Revised site location plan lodged on 03/12/10. Cllr Sorton has red-carded this application, if the planning officer is not minded to refuse this.</p>
<p><span style="text-decoration: underline;">8 Shore Road</span> &#8211; BPCCRA will continue to monitor possible tree work application.    An entrance has been created on the Haven Road side of this property. This property is up for sale at &#8216;offers&#8217; in excess of £2m.</p>
<p><span style="text-decoration: underline;">60A Kings Avenue</span> (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council&#8217;s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.<br />
<strong></strong></p>
<p><strong>4.    REPORT RE CANFORD CLIFFS &amp; PENN HILL AREA COMMITTEE MEETING (26/01/11)</strong></p>
<p>The meeting included a presentation about the Canford Cliffs Play Area and a lively discussion on the proposals to install parking meters on the Sandbanks Peninsula. MH reports that the Sandbanks parking meter proposal will not be progressed at the present time.<br />
William Mutlow added that there had been a debate about the effectiveness of the Area Committee. WM said that the change in the composition of the Area Committees in 2003 had not proved to be a good idea as decisions about matters in Parkstone Ward were now decided by Members for Newtown Ward, whereas these were more likely to affect residents in Canford Cliffs &amp; Penn Hill Wards. He cited the recent discussion about the Sandbanks Road railway bridge.<br />
<strong>Chairman&#8217;s Note</strong>: The Forward Plan for the Council Efficiency And Effectiveness Overview And Scrutiny Committee says &#8220;Review of Area Committees – to be programmed into the Forward Plan for Spring 2011 as this will be a resource intensive exercise&#8221;.</p>
<p><strong>5.    REPORT RE MEETING WITH REPRESENTATIVES FROM RESIDENTS&#8217; ASSOCIATION    ACTION AND COMMERCE AND INDUSTRY, FOLLOWED BY INFORMAL MEETING WITH   RESIDENTS&#8217; ASSOCIATION REPRESENTATIVES (28/01/11)</strong></p>
<p>JS said that Terry Stewart had written a comprehensive report on this meeting and he would include this in the Minutes – see below<br />
NS was expressed disappointment that no representatives from Commerce &amp; Industry attended the meeting and JS said that TS had also commented on the very poor attendance &#8211; out of the 40 some Residents’ and Community Associations in Poole, there were only 12 residents in attendance.<br />
Note provided by TS of presentations by the Leader of the Council, Cllr Ms Elaine Atkinson &amp; the Chief Financial Officer, Liz Wilkinson. Mrs Wilkinson&#8217;s additions to TS notes are shown in italics<br />
1. <span style="text-decoration: underline;">Financial Cuts</span><br />
•    Required cuts to Council Budgets because of Government cuts ; 2011-2: £15m.2012-3: £8m. 2013-4: £10m. <span style="color: #000000;"><em>These were the figures as quoted on the slide included in the presentation. I noted in my presentation however, that on-going work on the Budget since the presentation had originally been prepared, meant that the forecast resourcing gap up to 2013/14 had been reduced to £13m overall – of which £4.5 in now forecast in 2012/13 and £8.5m in 2013/14 as the 2011/12 now balances to nil – these are the figures reported in the Budget report to Cabinet next week.</em></span><br />
•    If cuts were to come solely from job reduction this would mean 370 post reductions.<br />
•    But with good planning there will be about 50 compulsory redundancies and about 40 voluntary ones. <span style="color: #000000;">T<em>he latest advice from the Head of HR as of Tuesday this week is that a total of 162 FTE posts are expected to be made redundant from the Council’s staffing establishment. These will be achieved through the deletion of vacant posts, not replacing staff due to retire, voluntary and compulsory redundancies. The maximum number of people expected to be made redundant on a compulsory basis is 50.</em></span><br />
•    There is a cut of 55% in the capital budget. <em>Not quite – I made reference to the size of the cuts made to certain capital grants in the settlement – I think I made reference as an example to the 55% cut made in capital grants to schools as reported to Children’s Overview &amp; Scrutiny Committee in the last few days by the responsible officers. The distinction is important because whilst capital grants are an important funding stream that the Council relies on to support its capital programme, they do not constitute the whole of the capital programme (as it is also funded from other sources too i.e. revenue contributions, capital receipts etc.</em><br />
•    This will mean a reorganisation of Council Departments. Only 7% cut in grants to voluntary bodies. <em>Average of 7% in respect of the Communities portfolio area.</em><br />
•    No introduction of fortnightly bin collections.<br />
•    No closure of libraries, but some opening hours reduced and some staff reductions.<br />
•    Continual downsizing of Council Departments, reduction of posts.<br />
•    Bournemouth is outsourcing most of their admin costs, but Poole is not convinced.<br />
•    Considering joint operation for services with Bournemouth, implemented Adult Teaching.</p>
<p>•    Council Gross Revenue Budget = £330 million, but if school expenditure is excluded 2011-2 Budget is £98 million. <em>Not quite right. I said the Gross revenues Budget in 2010/11 was approx. £330m (including schools). The Net Budget Requirement for the Council in 2010/11 was £98m. The Net Budget requirement is the composite amount of general formula grant and monies to be levied from local Council Tax to achieve a balanced budget (having first deducted specific grants funded nationally – which includes things like direct schools grant and housing benefits payments). The Gross Budget figure is more relevant therefore in discussing the relative size/activity of a Council. The Net Budget requirement figure however is needed to calculate the rate of local Council Tax (i.e. service costs not otherwise funded by specific grant, local fees    and income or by general formula grant).</em><br />
•    Council rents will increase 6.34%, but this is set by Government.</p>
<p>•    Wage increase on April 1: 0%. <em>This is the assumption made in the Budget proposed for Cabinet consideration next week.</em><br />
•    Reserves will be reduced to £5.9 million at April 1, 2011. <em>Final figure proposed is £5.96m for 11/12</em><br />
•    Beach hut and parking charges increased substantially, additional parking meters installed such as all Sandbanks Roads.<br />
•    2011-2 Council contribution for staff pensions will be 17.5%. 17.6% Increased to 18% 18.1% in 2012-3.<br />
•    Poole pensions are part of the Dorset County Pension Fund which is 80% funded (unlike central Government civil servants which are unfunded,i.e. current central pensions are paid for from current pension contributions. With longer living there is a MASSIVE pension liability.)<br />
•    The average pension that a Poole employee receives is only £4,000 per year. <em>I said that Lord Hutton’s initial conclusions were that public sector pensions were not ‘gold plated’ and that the average public sector pension was according to his report, £4k. I did comment that clearly the pensions of some individuals who earn considerably more than the average employee would be in receipt of larger pensions as Lord Hutton’s figures are based on national averages.</em><br />
2.<span style="text-decoration: underline;"> Problems</span><br />
The main cause of future financial pressures :<br />
(a) Major future demographic increase in age 65+ and 85+.<br />
(b) Increased birth rate by Poole residents, needing additional school places.<br />
Apparently Poole currently has a low inward migration rate.<br />
But with the planned 10,000 additional households in Poole this will mean population increases.<br />
(c) Poole has a Government grant £155 per head less than Bournemouth. <span style="text-decoration: underline;">£164 less than the average for all unitary authorities and £151 less than Bournemouth.</span><br />
(d) Most Councils have 50% of their revenue from Government grants, for Poole it is only 33%, so Council taxpayers have to make higher contribution. <em>Final figures now determined for central: local funding shows that<br />
•    Unitary average 48:52<br />
•    Poole 30:70 </em></p>
<p><span style="text-decoration: underline;">3. Future Action</span></p>
<ul>
<li> Draft Budget to Cabinet: Feb. 8.</li>
<li>Council approves final Budget: March 1.</li>
<li>Government wants zero tax increase, so like to give a 2.5% extra grant if this is implemented.</li>
<li>Police &amp; Fire Service have yet to agree their precepts, Government pressure for zero increase.</li>
<li>Department Heads have to propose 2012-3 spend by June. <em>Next budget round for 2012/13 will start in earnest across Service Units from June onwards with SUHs being required to begin working up proposals for 2012/13 budget purposes and next year’s re-fresh of the MTFP.</em></li>
</ul>
<p><strong>6. REPORT RE WORKSHOP EVENT RE TRANSPARENCY WEBSITE (28/01/11)<br />
</strong><br />
WH reported on the Workshop which had been held to show us how to use the transparency page on the BoP website. This is about 4 weeks behind the current date and amongst other things shows the Council expenditure over £500 – each month a new monthly section will be shown.<br />
This data is also available on a page showing the date over a 12 month period. This is useful as it allows the user to compare the BoP data with any one of the 70 or so other local authorities using this system.</p>
<p><strong>7.    ACCOUNTS TO DATE </strong>– JS reported that the total funds as at 31st January amounted to £33,203.72<br />
<strong></strong></p>
<p><strong>8.    ANY OTHER BUSINESS</strong></p>
<p><span style="text-decoration: underline;">Hedge at Kenilworth Court</span> – MH reports that work was due to commence yesterday, though she has not had a chance to go by to inspect as yet. The Highway&#8217;s enforcement officer is keeping a close eye on this issue.</p>
<p><span style="text-decoration: underline;">Vera Solomon </span>– Geoff Solomon, a former Vice-Chairman (1996-1999) and Chairman (1999) of the Assn, telephoned this morning to say that his wife, Vera, had recently passed away and it was likely that he would be moving away from the area. A new Road Warden will be needed for Potters Way.</p>
<p><span style="text-decoration: underline;">Data Protection Officer </span>– JS reported that Stan Alfert will be stepping down as Data Protection Officer at the next AGM. JS said that he was, naturally, sorry about this but did understand his reasons, particularly as he had been looking after the Membership database for the last 15/20 years.<br />
SA has kindly offered to print off 2 copies of the Wardens lists as at 31 Dec for Michael Bond within the next couple of months and also the Wardens&#8217; labels, as this will give us a &#8216;breathing space&#8217; to consider the way forward.</p>

<p><strong>1. APOLOGIES AND ACCURACY OF MINUTES</strong></p>
<p>JS welcomed Cllrs Mrs Haines &amp; Sorton and all those present.</p>
<p><strong>Apologies:</strong> Apologies received from Stan Alfert, Geoff Solomon &amp; Chris Stracey<br />
<strong>Accuracy:</strong> JS said that he would sign the Minutes as a true and accurate record of the meeting held on 10 NOVEMBER 2010.</p>
<p><strong>2. MATTERS ARISING </strong></p>
<p><strong>Poole Pottery/Old Orchard/Quay Thistle Hotel sites update: </strong>JS reported&#8230;<br />
1.    <span style="text-decoration: underline;">Quayside (former Dolphin Quays) development </span>– No new developments</p>
<p>2.    <span style="text-decoration: underline;">Poole Pottery factory buildings in Sopers Lane </span>– Planning application for an 80 bed care home with associated facilities refused by Planning Committee on 11/11/10. Chairman&#8217;s note: I have been notified that an appeal against this decision has been lodged by the applicant.</p>
<p>3.    <span style="text-decoration: underline;">Former Poole Pottery &amp; Swan Inn site</span> – No new developments</p>
<p>4.    <span style="text-decoration: underline;">Quay Thistle Hotel site</span> – ditto</p>
<p>5.    <span style="text-decoration: underline;">Old Orchard House. 39-61 High Street</span> – ditto</p>
<p>6.   <span style="text-decoration: underline;"> Land at West Quay Road</span> (Mixed use regeneration and new public quayside to include; the demolition of a listed gate post and all existing buildings on site; the redevelopment of the site with 440 residential units provided in six apartment blocks with basement parking and courtyard) &#8211; TS reported that there was a public exhibition of the proposed design of the new development and there was an overwhelming vote against this design by the 155 or so people who had viewed the exhibition. In consequence, the Planning Department has asked the developer to think again and they have appointed a new architect. They have said that new design will be available at the end of January, 2011, which will go forward to the Planning Committee in February.<br />
There are now four conservation bodies campaigning as they are very concerned over the development of some of these sites &#8211; including the proposals by the Poole Harbour Commissioners to build a very large marina off Hamworthy Park, which is very unpopular<br />
TS also reported that two big developments in West Quay Road have both refused to make any contribution towards affordable housing as they are not making enough profit.<br />
WM felt that it is far too easy for the developers to show that they are making losses and therefore cannot afford to make contributions towards affordable housing.</p>
<p><strong>Planning Enforcement, TPOs/Tree replacements</strong> – update: JS reported&#8230;</p>
<p>1 <span style="text-decoration: underline;">Cliff Drive </span>Complaint received regarding extra windows being installed at this property. Following discussions with contractors Celebration Developments and Greenwood Associates, an application to regularise the development is being submitted.</p>
<p><span style="text-decoration: underline;">17 Over Links Drive</span> (Application to demolish existing and erect 2 detached houses granted on 31/01/08 but number of conditions should have been complied with before this development commenced) – No new developments.</p>
<p><span style="text-decoration: underline;">19 Mornish Road</span> (Tree replacement) – ditto</p>
<p><span style="text-decoration: underline;">55 Canford Cliffs Road</span> (Removal of the gates, railings, fence and hedge, and the erection of a low stone wall with planting behind) – ditto</p>
<p><span style="text-decoration: underline;">15A Westminster Road</span> (Erection of railings over 1 metre high partly along the frontage of 15a Westminster Road, being adjacent to a highway. The boundary treatment then changes to a double close boarded fence over 1 metre high which continues along the frontage of Westminster Road, being adjacent to a highway and then turns South-West and continues down the boundary with Dalkeith Road being also adjacent to a highway)– ditto</p>
<p><span style="text-decoration: underline;">2 Compton Avenue &amp; 93 Lilliput Road</span> (Boundary treatment) – ditto</p>
<p><span style="text-decoration: underline;">24 Ravine Road </span>(Overhang on right hand side of garage is 800mm but should be 200mm) – Retrospective application refused on 26/10/10.</p>
<p><span style="text-decoration: underline;">Land adj to 20A Chaddesley Glen</span> (Land be reinstated) &#8211; An enforcement notice was due to be served requiring the land be reinstated. The damage to the trees is also under investigation. A revised scheme to erect detached garage, store, brick piers and wall was lodged on 09/11/10.</p>
<p><strong>Community Working Group (CWG)</strong>: In the absence of Roy Pointer who arrived later in the meeting, JS    JS/WH reported that the next CWG meeting is on 26/01/11. RP has had to tender his apologies for the meeting and JS has offered to take his place. This would have been the last meeting that RP was permitted to attend under the two year rule and Wayne Hancock has kindly agreed to take RPs place at future<br />
meetings.</p>
<p><strong>Poole Beaches and Coastal Defences</strong>: JS reported that the majority of the Shoreline Management    RP Policies for the coastline of Poole have remained the same as those of the original document. There have been some minor changes in policies for some sections of the coastline and he would include details in the Minutes – see below<br />
• The Policy for the length of coastline around Holes Bay has been split so the coast adjacent to the urban area can remain “hold the line” and the length of more natural coast adjacent to Upton House is classified as “no active intervention” allowing the existing natural erosion to continue. • The Policy for the length of coastline between Lake Pier and Rockley Point has changed to selected “hold the line” to allow natural erosion of the coast adjacent to Ham Common and protection of the coast adjacent to Rockley Caravan Park.<br />
• The Policy for the eastern side of Lytchett Bay is changed in the medium to long term to “hold the line” to allow for the possible construction of new defences required to manage potential flood risk.</p>
<p><strong>Council Tax 2010/11 &amp; Council&#8217;s Budget Monitoring report:</strong> William Mutlow reported on the Council Budget Monitoring (1 April 2010 &#8211; 31 October 2010) report presented at the previous night&#8217;s Cabinet meeting.    The budgeted deficit for 2010/11 has been reduced to £68,000 from the £640,000 deficit last month.<br />
However, significant pressures remain within Adult Social Care and in a number of the Council&#8217;s income streams, which are too volatile to predict and could add further pressure to the amounts already assumed within the Budget.<br />
JS reported that the council had been reviewing the boundaries in Poole with a view to reduction in the numbers of Councillors, however, at the previous night&#8217;s Cabinet meeting, those attending were told that there will be no reduction in 2011 and it is not likely to be before 2015 that the Boundary Commission will look at the boundaries. NS asked if the Association had any views on this situation. TS replied that we would be loathe to lose any of our three Councillors as we wish to have as good a representation as possible.<br />
There were no further comments on the number of Councillors we have for our Ward.</p>
<p><strong>Poole Partnership:</strong> – JS reported that he &amp; TS attended workshop on  24/11/10 at the Civic Centre to    JS consider the implications of the  recent Comprehensive Spending Review for delivering public services in  Poole and explore the opportunities for working together to deliver  services more effectively and efficiently. JS added that he was  disappointed with the time it took to make the presentations<br />
TS reported that we had had a financial workshop some six weeks previous  to this. Those from the Association who had attended were of the view  that this was a PR exercise on behalf of the council,  primarily to get the message across that what will happen in the form of cuts is going to be painful, as no specific information was available.<br />
JS and WH also attended a &#8216;Great sharing event&#8217; at Great Western Hotel, Bournemouth on 26/11/10 hosted by the Principal of Bournemouth &amp; Poole College to explore the use the College assets to serve the community. The College is attended by some 4,500 students but, for the most part, Bournemouth and Poole residents are unaware of the facilities available to general public.</p>
<p><strong>Public Rights of Way:</strong></p>
<p><span style="text-decoration: underline;">Westminster Road end of Dalkeith Road</span> – No new developments.</p>
<p><span style="text-decoration: underline;">Buccleuch Road to Lakeside Road</span> – ditto</p>
<p><span style="text-decoration: underline;">Bessborough Road</span> – ditto</p>
<p><span style="text-decoration: underline;">Footpath 82 Spur </span>– Sandbanks Boatyard &amp; Marina Co. Ltd had until 25/11/10 to appeal against the Definitive Modification Order to add Footpath 82 Spur but the latest position has yet to be announced.</p>
<p><strong>Possible Charitable Status for Assn:</strong> JS has still to set up a small Sub-Committee to look at this.</p>
<p><strong>Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden)</strong>:    JS reported the Assn had received from Poole Council Asset Management &amp; Property Services Unit a copy of the heads of terms that will become the basis of the Licence for the Sunken Garden for comment and also a plan of the site to mark the areas the Assn will be responsible for maintaining along with the Assn&#8217;s proposed timings for the works. It was agreed that JS would circulate this to the members of the Executive.<br />
NS reported later in the meeting that, as Cabinet Member, he had recently signed-off the funding for the Canford Cliffs Play Area. The funding allocated was up to £50,000. Other work would include new bins and benches, signage and fencing. In addition to the above funds, the Land Society is willing to contribute £5,000 towards the scheme, specifically for seating, the reinstatement of views and other ground maintenance works.</p>
<p><strong>Public Liability Insurance (PLI)</strong> – JS is pursuing.</p>
<p><strong>Poole Council&#8217;s Efficiency Review Programme:</strong> JS reported that, at last night&#8217;s Cabinet, efficiency savings were reported in the current year 2010/11 of £215,000.<br />

<p><strong>Parking in Shore Road: </strong>NS presented the petition to the Transportation Advisory Group meeting on 25/11/10 and it was recommended that a permit for commercial vehicles be introduced at a cost of £350 a year.</p>
<p><strong>3. NEW HOUSING DEVELOPMENT</strong></p>
<p>KA reported&#8230;</p>
<p><span style="text-decoration: underline;">11 Westminster Road</span> (Demolition of the existing building and  construction of three detached houses with associated parking and  access. (revised scheme – Appeal dismissed on 17/11/10</p>
<p><span style="text-decoration: underline;">7 Lakeside Road </span>(Erect a three storey block of six x two bed flats and one three bed duplex with basement parking. (Revised scheme) (as amended by plans received 29.04.10) – Appeal dismissed on 07/12/10.</p>
<p><strong>Other current planning issues</strong></p>
<p><span style="text-decoration: underline;">The Nightjar, 6 Ravine Road</span> (Fit new set of french doors to west elevation, erect new boarded timber fence and install a new extract system on roof at the rear) – Application registered on 04/10/10. Local concerns.<br />
<span style="text-decoration: underline;">7 Ventry Close</span> (Erection of 1no. dwelling and rationalisation of garage accommodation to no 7 Ventry Close) – Application registered on 15/10/10. Revised site location plan lodged on 03/12/10.<br />
<span style="text-decoration: underline;">8 Shore Road</span> &#8211; BPCCRA will continue to monitor possible tree work application.    An entrance has been created on the Haven Road side of this property. This property is up for sale at is &#8216;offers&#8217; in excess of £2m.<br />
<span style="text-decoration: underline;">60A Kings Avenue</span> (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council&#8217;s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.</p>
<p><strong>5.    ACCOUNTS TO DATE </strong>– JS reported that the total funds as at 30th November amounted to £30,866.22</p>
<p><strong>6.    ANY OTHER BUSINESS</strong></p>
<p><span style="text-decoration: underline;">Twin Sails Bridge: </span>JS reported that the Audit Commission&#8217;s Annual Audit Letter was presented at the    JS previous night&#8217;s Cabinet meeting. Concern is expressed in the letter over how Poole is going to repay £9.96 million it borrowed from the South West Regional Development Agency&#8217;s Regional Infrastructure Fund is part of a total project cost of £37 million. This is due to be repaid from future developer<br />
contributions from the regeneration sites from 2013.<br />
However, Annual Audit Letter says that “the economic conditions and the depressed housing market mean there is some uncertainty about the amount and timing of these contributions. Challenges to the application of the South East Dorset transport contributions policy also means that there is some uncertainty about planning contributions from this source&#8221;<br />
Roy Pointer pointed out the two triangular shaped lifting leaves, symbolising the sails of a yacht, will only be visible when these are upright, whereas for the majority of the time these will be down. He wonders if, because of this, the bridge will be prove to be much of a draw to tourists.</p>
<p><span style="text-decoration: underline;">Localism and Decentralisation Bill:</span> TS reported that the Government are going to Introduce a Localism and Decentralisation Bill. This will give quite a lot of local power to Residents’ Groups, etc. It is expected that bodies like the Assn will be able to shape where they live in the manner of Parish Plans which have already been introduced in rural Dorset. These are developed by consulting all the local residents of the Parish and drawing up detailed plans of how that particular community wants that Parish to develop. These have been highly successful. TS expects a similar sort of process will be carried out in urban areas such as this. This may give the local Residents’ Associations the power to grant or refuse planning permission.</p>
<p>There being no AOB, the meeting closed at 8.15pm and was concluded with mulled wine and mince pies.</p>

<p>C<strong>ommunity Working Group (CWG): </strong>Roy Pointer reported on CWG meeting held on 22/09/10 and said that the Minutes of the meeting would be circulated with the Minutes of tonight&#8217;s meeting.<strong> </strong></p>
<p>RP reported that the Members&#8217; Annual Tour of Inspection, which was due to take place last month, will now take place on 09/11/10. The tour is part of the member training programme, as well as an opportunity to review the quality of recent development and the success, or otherwise of place shaping. Five CWG members have been invited to join the Tour and RP has put his name down for this.</p>
<p>JS pointed out that the Tour of inspection is concerned with large sites and he did not feel that Members would have time to visit small sites in our area.</p>
<p>However, Cllr Mrs Haines said that she had recently had reason to visit 29 Forest Road <em>(13 houses with associated parking) </em>and felt the development did actually look attractive. This was a sub-division of a large plot and Cllr Mrs Haines suggested that this particular site could be put forward as a site to be visited by the Tour of Inspection to see if a development such as this works.</p>
<p><strong> </strong></p>
<p><strong>Poole Beaches and Coastal Defences</strong>: RP said the the issue of flood defences is due to be  discussed at the next CWG meeting.</p>

<p><strong>Council Tax 2010/11 &amp; Council&#8217;s Budget Monitoring report: </strong>TS reported on the Financial workshop held on 24/09/10 as part of the consultation on the Council&#8217;s 2011/12 Budget.</p>
<p>Six members of the Association attended along with 14 others to review the proposed cuts of £29m over the next four years from the Council’s annual budget of £100m. Each participant was given a list of the costs for each department. These amounts varied considerably, from ‘Adult Social Services’ which is 39% of the total budget to ‘Parks’ which is only 1%. Those attending were asked to try to cut the budget in each section by various percentages. TS said that those attending found this well-nigh impossible as they did not have sufficient information as to the breakdown of the budgets.</p>
<p>Everyone from the Association who attended decided that even though they had some good discussions the whole thing was just a PR exercise to demonstrate how painful these cuts were going to be.</p>
<p>TS has since received an e-mail from Cllr Peter Adams asking for his suggestion as to what the next meeting might consist of.  TS will reply that those attending need more detail so that they know in practice what each cut will mean.</p>
<p>There then followed many comments and much discussion on the Council budget; mainly between the members of this Association who had attended the Workshop.</p>
<p><strong>Chairman&#8217;s Note: </strong>The formal notes of the meeting will be circulated the Minutes of tonight&#8217;s meeting.</p>
<p>As TS had to leave the meeting early to attend, he used this opportunity to give feedback on his attendance earlier today at the first in a series of Twin Sails Bridge/Regeneration Open Days</p>
<p>He reported that the exhibition really brought home to him just how massive the changes are going to be to the centre of Poole.  He is worried that there does not seem to be a clear design or masterplan and each developer will develop how he wants to, or how much he can get away with to maximise their profits.  There is so much concern about this that a new Committee has been formed ‘The Vision for Poole Committee consisting of The Society for Poole Men, the Old Town Conservation Group and Dorset Campaign for the Protection of Rural England. The aim of this committee is to ask for tighter guidance and control of these ten sites. TS said that, in his opinion, Members need to stand up and be counted and really take a grip as the situation which, in his view, seems to be out of control.</p>

<p><strong>Poole Partnership: </strong><strong><em>-</em></strong><strong><em> </em></strong>JS reported that the joint meeting of Poole and Bournemouth Vision Groups which was due to take place on Monday 5th October has been postponed until after the Comprehensive Spending Review.</p>
<p>The Poole Partnership Local Development Framework Working Group meeting which was fixed for yesterday was also cancelled.</p>

<p><strong> </strong></p>
<p><strong>Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden):</strong></p>
<p>Cllr Mrs Deas said that she had spoken with Simon Legg, BoP Greenspace Maintenance Team Leader, yesterday and the process is well underway. He hopes that the takeover of the garden will be pretty soon and he is drawing up details to the BPCCRA for their agreement and approval of the necessary documents needed to be signed by the Association, i.e. insurance, peppercorn rent etc.</p>
<p>Cllr Mrs Deas also reported on her support for Affordable Housing. She has been pushing for the Council to adopt the procedure of Kingston-upon-Thames. For instance, on contentious issues, the council do not go ahead and give approval without seeking the views of the residents.</p>
<p>She has so far had little success in this and asks that the Resident’s Associations should press as hard as they can to get this implemented.</p>
<p>Cllr Mrs Deas went on to say that she had attended a Planning Summer School some years ago where it was demonstrated that it is possible to regenerate the centre of a town sympathetically by incorporating modern architecture alongside old architect extremely successfully which she feels should be done in Poole centre.</p>
<p>JS pointed out that when Gallahers are ready to come forward with fresh plans for the former Power Station site, he feels sure that these will be the subject of a Local Engagement Forum.</p>
<p><strong>Chairman&#8217;s note: </strong>The purpose of the Local Engagement Forum is &#8220;to enable those members of the community who might have meaningful comments to make on a major development, to have the opportunity to listen to detailed discussions and participate in the shaping of the scheme before it is submitted to the Council for a decision, as part of the Planning process.&#8221;</p>
<p><strong>Policy for financially supporting objectors to Planning Applications:</strong></p>
<p>JS read the proposals put together by Roy Pointer and SA, which were distributed to members at the meeting. These were:</p>
<p>1. Delegated authority is given for a Sub-group, following the request of any member, to engage specialists to draft formal representations in respect of Planning Applications which the Sub- group considers would:</p>
<p>(a) if approved, involve a substantial departure from the intent of national or local planning policy or regulations, and/or</p>
<p>(b) set an undesirable precedent for future development in the area covered by the Association.</p>
<p>2. The Sub-group has no authority to act in regard to Applications that relate to development outside the Association’s area nor on any request from any Member that objection be made to any Application which objection is, in the Sub-group’s opinion, largely made on a subjective basis, e.g. a mere dislike of the proposal. Any representations shall be based on planning considerations alone.</p>
<p>3. The Sub-group shall have no authority to arrange representations in respect of any planning appeal. The Sub-group shall comprise:</p>
<p>The Chairman of the Association</p>
<p>The Planning Officer of the Association</p>
<p>One other Member</p>
<p><strong>Delegation to commit funds</strong></p>
<p>4. The Sub-group may commit up to £1,000 or 50% (whichever is the lower) of the total cost of specialist services in respect of a single representation providing the sum committed is a full and final cost of the service up to the point of submitting the representation and not an initial instalment against further or unspecified costs of representation in respect of the Application.</p>
<p>5. The Sub-group shall report to the next regular meeting of the Association, any action taken under this delegation and, if necessary, seek guidance from the Association on any further action.</p>
<p><strong>Review</strong></p>
<p>6. The application of this delegation arrangement shall be reviewed by a Committee of the Association after the commitment of a total of £5,000 of funding, or two years operation of this Delegation, whichever shall first occur.</p>
<p>The Chairman then asked the meeting for comments.</p>
<p>Chris Stracey said that a residence had been built in his road that resembles ‘a white shoe box’, completely unlike anything else in the road, even though many objections were raised at the time.</p>
<p>The Chairman cited two fairly recent cases. That at 11 Leicester Road <em>(Outline application to demolish existing dwelling &amp; erect a 59 bedroom care home (class C2) with associated parking (15 spaces) </em>for which the professional representation was funded by the neighbour, and Kingsgate, 7 The Avenue for which the Association contributed £1,000 towards the £11,000 it had cost for professional representation.</p>
<p>The above proposals are meant to help objections where an awful precedent would be set were the developing plans allowed, and not for smaller instances, for which KA provides the wording for an objection letter to the Council from the Association.</p>
<p>TS pointed out that the principle of this is that the Association contributes towards professional advice to fight a local contentious issue whereby a number of residents would be affected, or where it would set an undesirable precedent.</p>
<p>Cllr. Mrs Deas said that Kingsgate, 7 The Avenue, was a good example. Mr. &amp; Mrs. Lace have just received notification from Barrister’s opinion that they can actually stop anyone accessing the  driveway. The Council were arguing against this and backing Seven Developments but through Barrister’s Opinion the residents have discovered that they do in fact own four-fifths of the driveway and they are entitled to withhold right of way. This will send out a clear message to Seven Development that residents will fight to the end, even if Council have already given their planning permission.</p>
<p>KA pointed out that it is very difficult to legislate to cover all situations. SA proposed that we accept the proposals as they stand now.</p>
<p>The Chairman asked for a show of hands that these proposals be adopted with a note to cover KAs point.</p>
<p><strong>Public Liability Insurance (PLI) </strong>- JS is pursuing.</p>
<p><strong> </strong></p>
<p><strong>Poole Council&#8217;s Business Transformation/Efficiency Review Programme: </strong>An updated report on this programme is due to be presented to the Council Efficiency and Effectiveness Overview and Scrutiny Committee meeting in February 2011.</p>
<p><strong>Funding for the NHS Dental Practice in Westbourne: </strong>JS reported that Mr Hamid Kolahy of the Westbourne Dental Practice had recently written to Jim Wilson to say that his practice n Alum Chine Road is only paid at £19.50 per UDA compared with three other local dental practices are paid at a higher rate Alderney Dental Practice, 451 Ringwood Road £26.00 per UDA (3.1 miles) Pasadena Dental, 210 Ashley Road, Parkstone £24.50 per UDA (1.6 miles) Parsa Dental, 11 The Triangle, Bournemouth £24.00 per UDA (1.1 miles)</p>
<p>JS ascertained that none of those present at the meeting actually use the Westbourne Dental Practice and it was decided that the Association took no action to follow this u, especially as it is outside our own area.</p>
<p><strong>Chairman&#8217;s note: </strong>In a note from Sarah, the Director of Patient Safety and Quality, NHS Bournemouth and Poole to Jim Wilson dated 19/07/10, she says that it is &#8220;not in a position to reimburse all dentists to the highest level of payment and due to the contractual position of dentists; it would not be possible to remove resources from another dentist. However, when Units of Dental Activity become available, for example if a dental practice closes, the PCT will put the activity out to tender with a view to securing a dental service in line with our Oral Health Needs Assessment. In this way, dentists can secure additional activity and we will at the same time review the value of the UDAs.&#8221;</p>
<p><strong>BPCCRA Autumn 2010 Magazine: </strong>JS signed off final version on 11/10/10.</p>
<p>SA reported that the lists of wardens had now been printed and those who distribute the magazines should be getting their printed lists from Michael Bond within the next couple of weeks. SA appealed to Wardens to let him know where the data is wrong, so that the Assn can</p>
<p>maintain the best possible database.</p>
<p><strong>Parking in Shore Road: </strong>Cllr Mrs Haines reported that she was due to present a petition from residents living in Shore Road and Brudenell Avenue, about camper vans being used as &#8216;beach- huts&#8217; &amp; overnight sleeping and water sports vans parking 24/7 in Shore Road by taking advantage of Beach Parking Permits, to the Transportation Advisory Group meeting on 07/10/10 but this was cancelled and the next meeting will take place on 25/11/10</p>
<p>As Cllr Mrs Haines will not be here for this meeting the petition will be presented by Cllr. Sorton. Another Ward Councillor will also be at this meeting as other areas in the Borough also have similar problems with camper vans.</p>

<p><strong>4.   UPDATE RE CANFORD CLIFFS &amp; FENN HILL AREA COMMITTEE MEETING (15/09/10) Chairman&#8217;s Note: </strong>I omitted to cover this item.</p>
<p>Lengthy discussions took place on recent changes in the Penn Hill Avenue and suggestions were made for improvements to the Kingsbridge Road/Highmoor Road junction.</p>
<p>Officers from Strategic Planning gave presentations on Preferred Options for Additional Sites &#8211; Consultation on Proposed and Revised Policy Areas</p>
<p><strong> </strong></p>
<p><strong>5.                  ACCOUNTS TO DATE </strong>- JS reported that the total funds as at 30th September amounted to £33,187.32, which takes account of the £3,000 donated to the Canford Cliffs Village Hall. It has also been agreed to make a payment of £1,000 to the flat-owners at Kingsgate, 7 The Avenue towards their costs of £11,000 fighting Seven Developments applications for the site at the rear.</p>
<p><strong>6.                  ANY OTHER BUSINESS</strong></p>
<p>Ward Walks &#8211; Cllr. Sorton reported on his Ward Walk with Cllr. Mrs Haines. Part of this was in Canford Cliffs Village and had suggested that we get rid of some of the clutter’ &#8211; in particular some of the litter bins. Cllr. Haines added that the question of trees in Haven Road had been brought up with the officers &#8211; trees contained in pots perhaps.</p>
<p>The next area visited was Mountbatten Road/Cassel Avenue area to check the distinctiveness, and will ask for this area to be given Conservation Area status.</p>
<p>Turning circle in Torbay Road &#8211; Rose Rogers asked if there were any regulation covering a rubbish skip left permanently obstructing this part of the road Cllr. Mrs Haines said that there was no restriction to having a skip in your own drive. JS suggested that she took up this question with a Penn Hill Ward Councillor, or that she contacts Transportation Services for their advice.</p>

<p><strong>A<span style="text-decoration: underline;">. Nigel Jacobs : Strategic Planning</span></strong></p>
<p>1. I recommend you get hold of the plan and drawings of ‘Poole’s Masterplan. A town Fit for the 21<sup>st</sup> Century.’</p>
<p>2. Because of cuts &amp; staff shortages they are limited on their work. Current Priorities :</p>
<p>(a) Dorset Heathlands, because of commitments to other Dorset Councils. Nigel leads this project.</p>
<p>(b) Site Specific Plan.</p>
<p>(c) Infrastructure Plan.</p>
<p>(d) Update SPG2 Design Masterplan.</p>
<p>3.They will be starting shortly on updating SPG2.</p>
<p>4.Warren Lever has been asked to look at setting up a Design Forum. Currently the thought is for one covering Bournemouth and Poole. Examples of good forums have some Community participation. Important that one of us is on the Forum.</p>
<p>5.There has been pressure to relax some elements of the SPG2 requirements because of the Recession. The Core Strategy Inspector recommended a more flexible approach to development in the regeneration area to enable development to occur recognising its impact on viability.</p>
<p>6. The Council <em>(i.e. the Councillors if they have the leadership guts </em><em>␣</em><em> </em><em>my comment) </em>are faced with a choice:</p>
<p>(a) If they want speedier development to provide employment, etc. it will mean lower CIL (Section 106 contributions) for Affordable Housing, and other Infrastructure with less discipline on enforcing SPG2 and other Core Strategy requirements.</p>
<p>Or b) holding up approving the key sites until the economy picks up when the developer profits improve and they can secure contributions to meet the stated needs set out in policy.</p>
<p>7. Planning Department has the power to refuse an application if the architectural design is poor.</p>
<p>8. In the end it is up to Councillors to make this decision. I believe we can apply heavy democratic pressure on Councillors leading up to the Local Elections in May, to apply Option B.</p>
<p>9. CABE have just done a review of the current Masterplan and are relatively happy that there is nothing fundamentally wrong with the principles within. Unlikely they will be issuing a written report.</p>
<p>10. The West Quay Road site is a critical to the regeneration of Poole and ideally would come forward last, although the Council has no control over the timing of planning applications. The Council will need to take a view as explained in 6.</p>
<p>11. The Core Strategy statement on number of units per site is a minimum figure. Overall the Core Strategy has to deliver a minimum number of dwellings (PCS5). If developers choose to go for different levels of use then they need to justify against what the overall approach to a site/location is demonstrating that their scheme can meet stated objectives for the Town.</p>
<p>12. He believed that Gallahers would be unlikely to gain support for 1,600 units on Hamworthy site ␣ as compared with Core Strategy 1,100 plus. Anticipates that any future scheme would not be too far away from baseline in Core Strategy.</p>
<p>13. The outline approval for the West Quay Marina site, s106 not yet signed, includes a provision that if the economy picks up and the developer makes more profit than forecast, the Council can re-visit the calculations and secure some Affordable Housing, etc. contributions. This approach is now being worked into other s106 agreements where viability is an issue.</p>
<p>14. Sainsbury are in no hurry to submit an application for development of their car park.</p>
<p>15. There is no indication that the Goods Yard site will be redeveloped soon although Network Rail retains aspirations for a new station but only as part of a development package for the whole site.</p>
<p>16. The multi-storey car park next to the Dolphin Centre may be demolished to allow extension of the centre.</p>
<p>17. The future of the Barclays Tower is uncertain. At some stage Barclays will want modern office accommodation which presents issues over what happens to the current building. Refurbishment is an option but redevelopment probably more likely. Barclays are committed to staying in Poole and there is no timeframe on any changes to this site.</p>
<p>18. The new Lifting Bridge will always be raised first. If there is heavy boat traffic in the summer the Harbour Master will have the power to raise both bridges at the same time should there be safety issues. There will be a bridge control unit on the Gallagher site with views of both bridges.</p>
<p>19. The bus depot behind the multi-storey park will be relocated to an industrial estate to allow expansion of the Dolphin Centre. The Bus Station will not be moved, but it may be re-modelled to allow for the Centre’s expansion.</p>
<p><strong><span style="text-decoration: underline;">B. Chris Francombe : Transport Planning</span></strong></p>
<p><strong><span style="text-decoration: underline;"> </span></strong></p>
<p>1. A31 link from the Port to Merley, Gravel Hill is unlikely to be dualled in the near future. The A31 round Wimborne may be dualled from 2020, but will depend on Government cuts.</p>
<p>2. Dorset County Council has agreed that the junction at Merley between the A31 and the A 349 will be closed for 2 weeks and 1 day so the 200 VIPs can be guaranteed to travel from London to Weymouth in 2 hours 43 minutes.</p>
<p>There has been no decision yet about the period of the Paralympics. Poole Council were not fully consulted, but are demanding in return that the Canford Bottom roundabout be converted into a hamburger design with the A31 going straight though the middle. Later the roundabout may have a flyover across the middle. There is likely to be traffic chaos during this period.</p>
<p>3. The £40million link from the A338 to the Airport will not be built since there is not a large enough traffic forecast.</p>
<p>4. The industrial site at the Airport is being reduced from 40 hectares to 20. The public bus service will be inadequate. Much employment will be provided at the Ferndown Estate planned for 20 hectares.</p>
<p>5.            Still discussing whether Kingland Road will be closed between the bus station and the Lighthouse. Key is the road into the bus station. Kingland Road may be reduced to a single one- way road.</p>
<p>6.            The rail link to Swanage will be implemented; current cost £40million, but depends on Railtrack problems.</p>
<p>7.            The rubble from the Hamworthy site will be removed over the 2nd lifting bridge and then down Holes Bay Road.</p>

<p style="text-align: left;"><strong>1. APOLOGIES AND ACCURACY OF MINUTES</strong></p>
<p style="text-align: left;">JS welcomed the three Ward Councillors and all those present. JS also thanked Sam Waldron for stepping in as Minutes Secretary.<br />

Accuracy: JS said that he would sign the Minutes as a true and accurate record of the meeting held on 11 AUGUST 2010, subject to the item about (a) &#8216;Cars parked in Ravine Road&#8217; and (b) &#8216;Pinecliff Gardens  (Sunken garden)&#8217;<br />
In the case of (a), MH has asked that the paragraph should be amended to read “the situation is that the transporter is allowed to park up for the purposes of loading and un-loading ONLY and should not be parked up. With regards to the forecourt cars, they can be parked there but subject to the normal restrictions. The traffic wardens will be asked to patrol that area more frequently to ensure that these cars do not exceed the restriction, otherwise they will be ticketed.<br />
In the case of (b), SA said that his concern was that the 3rd party insurance should cover all individuals working at the Sunken garden in Pinecliff Gardens. He feels that the Assn must have confirmation from the Council that this is the case.</p>
<p style="text-align: left;"><strong>2. MATTERS ARISING Poole Pottery/Old Orchard/Quay Thistle Hotel sites update: </strong>JS reported&#8230;</p>
<p style="text-align: left;">1.    Quayside (former Dolphin Quays) development – No new developments</p>
<p style="text-align: left;">2.    Poole Pottery factory buildings in Sopers Lane – Another planning application has been registered for this site but details have yet to be posted on the BoP website.</p>
<p style="text-align: left;">3.    Former Poole Pottery &amp; Swan Inn site – No new developments</p>
<p style="text-align: left;">4.    Quay Thistle Hotel site – ditto</p>
<p style="text-align: left;">5.    Old Orchard House. 39-61 High Street – ditto</p>
<p style="text-align: left;">6.    Land at West Quay Road (Mixed use regeneration and new public quayside to include; the demolition of a listed gate post and all existing buildings on site; the redevelopment of the site with 440 residential units provided in six apartment blocks with basement parking and courtyard) – TS said that the building is ugly, ignores planning guidelines and is too dominant. The Society of Poole Men, Poole Old Town Conservation Group and Dorset CPRE have formed a new “Vision for Poole” Committee to fight this application and pressure Councillors to tighten design rules for the 10 redevelopment sites within the regeneration area.</p>
<p style="text-align: left;"><strong>Planning Enforcement, TPOs/Tree replacements</strong> – update:</p>
<p style="text-align: left;">JS reported&#8230;</p>
<p><span style="text-decoration: underline;">17 Over Links Drive</span> (Application to demolish existing and erect 2 detached houses granted on 31/01/08 but number of conditions should have been complied with before this development commenced)<br />
Chairman&#8217;s Note:An undertaking has been requested that before any further on-site works are carried out that the owner seeks advice from an ecological adviser how best to prevent the risk of protected species entering the development area, and that he will erect some form of tree protection to ensure that no further damage to tree roots occurs.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">19 Mornish Road </span>(Tree replacement) – ditto</p>
<p style="text-align: left;"><span style="text-decoration: underline;">55 Canford Cliffs Road</span> (Removal of the gates, railings, fence and hedge, and the erection of a low stone wall with planting behind) – ditto</p>
<p><span style="text-decoration: underline;">15A Westminster Road</span> (Erection of railings over 1 metre high partly along the frontage of 15a Westminster Road, being adjacent to a highway. The boundary treatment then changes to a double close boarded fence over 1 metre high which continues along the frontage of Westminster Road,being adjacent to a highway and then turns South-West and continues down the boundary with Dalkeith Road being also adjacent to a highway)– ditto</p>
<p style="text-align: left;"><span style="text-decoration: underline;">2 Compton Avenue &amp; 93 Lilliput Road</span> (Boundary treatment) – ditto</p>
<p style="text-align: left;"><strong>Community Working Group (CWG):</strong> The next CWG meeting is fixed for 22/09/10. JS reminded members that an annual up-date on Sir Michael Pitt&#8217;s independent review &amp; the IDeA Peer Review of planning matters in Poole is due to be presented to the Council Efficiency and Effectiveness Overview and Scrutiny Committee meeting on 23/09/10.</p>
<p style="text-align: left;">Roy Pointer referred to the Ward Walk Report and pointed out that there were no time scales/actions.    He will be following this up at the next CWG meeting<br />
RP for consultation and comments are invited.</p>
<p style="text-align: left;"><strong>P</strong><strong>oole Beaches and Coastal Defences</strong>: Roy Pointer pointed out that the Environmental Statement is out Council Tax 2010/11 &amp; Council&#8217;s Budget Monitoring report: William Mutlow reported that the latest Corporate Financial Monitoring report for the period from 01/04/10 to 31/07/10 shows a surplus of £216K.<br />
As a result of Government cutbacks and increased pressures such as Adult Social Services, reduction in Planning Services/Building Regulations Service fees etc, the revised General Fund pressure has risen from £8,434m for June 2010 to £9.986 for July 2010 but total reductions found to date have increased from £8,616m to £10,202.<br />
The capital projects currently in hand will continue but the prospect for new capital projects will, of course, depend on the finance being available.<br />
TS reported that the Council are organising a Financial Workshop for representatives of all Residents’ Associations to discuss next year&#8217;s Budget in the Committee Suite at the Civic Centre on 24 September 9.30 – 12.30/13.00.<br />
Cllr Leverett will be writing to shortly to invite their attendance. The number of representatives per Residents&#8217; Assn has yet to be announced.</p>
<p style="text-align: left;"><strong>Poole Partnership: – </strong></p>
<p style="text-align: left;">JS reported that the Stronger Communities Partnership meeting scheduled for 08/09/10 was cancelled.<br />
There are likely to be some important developments over this month and October which could have an influence on the work of the Stronger Communities Partnership, including the governments spending review and developments with their Big Society agenda. As a result, it was felt that it would be more useful to meet later in the year, once a better understanding is known how these issues will affect this group.<br />
The outcome of the Poole Partnership Management Board which met on 02/09/10 has yet to published in the public domain.<br />
TS asked JS if he would like to say a word about the Local Enterprise Partnership (LEP).<br />
The LEP was lodged with the Department for Business Innovation and Skills on Monday and was endorsed by the Cabinet at their meeting last night. Following the dissolution of the Regional Development Agencies, Poole, Dorset and Bournemouth Councils have got together to submit an Expression of Interest in forming a LEP.    This will have an independent chairman – Gordon Page (who heads up Hamworthy Engineering).<br />
NS said that the LEP will supersede the Wessex Multi-Area Agreement which is a multi-faceted enterprise. HC asked if a copy of the Expression of Interest is available on the BOP website. JS said he will enquire. Roland Cunnell said that Mr Page used to be Leader of the Dorset Training Enterprise Council</p>
<p style="text-align: left;"><strong>Public Rights of Way:</strong></p>
<p style="text-align: left;"><span style="text-decoration: underline;">Westminster Road end of Dalkeith Road</span> – Meeting with Public Rights of Way Officer and local residents took place on 26/07/10 – the officer needs more information.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">Buccleuch Road to Lakeside Road</span> – No new developments.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">Bessborough Road </span>– ditto</p>
<p style="text-align: left;"><span style="text-decoration: underline;">Footpath 82 Spur</span> &#8211; ditto</p>
<p style="text-align: left;"><strong>Possible Charitable Status for Assn:</strong></p>
<p style="text-align: left;">JS has still to set up a small Sub-Committee to look at this.</p>
<p style="text-align: left;"><strong>Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden):</strong></p>
<p style="text-align: left;">MH reported that £30,000 has been allocated for the play area but MH is putting in a bid for more money from the s106 funds.    It is hoped to install one or two adult keep fit equipment, if funds allow. It is anticipated that the childrens&#8217; play equipment if unlikely to be installed until next spring and should be available for use by next summer<br />
WH said he is currently waiting to hear from Cllr Mrs Deas about another proposed meeting with Simon Legg in connection with the sunken garden in Pinecliff Gardens.<br />
Policy for financially supporting objectors to Planning Applications: JS said that to start off the discussion on this item, SA had made a number of suggestions as follows..</p>
<p style="text-align: left;">1. Case by case decision by Sub-committee reported to membership at meeting a.s.a.p.</p>
<p style="text-align: left;">2. Normally maximum £1000 but not exceeding 50% of costs, anything larger to be discussed at a meeting and approved.</p>
<p style="text-align: left;">3. Must be member but immediate joining would have to be allowed.</p>
<p style="text-align: left;">4. If above complied with and outside our area, must get consent of local Residents&#8217; Assn, if any.</p>
<p style="text-align: left;">5. Reconsider this policy when we have spent £10,000 or after 2 years</p>
<p style="text-align: left;">6. Above applies to applications. Only applicable to appeals if we take passive role but individuals not precluded from action on their own account.</p>
<p style="text-align: left;">The Assn must be kept in picture so that it doesn&#8217;t support any events that happen and the Assn has &#8216;egg on its face&#8217;.<br />
NS said that the Assn should only contribute in exceptional cases.    The decision of who to support should be subject to a strict vetting procedure by a small sub committee made up of the chairman, the planning officer, and A N Other. Their recommendation would then be put to the meeting.<br />
William Mutlow felt the Assn should set strict guidelines.<br />
Martin Heath pointed out that there was only a limited time scale for objecting to planning applications but JS pointed out that if the application is red-carded representations can be lodged right up the date of the Planning Committee Meeting.<br />
Roy Pointer felt that we should only support applications in our own area.<br />
It was agreed that JS, KA &amp; Roy Pointer would get together to agree a resolution to be put at the next meeting.</p>
<p><strong>Public Liability Insurance (PLI) –</strong> JS is pursuing.</p>
<p style="text-align: left;"><strong>Poole Council&#8217;s Business Transformation/Efficiency Review Programme: </strong></p>
<p style="text-align: left;">An updated report on this programme is due to be presented to the Council Efficiency and Effectiveness Overview and Scrutiny   Committee meeting in February 2011.</p>
<p style="text-align: left;"><strong>Funding for Westbourne Medical Centre and the NHS Dental Practice in Westbourne:</strong> JS reported  that he had received a letter dated 25/08/10 from Anne Swan, Interim Chief Executive of NHS Bournemouth and Poole.<br />
“Thank you for your recent letter in support of the Westbourne Medical Centre requesting a premises extension. The Primary Care Trust has undertaken a comprehensive review of the health needs of the local population, reviewed existing services provided by the practice and the practice&#8217;s plans to develop services in the future.<br />
I am extremely pleased to advise that we have agreed to fund an extension to the Westbourne Medical Centre and we are now in the process of agreeing the detail of this plan with the practice.<br />
I hope this will reassure you of our commitment to develop services outside of hospital and we look forward to working with the practice as they take their plans forward.”<br />
As members will be aware, Jim Wilson would also like the Assn to send a letter of support for the Westbourne Dental Practice. JS has suggested to JW that it might be politic if the Manager of the Westbourne Dental Practice could send JS a note confirming that he/she is being paid at a lower rate per treatment than similar dentists in the area and that he/she is happy for us (BPCCRA) to take up this matter with the PCT.</p>
<p style="text-align: left;"><strong>BPCCRA Autumn 2010 Magazine</strong>: The deadline date for material is last week in September. Hazel Clifton said that she would be submitting an article about the Canford Cliffs Village Hall.</p>
<p style="text-align: left;">
<p style="text-align: left;"><strong>3. NEW HOUSING DEVELOPMENT </strong>In the absence of Keith Alcroft, JS reported that</p>
<p style="text-align: left;"><span style="text-decoration: underline;">The Cottage, Kingsgate, 7 The Avenue</span> (Erect a detached house on land adjacent to The Cottage and erect detached garage to The Cottage) &#8211; Application is due to be determined at tomorrow&#8217;s Planning Committee.meeting. The officer&#8217;s recommendation is to &#8216;Grant with conditions&#8217;.<br />
JS reported that he had been informed by Ian Lace this morning that Kingsgate residents had signed a Covenant between themselves and Seven Developments in relation to the above application. JS understands that this is on the basis that Seven Developments&#8217; appeal (APP/Q1255/A/10/2126736) against the Planning Committee&#8217;s refusal on 25/03/10 of the application for a block of 5 apartments and associated garages is withdrawn.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">4 Lawrence Drive </span>(Demolish existing buildings and erect 1 block of 8 apartments with assoc parking) – Application refused on 05/03/10 is now the subject of an appeal Hearing (APP/Q1255/A/10/2128771) at 10.00am on 28/09/10 In the Council Chamber. JS encouraged members to attend to show the strength of    All feeling against this application.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">Land adj 1 Over Links Drive (</span>Sever land and erect a new detached house (Revised Scheme) – Application refused by Planning Committee on 10/12/09 is subject of a &#8216;Written Representations&#8217; appeal (APP/Q1255/A/10/2120940). The &#8216;Start date&#8217; for this appeal was 27/01/10 but the site visit has yet to be arranged..<br />
24 Ravine Road (Demolish existing dwelling and erect replacement dwelling with integral garaging. (Revised scheme) Amended plans received 08/12/09 and 25/01/10) – Application refused under delegated authority on 29/01/10 is now the subject of appeal (APP/Q1255/A/10/2122302) to be determined by Written Representations. Site visit took place on 17/08/10.<br />
(b) Demolish existing dwelling and erect 2 No semi-detached dwellings with attached garages (Revised Scheme)- Application refused by Planning Committee on 08/07/10. Canford Cliffs, Promenade 2 (a) Construction of 18 new beach huts &#8211; Application No: 08/24380/005/F &amp; (b) Conservation Area application to demolish 8 beach huts (nos 99-106) adjacent to Canford Cliffs Chine. Application No: 08/24380/007/U The applications were registered as long ago as 22/01/08 &amp;13/02/08 respectively. MH will keep the Assn advised of any further developments.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">4-6 Compton Avenue</span> (Non material amendment of planning permission 06/12687/005/F to extend basement parking, an additional staircase, two roof lights, convert half gable window to full height) – Application granted on.26/07/10 8 Shore Road &#8211; BPCCRA will continue to monitor possible tree work application.    An entrance has been created on the Haven Road side of this property. This property is up for sale at is &#8216;offers&#8217; in excess of £2m.</p>
<p style="text-align: left;"><strong>Other current planning issues</strong></p>
<p style="text-align: left;"><span style="text-decoration: underline;">1 Westminster Road East</span><br />

Both applications refused under delegated authority on 04/04/10 &amp; 29/06/10 are subject of a &#8216;Written Representations&#8217; appeals (APP/Q1255/E/10/2132669 &amp; APP/Q1255/E/10/2132672). The &#8216;Start date&#8217; for these appeals was 22/07/10 but the site visit has yet to be arranged.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">11 Westminster Road</span> (Demolition of the existing building and construction of three detached houses with associated parking and access. (revised scheme – Application refused on 17/05/10 is now the subject of a appeal Hearing (APP/Q1255/A/10/2129589) at 10.00 on 12/10/10</p>
<p style="text-align: left;"><span style="text-decoration: underline;">2 Crawshaw Road</span> (Demolish existing dwelling and erect x 2 detached dwellings with on site parking. (Revised Scheme) – Application registered 25/05/10. Amended plans lodged on 14/07/10.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">6 Durrant Road</span><br />
(a) Demolish existing dwelling and erect x2 detached dwellings. (Revised Scheme) As amended by plans received 01/10/09) – Application refused under delegated authority on 11/12/09, now the subject of Written Representations appeals (APP/Q1255/A/10/2121180). The site visit was fixed for yesterday (07/09/10).</p>
<p><span style="text-decoration: underline;">60A Kings Avenue</span> (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council&#8217;s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.</p>
<p><strong>6.    ACCOUNTS TO DATE </strong>–</p>
<p style="text-align: left;">JS reported that the total funds as at 31st August amounted to £36,298.47.<br />
JS said that he had met with Paul Fearnley this afternoon who is anxious to make the Assn&#8217;s financial procedures as efficient as possible. There are several ideas that PF has in mind&#8230;<br />
1. Encourage as many as possible of the Assn&#8217;s payments made and received to be processed electronically. This will reduce the considerable time spent in handling cheques.<br />
2. Close the Alliance and Leicester account (formerly Gyro) account but this will involve requesting many members to change their Standing Order details.<br />
3. At present members pay an annual sub when they want to. It has been suggested that the Assn would have much more control over the receipt of subs if they were all due to be paid at the same time of the year. 4. Allocate every member with a unique reference number.<br />
SA said that he was not opposed to the idea of a unique reference number but thought that it might be a good idea to introduce this gradually for new members only.<br />
It&#8217;s been decided that whatever changes are made in due course, no precipitate changes will be made until members have had time to consider this over the coming months.</p>
<p style="text-align: left;"><strong>7.    ANY OTHER BUSINESS</strong></p>
<p style="text-align: left;"><span style="text-decoration: underline;">Parkstone Children&#8217;s Centre &amp; Alexandra Park Lodg</span>e – JS reported that the Cabinet at last night&#8217;s meeting had re-affirmed its decision to go ahead with the building of this centre subject to the approval of the planning application which is to be determined at tomorrow&#8217;s Planning Committee meeting. Chairman&#8217;s Note: I&#8217;m told that the Planning Committee unanimously voted to refuse this application, apart from Cllr. Mrs Stribley who abstained</p>
<p style="text-align: left;"><span style="text-decoration: underline;">Canford Cliffs Village Hall </span>– Hazel Clifton asked if the Assn would consider making a donation to the Village Hall towards its ever increasing maintenance expenditure. This year the Trustees have had several unexpected repairs. Firstly, three separate floods due to old clay pipes being cracked and blocked by tree roots. The pipes have had to be replaced with plastic ones and the &#8216;runways&#8217; cleared at cost of £3000. Secondly, the two boilers that run the heating for the main Hall and the Bridge Club below have been &#8216;condemned&#8217; and the Trustees are having to replace both boilers and remove asbestos, make good, etc. at a cost of £6000+.<br />
Both these expenses were unexpected and the Trustees had already committed themselves to an extension to the store room to give extra space for storage of short mat bowls mats.<br />
The Trustees do not receive any funding from the Council. The Canford Cliffs Land Society have been generous in the past but it needs to go to an EGM before it can give the Trustees any extra funding. The Hall&#8217;s takings just about cover its running costs and therefore the Trustees&#8217; funds are getting quite low.<br />
SA suggested that if the Association makes a donation we should have the free use of the hall for the Assn&#8217; AGMs.    HC will pencil in Saturday 14th May 2011 for the meeting but JS wonders if this will clash with the Conservation Group Councillors Annual Meeting which is always held on the second Saturday in May.    MH to make enquiries.<br />
Roy Pointer asked, if provision was being made for the storage of short mat bowls mats, could the club make a contribution but HC said that no club had been approached yet.<br />
In answer to a question from SA, HC said that the Canford Cliffs Land Society had already made a recent contribution of £50,000.<br />
TS suggested a donation of £3,000 and this was unanimously agreed by a show of hands.</p>
<p style="text-align: left;"><span style="text-decoration: underline;">Parking in Shore Road </span>– MH said that she had received complaints from residents living in Shore Road and Brudenell Avenue about camper vans being used as &#8216;beach-huts&#8217; &amp; overnight sleeping and watersports vans parking 24/7 in Shore Road by taking advantage of Beach Parking Permits. Residents feel that this is not fair, particularly as the water sports vans are running a commercial enterprise . MH has organised a petition which she invited members to sign and plans to present at next week&#8217;s Full Council Meeting.</p>

<p><strong>C</strong><strong>ommunity Working Group (CWG) </strong>:</p>
<p>Report from last meeting: Roy Pointer reported on matters that had been discussed at the CWG meeting on 28/07/10, in which members may be interested. RP feels that the Assn. should encourage everybody to make representations on the West Quays development as Stephen Thorne says that, in the case of the West Quay Marina site he only had two letters about this. TS pointed out that the Assn. is quite remote from this site, and therefore it seems that people in this area may have no interest.</p>
<p>There will be a presentation from the Council to the CWG at its next meeting on the changes to Planning Regulations which have come forward from the Government, and RP suggested that whoever does the presentation should be invited to our Assn. meeting as this group may be interested. This is likely to come out sometime in the Autumn. Consultation on the Site Specific Allocations and Development Management Policies (which will replace the majority of current ‘saved’ policies in the Poole Local Plan First Alteration) and has now commenced and details are available on the BoP website</p>

<p>JS said that Bill Gordon who is managing the consultation has offered to meet representatives of the Assn shortly after the commencement of the consultation period. The consultation extends to</p>
<p>the 1st October. Members living within in the Avenue Conservation Area have some strong views about making sure that the policies which are in the current plan are saved. JS invited Martin Heath to this meeting.</p>
<p>There is a new initiative called the Community Engagement Forum which gives the opportunity for developers to consult with local communities before planning applications are lodged, and RPasked JS to suggest to Stephen Thorne that developers of the land at West Quay Road might beinvited to seek local opinions about this development by using the format as a ‘pilot’.</p>
<p>The next Newsletter from the CWG is due out shortly and RP said that it will include a piece on the role and constituency of the CWG. It was important to think about succession well before the Group is reviewed in the March next year. JS was hoping to circulate this with the Minutes.</p>
<p><strong>The South East Dorset Transport Strategy (Third Local Transport Plan 2011 – 2016) </strong>- Further consultation on the recommended transport strategy and the associated implementation programme will take place in September 2010. TS said that he is registered as a stakeholder?</p>
<p>Assn members were encouraged to engage since most of the options affect Branksome Park area.</p>
<p>TS pointed out that as well as the Site Specific consultation there is also a consultation on Poole’s Infrastructure Development Plan Documents and responses to this have to be in by October 9.</p>

<p><strong>Poole Beaches and Coastal Defences</strong>:</p>
<p>Shoreline Management Plan &#8211; RP reported that the Poole Bay, Poole Harbour and Wareham Flood and Coastal Erosion Risk Management Strategy portion looked at flood risk and erosion between Hengistbury Head and Durlston Head. There is now another document – The Strategic Environmental Assessment. This takes the Shoreline, Management Plan and looks at it from an environmental point of view. <p><strong> </strong></p>
<p><strong>Council Tax 2010/11 &amp; Council&#8217;s Budget Monitoring report: </strong>William Mutlow reported that there as no new Council Budget Monitoring report at the moment but he reported that generally the Council is endeavouring to find various cuts and these need to be sustainable in future years. The</p>
<p>budget will have to be rebalanced for this year to find these cuts. No detailed information has been published yet, but we expect to see a lot more over the coming months.</p>
<p>TS reported that he had had a meeting with the Leader of the Council, Cllr Dr Brian Leverett, who is hoping to set up a meeting for Residents’ Assn. representatives with himself, John McBride and Liz Wilkinson, the Head of Financial Services, towards the end of September, when</p>
<p>representatives will be able to comment on options the Council has for cutting £29M from the Medium Term Financial Plan over the next four years.</p>
<p>JS reported that this is a great improvement over the usual procedure, where Residents’ Assns are presented with the budget in February, when it was all &#8216;cut and dried&#8217;.</p>

<p><strong>Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden)</strong> <strong> </strong></p>
<p><strong> </strong></p>
<p><span style="text-decoration: underline;">Canford Cliffs Play Area</span><strong> </strong>Hazel Clifton reported that Canford Cliffs project should start in the Autumn.</p>
<p><span style="text-decoration: underline;">Pinecliff Gardens (Sunken garden</span>) CD reported that she, WH and Daphne Howell had met with Simon Legg from Leisure Services and he indicated that the Council is willing to let Canford Cliffs residents take over the management of the &#8216;Sunken garden&#8217;, as there is no funding for plants. We shall be the first area in the Borough to be granted a ‘Green Pennant’. This will incur a cost to the Assn of approx £200 (per annum) for an insurance premium to cover injuries to any of the residents working on the garden. The Council is willing to support this venture in taking away rubbish etc., and there will probably be a small annual charge i.e. a ‘peppercorn’ rent. CD said that she had had very positive feedback from residents and hopefully the garden will be brought back to how it used to be a few years ago, instead of the sorry state that it is in now.</p>
<p>WH stated that he had already e-mailed the documentation to JS and asked if there were any thoughts on funding of plants. CD said that she hoped that the funding the Assn. were going to provide to the Council for this project, were the Council to go ahead, would still be available. She also suggested that maybe local businesses would be willing to sponsor some of the costs. Carol thinks that this is a really good idea and will help promote some ‘community spirit’. Flat dwellers, for instance, with no gardens of their own to work on should welcome the opportunity to meet other people down at the garden. SA thought this is a marvellous idea but it will undoubtedly incur ongoing costs and there are insurance implications if we take over the lease. He suggested that there needs to be a Steering Committee from the Assn. as the project won’t run itself. JS asked WH would he be prepared to project manage this, and he agreed. There was a show of hands to see if this project should be carried forward. It was agreed that it would be.</p>
<p><strong>Use of Assn&#8217;s Capital Reserve – </strong>No new developments.</p>

<p><strong>Public Liability Insurance (PLI) </strong>– JS is pursuing.</p>

<p><strong>Poole Council&#8217;s Business Transformation/Efficiency Review Programme – </strong></p>
<p>MH confirmed that an updated report will be presented to the Council Efficiency and Effectiveness Overview and Scrutiny Committee meeting until February 2011.</p>
<p><strong>Funding for Westbourne Medical Centre and the NHS Dental Practice in Westbourne –</strong></p>
<p>Awaiting further communication next month from Anne Swan, Interim Chief Executive of NHS Bournemouth and Poole, as promised in Angela Schofield, Chairman, Bournemouth and Poole Teaching Primary Care Trust letter dated 12/07/10.</p>
<p><strong> </strong></p>
<p><strong>Overhanging Hedge at Kenilworth Court, 3 Western Road – </strong></p>
<p>MH reported that the Council had sent a confirmation letter to Kenilworth Court that this problem has to be dealt with before the end</p>
<p>of the year and the managing agent will comply with this.</p>
<p><strong>Parking in Ravine Road </strong></p>
<p>– MH reported that the Mazda car showroom on the corner of Haven and Ravine Roads are allowed to have delivery of cars from a transporter, but that showroom cars are not allowed to park there as they currently do. The Council have agreed to ask the Traffic Wardens to visit this area regularly to see what the showroom actually does. So she advises us to ‘watch this space’.</p>
<p><strong>3<span style="text-decoration: underline;">. NEW HOUSING DEVELOPMENT</span></strong></p>
<p>In the absence of Keith Alcroft, JS reported that no letters of objection had sent on behalf of the Association since the last meeting. Roland Cunnell expressed the view that he thought the Assn might be more pro-active in relation to planning applications. RC is particularly concerned about</p>

<p>– Application refused by Planning Committee on 10/12/09 is subject of a &#8216;Written Representations&#8217; appeal (APP/Q1255/A/10/2120940). The &#8216;Start date&#8217; for this appeal was 27/01/10 but the site visit has yet to be arranged.</p>
<p>RC is also concerned about the LPAs apparent lack of action at</p>
<p><span style="text-decoration: underline;">17 Over Links Drive</span><strong> </strong><em>(Demolish</em> <em>existing and erect 2 detached houses) </em></p>
<p>.</p>
<p><strong>Chairman&#8217;s note:</strong> There is a letter from Greener Homes Ltd dated 06/08/10 posted on the BoP Planning Application website.</p>

<p><span style="text-decoration: underline;">8 Buccleuch Road</span><strong> </strong>- CD reported that she had had a meeting, at his request, with a developer who wants to build a chalet bungalow on the land at this site, and asked for the support of the Ward Councillors.</p>
<p>SA said that he knows the site well and thinks that applications have been rejected in the past as the site is slightly less than the minimum size, although things have now changed. The site also contains many trees that have Preservation Orders on them and SA feels it would be impossible to</p>
<p>build on the site without felling trees. MH reported that this road was visited on the last Ward Walk. The land in question does not only have a TPO on it, but there is in fact a Woodland Preservation Order. She will alert the Planning Department to keep an eye on this plot as it is so easy to fell the trees and pay the fine.</p>
<p>NS said that he would be very worried about creating a precedent on this controversial site by supporting an application. JS was of the view that the Assn. should just &#8217;sit on the fence&#8217;. However, SA proposed that theAssn. should take the stance that this is a site not to be developed. JS asked for a show of hands that the Assn. would oppose any development plans for 8 Buccleuch Road. This was agreed.</p>

<p><strong>Parkstone Children&#8217;s Centre &amp; Alexandra Park Lodge</strong> – JS said that he thought it unreasonablethat this application was listed for determination at next Thursday&#8217;s Planning Committee meeting. The yellow site notice is dated 09/08/10 with comments to be lodged by 28/08/10. MH will investigate.</p>

<p>I am now informed that the planning application will be withdrawn from the Planning Committee on 19 August 2010 and is likely to be rescheduled for the meeting on 9 September 2010.</p>
<p><strong>Brian Cox</strong> – JS reported that Brian Cox&#8217; death notice appears in today&#8217;s Daily Echo. Brian was the former Chairman of the Canford Cliffs Land Society. His Funeral Service is to be held at All Saints&#8217; Church, Branksome Park, Poole on Monday 23rd August at 2pm.</p>
<p><strong>BPCCRA Autumn 2010 magazine</strong> – JS asked for material for the magazine by the end of this month.</p>
<p>Policy for financially supporting neighbour objections to Planning Applications NS reminded JS that this matter has yet to resolved. It was agreed that this would be discussed at the Assn&#8217;s next meeting.</p>
<p><strong>Information messages from Dorset Police, distributed by Neighbourhood Watch</strong> &#8211; JS said that he had recently received two messages which he thought would be of interest to members and would</p>
<p>include these in the Minutes.</p>
<p>1. Dorset Police have received a large numbers of calls from members of the public across the County advising them of suspicious telephone calls they have received. The callers have been asking occupants questions about their home security and what type of property they live in. A</p>
<p>large number of them have also been asked for their age and on some occasions they have been asked for bank details and offered alarm systems for sale. The callers appear to be targeting older residents. Please do not give out personal details to</p>
<p>callers over the phone. Do not accept offers of alarm fitting over the phone. If you wish to purchase an alarm, wherever possible seek personal recommendations. Some companies operate high pressure selling tactics so do not be bullied into allowing them to visit you at home.</p>
<p>If you would like security advice please contact your local Safer Neighbourhood team.</p>
<p>2. Dorset Police would like to advice you of a scam two Dorset residents have reported to Trading Standards. Letters or calls are received from persons claiming to be calling on behalf of SKY offering satellite system insurance. Residents are asked for banking details and direct debits amounts are then taken monthly from their accounts. The telephone number provided by the caller and the insurance policies do not exist. If you receive a call please check the callers’ identity by asking for verification of the company for whom they work before agreeing to anything over the phone.</p>
<p>Do not give out personal banking details over the phone; if they are legitimate they should already have your details on record.</p>
<p>Please pass this information on to friends and neighbours. Thank you</p>

An earth moving unit is on site and some ground work undertaken. JS has contacted the Planning Enforcement Officer as there are a number of conditions which should have been complied with before this development commenced.</p>
<p><span style="text-decoration: underline;"> </span></p>
<p><span style="text-decoration: underline;">19 Mornish Road</span> <em>(Tree replacement) – </em>This is still under discussion and actions are underway</p>
<p><span style="text-decoration: underline;">138 Canford Cliffs Road NS</span> reported that he had seen a report in the Bournemouth Echo of a successful proceedings brought by the Council against the developers, Poole Property Ltd, about their unauthorised felling of a protected tree at 138 Canford Cliffs Road. The Court fined Poole Property Company £11,000 (the maximum fine for the felling of a single tree is £20,000) Even though NS thinks this is a paltry sum in comparison to the value of the site, he thinks it is substantial enough to send the correct message that Poole Council intend to act in these circumstances.</p>
<p><span style="text-decoration: underline;"> </span></p>
<p><span style="text-decoration: underline;">55 Canford Cliffs Road</span> <em>(Removal of the gates, railings, fence and hedge, and the erection of a low stone wall with planting behind)</em> – A Breach of Condition Notice against Barrington Homes required work to be completed by 29/06/10.</p>
<p><span style="text-decoration: underline;"> </span></p>
<p><span style="text-decoration: underline;">Bella Rosa, 37 Haven Road</span> (<em>Erection of blue oblique glass screens positioned around the timber decking area located at the front of the property) </em>– The smoked glass screens have been removed..</p>

<p><span style="text-decoration: underline;">15A Westminster Road</span> (E<em>rection of railings over 1 metre high partly along the frontage of 15a Westminster Road, being adjacent to a highway. The boundary treatment then changes to a double close boarded fence over 1 metre high which continues along the frontage of Westminster Road,being adjacent to a highway and then turns South-West and continues down the boundary with Dalkeith Road being also adjacent to a highway)– </em>No new developments</p>
<p><span style="text-decoration: underline;"> </span></p>
<p><span style="text-decoration: underline;">2 Compton Avenue &amp; 93 Lilliput Road</span> <em>(Boundary treatment)</em> – A new hedgerow will be planted once the work at 4-6 Compton Avenue has been completed.</p>
<p><strong>Community Working Group (CWG), Progress re Sir Michael Pitt&#8217;s recommendations &amp; IDeA Report: </strong>JS<strong> </strong>reported that the date of the next CWG meeting had been changed to 28/07/10 and if any member had an issue to raise would he/she liaise with Roy Pointer.</p>
<p><strong>Poole Beaches and Coastal Defences:</strong> No new developments</p>
<p><strong>Council Tax 2010/11 &amp; Council&#8217;s Budget Monitoring report:</strong> In the absence of William Mutlow, JS reported that, as part of the £1bn saving announced by the Coalition Government last month, Poole had suffered in-year grant cuts of £2.9m pa. As a result, the Council have introduced a number of austerity measures to make sure it under-spends this year – it will need that leeway because it is unlikely that it will feel the full effect of the permanent cuts with only 6 or 7 months of the year remaining.</p>
<p>At the Southern Poole Chairmens&#8217; Liaison Group meeting on 28/06/10, John McBride, Poole&#8217;s Chief Executive, told those present that the Leader of the Council, Cllr Brian Leverett, is proposing a meeting with Residents&#8217; Associations in September 2010 to discuss next year&#8217;s Budget.</p>
<p>TS pointed out that ANY questions can be raised by Residents’ Associations, as long as the question is registered beforehand.</p>
<p>All expenditure over £500 is due be posted on the BoP website but, as JMcB said, this will have to be fine-tuned as individual Adult Social Care costs, for instance, are likely to be covered by the Data Protection Act. J McB also spoke of the idea of &#8216;Armchair auditors&#8217;- residents with access to the Internet monitoring the Council&#8217;s expenditure.. JMcB feels that this will act as a powerful deterrent to wasteful expenditure.</p>
<p>TS said that he is very impressed that JMcB has taken on board the current government’s ‘Big Society’ belief in moving as much power as possible down to local level, thus giving Residents’ Associations the opportunity to make constructive suggestions</p>
<p><strong>Poole Partnership:</strong><em> </em>JS reported that, last Tuesday he had attended a Poole Partnership Local Development Framework meeting in his capacity as Poole Partnership Steering Group representative for Residents&#8217; &amp; Tenants&#8217; Assns and Community Groups. At this meeting, Nicolas Perrins, Senior Planning Officer, Planning and Regeneration Services gave a presentation by entitled &#8216;New direction of travel of Government policy for Planning and implications for Poole&#8217;. JS said that he would include the text of the Powerpoint presentation in the Minutes&#8230;</p>
<p><strong>Direction of change</strong></p>
<p>Decentralisation and Localism Bill – handing power back to local government and communities (Big Society):</p>
<p>1.   Slim downed National Planning Guidance focus on sustainable development (No definition of Sustainable Development);</p>
<p>2.   Scrapping of Regional Spacial Strategies <em>(RSS)</em>;</p>
<p>3.   Planning and Housing decisions to rest locally;</p>
<p>4.   Compulsory consultation on development plans and planning applications;</p>
<p>5.   Recent revision to PPS3 <em>(Planning Policy Statement 3)</em> – re-classification of garden land as Green field – to stop &#8216;garden grabbing&#8217; (Core Strategy seeks to do this);</p>
<p>6.   New designation to protect green space above that of Public Open Space;</p>
<p>7.   Permissive approach to planning applications once National Framework in place;</p>
<p>8.   Third Party right of appeal;</p>
<p>9.   Abolition of Government Offices and introduction of Local Enterprise Partnership (Economic Development Role) &#8211; joint working across sub-regions;</p>
<p>10.   However, LDF <em>(Local Development Framework) </em>work is set to continue within new framework</p>
<p>“<em>&#8230;The revocation of RSS is not a signal for local Authorities to stop making plans for their area. Local Planning Authorities should continue to develop LDF Core Strategies and other DPDs reflecting peoples aspirations on important issues such as climate change, housing and economic development” (CLG, 6<sup>th</sup> July 2010)</em></p>

<p><strong>Issues </strong></p>
<ul>
<li>Major legislative reform to planning system to follow – will take time!</li>
<li>Local authorities to ensure housing, commercial and social needs are met but how will this be managed?</li>
<li>What will be put in place to ensure proper strategic planning to ensure cross-boundary co-ordination?</li>
<li>How will regionally significant infrastructure be co-ordinated?</li>
<li>What of s106/CIL <em>(Community Infrastructure Levy)</em> and development mitigation?</li>
<li>How will authority manage greater public involvement?</li>
</ul>
<p><strong>Chairman&#8217;s note: </strong>Wayne Hancock kindly attended the first meeting of the newly formed Poole Partnership Vision Group (which replaces the Poole Partnership Steering Group) in my place and his report is set out below.</p>
<p><span style="text-decoration: underline;">Report on the Poole Partnership Vision Group meeting 22 Jul 2010 Civic Centre, Poole</span></p>
<p>Although Richard Dimbleby had expressed his desire to stand down as chairman, he agreed to chair the meeting and it was hoped that a volunteer would come forward to take his place.</p>
<p>Adrian Dawson was elected Vice Chairman for the meeting and will consider whether to accept the role more permanently.</p>
<p>With the pressure on services due to cuts in government funding, the strategy document 2010 to 2026 will have to be changed and some items removed. Great emphasis was made of working together and sharing resources wherever possible. However, this should not to be at the expense of retaining a ‘Poole’ identity.</p>
<p>This partnership is to run from 2010 to 2026 and it is not yet known what will be the requirements in, say, five years time owing to the recent change in government. At the moment, new policies are appearing quite quickly, i.e. David Cameron’s ‘Big Society,’ where it is envisaged that local authorities and local groups will have their say and even be empowered to run local services which were previously run by the government. It is a turbulent time.</p>
<p>The big three issues are :</p>
<p>1. Deficit reduction</p>
<p>2. Decentralisation</p>
<p>3. Localism – localism – localism</p>
<p>A large number of ‘Target’ driven services are being decentralised and power is being handed down to local communities, i.e. PCTs. The government is removing the barriers and burdens currently standing in the way of local communities carrying out tasks. There is no ‘blueprint’- what works for one area may not work for the one next door. Issues that concern people will not just ‘go away’, but they will now have the means to do something about them. There are NO RULES &#8211; what you want you will try to get. It appears to be a ‘power to the people’ move. How will it really work? No-one knows at this stage.</p>
<p>Councils are expecting to supply a smaller number of services and it will be up to the local community to provide those no longer provided, i.e. libraries run by volunteers. Obviously this will have an impact on jobs &#8211; are people are saying ‘will I lose my job to a volunteer?’.</p>
<p>Social Enterprise is a new way of arranging to provide a service. For example, a church may set up and run a prison. However, Social Enterprise should not be at the cost of local people losing their jobs to organisations farming out the work to other areas. Concern was expressed at companies like BUPA and Virgin obtaining contracts at the expense of local businesses.</p>
<p>Government policy will drastically change the way things are done and poses the question who is responsible for what? Where will the power go?</p>
<p>Concern was expressed as to whether volunteers could be found to carry out the tasks required and, if so, would they have the knowledge and where-with-all to be able to carry them out satisfactorily? Also,</p>
<p>what happens if the services which are supposed to be provided are not, or are poorly managed?</p>
<p>It was the feeling of the meeting that the role of the vision group (PPVG) would be to set out the ideals; it would then be the responsibility of the management group (PPMG) to make things happen.</p>
<p>It was also felt that the role of the partnership program was to provide a forum for local communities. However, that requires all local community groups to be contacted and made aware of the partnership and how the partnership can assist them with their goals. A question was raised &#8211; how does the partnership report back to the local groups, communities and residents?</p>
<p>Finally, three papers were made available :-</p>
<p>1. HM Treasury – The Spending Review – June 2010</p>
<p>2. HM Government – The Coalition: our programme for government</p>
<p>3. Conservatives – Control Shift – Returning power to local people – Responsibility Agenda, Policy Green Paper No 9</p>
<p>Item 2.5 of the HM Treasury document lists 9 criteria for the allocation of resources.</p>
<p><strong><em>End of Report</em></strong></p>
<p><strong>Canford Cliffs Village &amp; proposal to plant trees in Haven Road</strong> <strong>: <em> </em></strong> MH reported that she had attended last Wednesday&#8217;s Canford Cliffs &amp; Penn Hill Area committee meeting where it was said that before any decisions, fund-raising etc. it is necessary to determine exactly where services and utilities are, as there is no definitive map of these. In order to do this, an exploratory trench would need to be dug at a cost of approximately £700.</p>
<p>Roy Pointer mentioned that it should be known by law exactly where the utilities are.</p>
<p>MH said that discussions she had had with the traders on Haven Road had come ‘full circle’ as they deem the loss of car parking space is not desirable, and they suggest that trees should be planted in tubs.</p>
<p>KA pointed out that the plan calls for only one parking place to be lost.</p>
<p>SA reported that he had detected opposition to this scheme, at the Area Committee meeting, from people other than the traders on Haven Road.</p>
<p>When asked what kind of trees were intended, KA answered that it wasn’t known yet, that he had been told by Mr. Osborne at the Council that this would be decided when the scheme was definite.</p>
<p>There was some discussion as to whether in the present climate was it correct to be spending money on something not essential. Mike Parkin, a regular user of Haven Road, suggested that in the making of car parking in Haven Road more difficult, there was a negative safety aspect to be considered.</p>
<p>JS suggested that we had a show of hands as to whether to proceed with this scheme or not.</p>

<p>Therefore JS asked MH to report back to officers that the Association would not be able to fund this scheme.</p>
<p><strong>Public Rights of Way:</strong></p>
<p><span style="text-decoration: underline;">Westminster Road end of Dalkeith Road</span> – Officers are meeting with local residents on 26/07/10</p>
<p><span style="text-decoration: underline;"> </span></p>
<p><span style="text-decoration: underline;">Buccleuch Road to Lakeside Road</span> – No new developments.</p>
<p><span style="text-decoration: underline;"> </span></p>
<p><span style="text-decoration: underline;">Bessborough Road</span> – The Canford Cliffs Land Society have arranged the vegetation beside the footpath from Bessborough Road to Haven Road (next to the Electricity sub-station) to be cut back. MH said that, although the Land Society was organising this, the work is actually being done through the Community Pay Back Scheme and therefore the labour costs are nil.</p>
<p><span style="text-decoration: underline;"> </span></p>
<p><span style="text-decoration: underline;">Footpath 82 Spur</span> – At special meeting of Canford Cliffs and Penn Hill Area Committee held on 19/07/10, Members granted the Definitive Modification Order to add this footpath to the Definitive Map.</p>
<p>Almost certainly, the Sandbanks Boatyard &amp; Marina Co Ltd will appeal</p>
<p><strong>Possible Charitable Status for Assn: J</strong>S has still to set up a small Sub-Committee to look at this.</p>
<p><strong>Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden) </strong>MH <strong>r</strong>eported that the Canford Cliffs Play Area is scheduled for 2001/2012. However, TS reported that Cllr Peter Adams had told him that this will not now be progressed. MH will double check to clarify this situation.</p>
<p>CD was not present to report on the current state of the sunken garden. However, JS said that Simon Legg was keen to set up a meeting.</p>
<p><strong>Use of Assn&#8217;s Capital Reserve – </strong>No new developments.</p>
<p><strong>Public Liability Insurance (PLI) </strong>– JS is pursuing.</p>
<p><strong>Poole Council&#8217;s Business Transformation Programme </strong>– The Council&#8217;s Business Transformation Programme and Efficiency Review Programme are to be merged. A fully updated report is to be presented at the Council Efficiency and Effectiveness Overview and Scrutiny Committee meeting on 23/09/10.</p>
<p><strong> </strong></p>
<p><strong>Funding for Westbourne Medical Centre and the NHS Dental Practice in Westbourne </strong>-</p>
<p>Jim Wilson believes that the withholding of funds from both the medical &amp; dental practices may have possible serious implications on the ability of those two individual practices being able to continuing carrying on over the medium to long term, even in their present state. This, of course, is going to be subject to whatever occurs when the present governments plans for change come to fruition and whether either of those practices have been able to retain the patients that exist.</p>
<p>JS proposed that a meeting with the non-executive members of the board should be put under way.</p>
<p><strong><em>Chairman&#8217;s Note</em></strong><strong>: </strong>Subsequent to the meeting, it has been agreed the the Association should take no further action at the present time and await the further communication next month from Anne Swan, Interim Chief Executive of NHS Bournemouth and Poole, as promised in Angela Schofield, Chairman, Bournemouth and Poole Teaching Primary Care Trust letter dated 12/07/10.</p>
<p><strong> </strong></p>
<p><strong>Overhanging Hedge at Kenilworth Court, 3 Western Road.</strong> MH reported that after considerable discussions with the residents of of the block he Mr. Hertz(?) the representative of the Managing Agent at Kenilworth Court, managed to secure agreement from the majority to have the hedge removed in the next few weeks with replanting to take place 6 months later. One of the residents however, contacted the council and asked if it would be possible instead to keep the hedge in-situ until the replanting takes place. This was deemed to be a reasonable request and this is where MH left it for now – that the replanting MUST be carried out before Christmas.</p>
<p>MH will put it on record that this is the case, so that if it is not done, the council themselves can take action.</p>
<p><strong><span style="text-decoration: underline;">3. NEW HOUSING DEVELOPMENT</span></strong><span style="text-decoration: underline;"> </span></p>

<p><strong>Former Cafe building, Compton Acres </strong><em>(Change of use of former cafe building A3 to playschool D1)</em> &#8211; Temporary permission granted for two years from 28/06/10.</p>
<p><strong>Chairman&#8217;s note: </strong>£41,258 capital funding from the &#8216;Early Years Quality &amp; Access Capital Grant (2008-2011) is to be allocated to the Wise Owl Pre-school at Compton Acres following termination of the rental agreement for their current premises but applications must show the applicant’s sustainability and commitment to delivering a service for at least <span style="text-decoration: underline;">three</span> years and this will be reflected in the funding agreement with the Local Authority.</p>
<p><strong>6A Dalkeith Road </strong><em>(Demolish existing property and build new contemporary dwelling) </em>– Application registered on 10/05/10 and letter of objection lodged on behalf of Assn on 25/05/10. Application withdrawn on 05/07/10.</p>
<p><span style="text-decoration: underline;">Other current planning issues</span></p>

<p><strong><span style="text-decoration: underline;">5.      REPORT RE CANFORD CLIFFS &amp; PENN HILL AREA COMMITTEE MEETING (14/07/10) </span></strong></p>

<p><strong>Chairman&#8217;s Note: </strong>Again, I omitted to cover this item in my efforts to conclude the business of the meeting quickly.</p>
<p>The subject of the new cycle lanes in Penn Hill Ave was discussed at length, particularly as there is no room for cycle lanes at Woodside/Kingsbridge Roads end of Penn Hill Ave. Cllr Parker proposed a review of the scheme after it&#8217;s been operation for a while.</p>
<p>The mini-roundabout at the junction of Kingsbridge/Highbridge Road was also the subject of some concern, as pantechnicons using this route, which the Council, in its infinite wisdom, has designated as a Prime Transport Corridor between Poole &amp; Bournemouth find it difficult to negotiate this roundabout.</p>
<p>One pantechnicon recently driving over the roundabout has caused the surface to break up.</p>
<p>One Penn Hill Ave resident, present at the meeting, suggested a one-way system using Balmoral Road, Sandecotes Road and Kingsbridge Road.</p>

<p>A<span style="text-decoration: underline;">lexandra Park Lodge</span> &#8211; The Council are planning to demolish this property and replace it with a single storey Childrens&#8217; Centre at a cost of £280,000. It is intended to submit an application with the intention of it being considered by Planning Committee on 19th August in order for the works to be completed in sufficient time for service delivery from March 2011.</p>
<p>The Children’s Centre will serve families living in the Parkstone, Penn Hill, and Canford Cliffs area.<strong> </strong></p>
<p>There is to be two consultation events, both to be held at Alexandra Bowls Club at 10.00am 29<sup>th</sup> July and 6pm on 11<sup>th</sup> August. Flyers and information for local residents and parents will be delivered by the end of this week. There is a feeling that it is not just residents who back onto the park who need to be consulted but other groups that use the park on a daily basis. It is also felt that two short notice meetings at the Bowls Club notified by a flyer to residents at the end of this week does not constitute a proper consultation. It is suggested that this on a par with the letter the Council sent regarding the Playbuilder scheme which, again, was only posted to residents who actually backed onto</p>
<p><span style="text-decoration: underline;">Bournemouth and Poole’s Building Schools for the Future (BSF) programme</span> -TS said that there was some confusion over the BSF programme i.e.is Ashdown College still to be funded? MH reported that this case still has to be put forward, and the outcome is still uncertain.</p>
<p><span style="text-decoration: underline;">Parkstone, Penn Hill &amp; Canford Cliffs Safer Neighbourhood Team meeting &amp; Canford Cliffs Christmas lights</span> &#8211; MH reported two dates for the future.</p>
<p>The Safer Neighbourhood Team will meet on Wednesday July 28<sup>th</sup> 7.00pm at the Conference Room, Civic Centre, Poole and looking ahead, the Canford Cliffs Christmas lights will be switched on on Haven Road on November 12<sup>th</sup>.</p>
<p><span style="text-decoration: underline;">Parking in Ravine Road</span> &#8211; Mike Parkin asked if MH had had her chat with the Mazda Car showroom on Haven Road re their use of the car parking spaces on Ravine Road. MH said that this still has to be done.</p>
<p><span style="text-decoration: underline;">24 Ravine Road</span> &#8211; Mike Parkin gave an up-to-date report on the planning application, currently, under Appeal for 24 Ravine Road. A site visit by the Inspectorate scheduled for July 28 has now been postponed. The house on this site has now been demolished.</p>
<p>Roland Cunnell said that he had &#8216;phoned the Planning Inspectorate to enquire about the site visit by the Inspector to land adjacent to 1 Over Links Drive and had been told that tis had not yet been arranged..</p>
<p>The meeting closed at 8.10pm and was concluded with a &#8216;glass&#8217; and &#8216;nibbles.</p>
