2. MATTERS ARISING Poole Pottery/Old Orchard/Quay Thistle Hotel sites update: JS reported…           

1.            Quayside (former Dolphin Quays) development – No new developments

2.            Poole Pottery factory buildings in Sopers Lane – A planning application for an 80 bed care home with associated facilities was registered on 09/09/10.

3.            Former Poole Pottery & Swan Inn site – No new developments

4.            Quay Thistle Hotel site – ditto

5.            Old Orchard House. 39-61 High Street – ditto

6. Land at West Quay Road (Mixed use regeneration and new public quayside to include;

the demolition of a listed gate post and all existing buildings on site; the redevelopment of the site with 440 residential units provided in six apartment blocks with basement parking and courtyard

Planning Enforcement, TPOs/Tree replacements update:

17 Over Links Drive (Application to demolish existing and erect 2 detached houses granted on 31/01/08 but number of conditions should have been complied with before this development commenced) – No new developments but ground work continuing.

19 Mornish Road (Tree replacement) – ditto

55 Canford Cliffs Road (Removal of the gates, railings, fence and hedge, and the erection of a low stone wall with planting behind) – ditto

15A Westminster Road (Erection of railings over 1 metre high partly along the frontage of 15a Westminster Road, being adjacent to a highway. The boundary treatment then changes to a double close boarded fence over 1 metre high which continues along the frontage of Westminster Road, being adjacent to a highway and then turns South-West and continues down the boundary with Dalkeith Road being also adjacent to a highway) ditto

Community Working Group (CWG): Roy Pointer reported on CWG meeting held on 22/09/10 and said that the Minutes of the meeting would be circulated with the Minutes of tonight”s meeting.

RP reported that the Members” Annual Tour of Inspection, which was due to take place last month, will now take place on 09/11/10. The tour is part of the member training programme, as well as an opportunity to review the quality of recent development and the success, or otherwise of place shaping. Five CWG members have been invited to join the Tour and RP has put his name down for this.

JS pointed out that the Tour of inspection is concerned with large sites and he did not feel that Members would have time to visit small sites in our area.

However, Cllr Mrs Haines said that she had recently had reason to visit 29 Forest Road (13 houses with associated parking) and felt the development did actually look attractive. This was a sub-division of a large plot and Cllr Mrs Haines suggested that this particular site could be put forward as a site to be visited by the Tour of Inspection to see if a development such as this works.

Poole Beaches and Coastal Defences: RP said the the issue of flood defences is due to be  discussed at the next CWG meeting.

Council Tax 2010/11 & Council”s Budget Monitoring report: TS reported on the Financial workshop held on 24/09/10 as part of the consultation on the Council”s 2011/12 Budget.

Six members of the Association attended along with 14 others to review the proposed cuts of £29m over the next four years from the Council’s annual budget of £100m. Each participant was given a list of the costs for each department. These amounts varied considerably, from ‘Adult Social Services’ which is 39% of the total budget to ‘Parks’ which is only 1%. Those attending were asked to try to cut the budget in each section by various percentages. TS said that those attending found this well-nigh impossible as they did not have sufficient information as to the breakdown of the budgets.

Everyone from the Association who attended decided that even though they had some good discussions the whole thing was just a PR exercise to demonstrate how painful these cuts were going to be.

TS has since received an e-mail from Cllr Peter Adams asking for his suggestion as to what the next meeting might consist of.  TS will reply that those attending need more detail so that they know in practice what each cut will mean.

There then followed many comments and much discussion on the Council budget; mainly between the members of this Association who had attended the Workshop.

As TS had to leave the meeting early to attend, he used this opportunity to give feedback on his attendance earlier today at the first in a series of Twin Sails Bridge/Regeneration Open Days

He reported that the exhibition really brought home to him just how massive the changes are going to be to the centre of Poole.  He is worried that there does not seem to be a clear design or masterplan and each developer will develop how he wants to, or how much he can get away with to maximise their profits.  There is so much concern about this that a new Committee has been formed ‘The Vision for Poole Committee consisting of The Society for Poole Men, the Old Town Conservation Group and Dorset Campaign for the Protection of Rural England. The aim of this committee is to ask for tighter guidance and control of these ten sites. TS said that, in his opinion, Members need to stand up and be counted and really take a grip as the situation which, in his view, seems to be out of control.

Chairman”s Note: TS report on the information gained at today”s Twin Sails Bridge/Regeneration Open Day at Hamworthy Library is set out at the foot of these Minutes.

Poole Partnership: JS reported that the joint meeting of Poole and Bournemouth Vision Groups which was due to take place on Monday 5th October has been postponed until after the Comprehensive Spending Review.

The Poole Partnership Local Development Framework Working Group meeting which was fixed for yesterday was also cancelled.

Public Rights of Way:

Westminster Road end of Dalkeith Road – No new developments.

Buccleuch Road to Lakeside Road – ditto

Bessborough Road – ditto

Footpath 82 Spur – Sandbanks Boatyard & Marina Co. Ltd has until 21/10/10 to appeal against the Definitive Modification Order to add Footpath 82 Spur.

Chairman”s Note: The deadline for objections appears to have been extended to 25/11/10.

Possible Charitable Status for Assn: JS has still to set up a small Sub-Committee to look at this.

Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden):

Cllr Mrs Deas said that she had spoken with Simon Legg, BoP Greenspace Maintenance Team Leader, yesterday and the process is well underway. He hopes that the takeover of the garden will be pretty soon and he is drawing up details to the BPCCRA for their agreement and approval of the necessary documents needed to be signed by the Association, i.e. insurance, peppercorn rent etc.

Cllr Mrs Deas also reported on her support for Affordable Housing. She has been pushing for the Council to adopt the procedure of Kingston-upon-Thames. For instance, on contentious issues, the council do not go ahead and give approval without seeking the views of the residents.

She has so far had little success in this and asks that the Resident’s Associations should press as hard as they can to get this implemented.

Cllr Mrs Deas went on to say that she had attended a Planning Summer School some years ago where it was demonstrated that it is possible to regenerate the centre of a town sympathetically by incorporating modern architecture alongside old architect extremely successfully which she feels should be done in Poole centre.

JS pointed out that when Gallahers are ready to come forward with fresh plans for the former Power Station site, he feels sure that these will be the subject of a Local Engagement Forum.

Chairman”s note: The purpose of the Local Engagement Forum is “to enable those members of the community who might have meaningful comments to make on a major development, to have the opportunity to listen to detailed discussions and participate in the shaping of the scheme before it is submitted to the Council for a decision, as part of the Planning process.”

Policy for financially supporting objectors to Planning Applications:

JS read the proposals put together by Roy Pointer and SA, which were distributed to members at the meeting. These were:

1. Delegated authority is given for a Sub-group, following the request of any member, to engage specialists to draft formal representations in respect of Planning Applications which the Sub- group considers would:

(a) if approved, involve a substantial departure from the intent of national or local planning policy or regulations, and/or

(b) set an undesirable precedent for future development in the area covered by the Association.

2. The Sub-group has no authority to act in regard to Applications that relate to development outside the Association’s area nor on any request from any Member that objection be made to any Application which objection is, in the Sub-group’s opinion, largely made on a subjective basis, e.g. a mere dislike of the proposal. Any representations shall be based on planning considerations alone.

3. The Sub-group shall have no authority to arrange representations in respect of any planning appeal. The Sub-group shall comprise:

The Chairman of the Association

The Planning Officer of the Association

One other Member

Delegation to commit funds

4. The Sub-group may commit up to £1,000 or 50% (whichever is the lower) of the total cost of specialist services in respect of a single representation providing the sum committed is a full and final cost of the service up to the point of submitting the representation and not an initial instalment against further or unspecified costs of representation in respect of the Application.

5. The Sub-group shall report to the next regular meeting of the Association, any action taken under this delegation and, if necessary, seek guidance from the Association on any further action.

Review

6. The application of this delegation arrangement shall be reviewed by a Committee of the Association after the commitment of a total of £5,000 of funding, or two years operation of this Delegation, whichever shall first occur.

The Chairman then asked the meeting for comments.

Chris Stracey said that a residence had been built in his road that resembles ‘a white shoe box’, completely unlike anything else in the road, even though many objections were raised at the time.

The Chairman cited two fairly recent cases. That at 11 Leicester Road (Outline application to demolish existing dwelling & erect a 59 bedroom care home (class C2) with associated parking (15 spaces) for which the professional representation was funded by the neighbour, and Kingsgate, 7 The Avenue for which the Association contributed £1,000 towards the £11,000 it had cost for professional representation.

The above proposals are meant to help objections where an awful precedent would be set were the developing plans allowed, and not for smaller instances, for which KA provides the wording for an objection letter to the Council from the Association.

TS pointed out that the principle of this is that the Association contributes towards professional advice to fight a local contentious issue whereby a number of residents would be affected, or where it would set an undesirable precedent.

Cllr. Mrs Deas said that Kingsgate, 7 The Avenue, was a good example. Mr. & Mrs. Lace have just received notification from Barrister’s opinion that they can actually stop anyone accessing the  driveway. The Council were arguing against this and backing Seven Developments but through Barrister’s Opinion the residents have discovered that they do in fact own four-fifths of the driveway and they are entitled to withhold right of way. This will send out a clear message to Seven Development that residents will fight to the end, even if Council have already given their planning permission.

KA pointed out that it is very difficult to legislate to cover all situations. SA proposed that we accept the proposals as they stand now.

The Chairman asked for a show of hands that these proposals be adopted with a note to cover KAs point.

Public Liability Insurance (PLI) – JS is pursuing.

Poole Council”s Business Transformation/Efficiency Review Programme: An updated report on this programme is due to be presented to the Council Efficiency and Effectiveness Overview and Scrutiny Committee meeting in February 2011.

Funding for the NHS Dental Practice in Westbourne: JS reported that Mr Hamid Kolahy of the Westbourne Dental Practice had recently written to Jim Wilson to say that his practice n Alum Chine Road is only paid at £19.50 per UDA compared with three other local dental practices are paid at a higher rate Alderney Dental Practice, 451 Ringwood Road £26.00 per UDA (3.1 miles) Pasadena Dental, 210 Ashley Road, Parkstone £24.50 per UDA (1.6 miles) Parsa Dental, 11 The Triangle, Bournemouth £24.00 per UDA (1.1 miles)

JS ascertained that none of those present at the meeting actually use the Westbourne Dental Practice and it was decided that the Association took no action to follow this u, especially as it is outside our own area.

Chairman”s note: In a note from Sarah, the Director of Patient Safety and Quality, NHS Bournemouth and Poole to Jim Wilson dated 19/07/10, she says that it is “not in a position to reimburse all dentists to the highest level of payment and due to the contractual position of dentists; it would not be possible to remove resources from another dentist. However, when Units of Dental Activity become available, for example if a dental practice closes, the PCT will put the activity out to tender with a view to securing a dental service in line with our Oral Health Needs Assessment. In this way, dentists can secure additional activity and we will at the same time review the value of the UDAs.”

BPCCRA Autumn 2010 Magazine: JS signed off final version on 11/10/10.

SA reported that the lists of wardens had now been printed and those who distribute the magazines should be getting their printed lists from Michael Bond within the next couple of weeks. SA appealed to Wardens to let him know where the data is wrong, so that the Assn can

maintain the best possible database.

Parking in Shore Road: Cllr Mrs Haines reported that she was due to present a petition from residents living in Shore Road and Brudenell Avenue, about camper vans being used as “beach- huts” & overnight sleeping and water sports vans parking 24/7 in Shore Road by taking advantage of Beach Parking Permits, to the Transportation Advisory Group meeting on 07/10/10 but this was cancelled and the next meeting will take place on 25/11/10

As Cllr Mrs Haines will not be here for this meeting the petition will be presented by Cllr. Sorton. Another Ward Councillor will also be at this meeting as other areas in the Borough also have similar problems with camper vans.

3. NEW HOUSING DEVELOPMENT JS reported that the Assn had not registered any objections to planning applications during the past month.

The Cottage, Kingsgate, 7 The Avenue (Erect a detached house on land adjacent to The Cottage and erect detached garage to The Cottage) – Application was granted with conditions at Planning Committee meeting on 09/09/10.

4 Lawrence Drive (Demolish existing buildings and erect 1 block of 8 apartments with assoc parking) – Application refused on 05/03/10. Awaiting outcome of appeal Hearing (APP/Q1255/A/10/2128771) held on 28/09/10.

11 Westminster Road East

(a) Demolish existing and erect a 3 storey single dwelling and garage with associated vehicular access

(b) Demolition of existing dwelling and garage. Erection of a 3-storey (part) single family dwelling, a garage and associated vehicular access and landscaping

Both applications refused under delegated authority on 04/04/10 & 29/06/10 are subject of a “Written Representations” appeals (APP/Q1255/E/10/2132669 & APP/Q1255/E/10/2132672). The “Start date” for these appeals was 22/07/10. Site visit took place on 13/10/10.

Land adj 1 Over Links Drive (Sever land and erect a new detached house (Revised Scheme) – Application refused by Planning Committee on 10/12/09 is subject of a “Written Representations” appeal (APP/Q1255/A/10/2120940). The “Start date” for this appeal was 27/01/10. Site visit took place on 13/10/10.

11 Westminster Road (Demolition of the existing building and construction of three detached houses with associated parking and access. (revised scheme – Application refused on 17/05/10. Awaiting outcome of appeal Hearing (APP/Q1255/A/10/2129589) held on 12/10/10

24 Ravine Road (Demolish existing dwelling and erect replacement dwelling with integral garaging. (Revised scheme) Amended plans received 08/12/09 and 25/01/10) – Written Representations appeal (APP/Q1255/A/10/2122302) was dismissed on 16/09/10.

2 Crawshaw Road (Demolish existing dwelling and erect x 2 detached dwellings with on-site parking. (Revised Scheme) – Application registered 25/05/10. Amended plans lodged on 14/07/10.

6 Durrant Road

(a) Demolish existing dwelling and erect x2 detached dwellings. (Revised Scheme) As amended by plans received 01/10/09) – Application refused under delegated authority on 11/12/09, now the subject of Written Representations appeals (APP/Q1255/A/10/2121180). Site visit took place on 07/09/10.

(b) Demolish existing dwelling and erect 2 No semi-detached dwellings with attached garages (Revised Scheme)– Application refused by Planning Committee on 08/07/10.

Canford Cliffs, Promenade 2 (a) Construction of 18 new beach huts – Application No: 08/24380/005/F & (b) Conservation Area application to demolish 8 beach huts (nos 99-106) adjacent to Canford Cliffs Chine. Application No: 08/24380/007/U The applications were registered as long ago as 22/01/08 &13/02/08 respectively. MH will keep the Assn advised of any further developments.

4-6 Compton Avenue (Non material amendment of planning permission 06/12687/005/F to extend basement parking, an additional staircase, two roof lights, convert half gable window to full height) Application granted on.26/07/10

8 Shore Road – BPCCRA will continue to monitor possible tree work application. An entrance has been created on the Haven Road side of this property. This property is up for sale at is “offers” in excess of £2m.

60A Kings Avenue (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council”s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.

4.   UPDATE RE CANFORD CLIFFS & FENN HILL AREA COMMITTEE MEETING (15/09/10) Chairman”s Note: I omitted to cover this item.

Lengthy discussions took place on recent changes in the Penn Hill Avenue and suggestions were made for improvements to the Kingsbridge Road/Highmoor Road junction.

Officers from Strategic Planning gave presentations on Preferred Options for Additional Sites – Consultation on Proposed and Revised Policy Areas

5.                  ACCOUNTS TO DATE – JS reported that the total funds as at 30th September amounted to £33,187.32, which takes account of the £3,000 donated to the Canford Cliffs Village Hall. It has also been agreed to make a payment of £1,000 to the flat-owners at Kingsgate, 7 The Avenue towards their costs of £11,000 fighting Seven Developments applications for the site at the rear.

6.                  ANY OTHER BUSINESS

Ward Walks – Cllr. Sorton reported on his Ward Walk with Cllr. Mrs Haines. Part of this was in Canford Cliffs Village and had suggested that we get rid of some of the clutter’ – in particular some of the litter bins. Cllr. Haines added that the question of trees in Haven Road had been brought up with the officers – trees contained in pots perhaps.

The next area visited was Mountbatten Road/Cassel Avenue area to check the distinctiveness, and will ask for this area to be given Conservation Area status.

Turning circle in Torbay Road – Rose Rogers asked if there were any regulation covering a rubbish skip left permanently obstructing this part of the road Cllr. Mrs Haines said that there was no restriction to having a skip in your own drive. JS suggested that she took up this question with a Penn Hill Ward Councillor, or that she contacts Transportation Services for their advice.

REPORT ON INFORMATION GAINED AT TWIN SAILS BRIDGE/REGENERATION

OPEN DAY ON 13/10/10 AT HAMWORTHY LIBRARY

A. Nigel Jacobs : Strategic Planning

1. I recommend you get hold of the plan and drawings of ‘Poole’s Masterplan. A town Fit for the 21st Century.’

2. Because of cuts & staff shortages they are limited on their work. Current Priorities :

(a) Dorset Heathlands, because of commitments to other Dorset Councils. Nigel leads this project.

(b) Site Specific Plan.

(c) Infrastructure Plan.

(d) Update SPG2 Design Masterplan.

3.They will be starting shortly on updating SPG2.

4.Warren Lever has been asked to look at setting up a Design Forum. Currently the thought is for one covering Bournemouth and Poole. Examples of good forums have some Community participation. Important that one of us is on the Forum.

5.There has been pressure to relax some elements of the SPG2 requirements because of the Recession. The Core Strategy Inspector recommended a more flexible approach to development in the regeneration area to enable development to occur recognising its impact on viability.

6. The Council (i.e. the Councillors if they have the leadership guts my comment) are faced with a choice:

(a) If they want speedier development to provide employment, etc. it will mean lower CIL (Section 106 contributions) for Affordable Housing, and other Infrastructure with less discipline on enforcing SPG2 and other Core Strategy requirements.

Or b) holding up approving the key sites until the economy picks up when the developer profits improve and they can secure contributions to meet the stated needs set out in policy.

7. Planning Department has the power to refuse an application if the architectural design is poor.

8. In the end it is up to Councillors to make this decision. I believe we can apply heavy democratic pressure on Councillors leading up to the Local Elections in May, to apply Option B.

9. CABE have just done a review of the current Masterplan and are relatively happy that there is nothing fundamentally wrong with the principles within. Unlikely they will be issuing a written report.

10. The West Quay Road site is a critical to the regeneration of Poole and ideally would come forward last, although the Council has no control over the timing of planning applications. The Council will need to take a view as explained in 6.

11. The Core Strategy statement on number of units per site is a minimum figure. Overall the Core Strategy has to deliver a minimum number of dwellings (PCS5). If developers choose to go for different levels of use then they need to justify against what the overall approach to a site/location is demonstrating that their scheme can meet stated objectives for the Town.

12. He believed that Gallahers would be unlikely to gain support for 1,600 units on Hamworthy site ␣ as compared with Core Strategy 1,100 plus. Anticipates that any future scheme would not be too far away from baseline in Core Strategy.

13. The outline approval for the West Quay Marina site, s106 not yet signed, includes a provision that if the economy picks up and the developer makes more profit than forecast, the Council can re-visit the calculations and secure some Affordable Housing, etc. contributions. This approach is now being worked into other s106 agreements where viability is an issue.

14. Sainsbury are in no hurry to submit an application for development of their car park.

15. There is no indication that the Goods Yard site will be redeveloped soon although Network Rail retains aspirations for a new station but only as part of a development package for the whole site.

16. The multi-storey car park next to the Dolphin Centre may be demolished to allow extension of the centre.

17. The future of the Barclays Tower is uncertain. At some stage Barclays will want modern office accommodation which presents issues over what happens to the current building. Refurbishment is an option but redevelopment probably more likely. Barclays are committed to staying in Poole and there is no timeframe on any changes to this site.

18. The new Lifting Bridge will always be raised first. If there is heavy boat traffic in the summer the Harbour Master will have the power to raise both bridges at the same time should there be safety issues. There will be a bridge control unit on the Gallagher site with views of both bridges.

19. The bus depot behind the multi-storey park will be relocated to an industrial estate to allow expansion of the Dolphin Centre. The Bus Station will not be moved, but it may be re-modelled to allow for the Centre’s expansion.

B. Chris Francombe : Transport Planning

1. A31 link from the Port to Merley, Gravel Hill is unlikely to be dualled in the near future. The A31 round Wimborne may be dualled from 2020, but will depend on Government cuts.

2. Dorset County Council has agreed that the junction at Merley between the A31 and the A 349 will be closed for 2 weeks and 1 day so the 200 VIPs can be guaranteed to travel from London to Weymouth in 2 hours 43 minutes.

There has been no decision yet about the period of the Paralympics. Poole Council were not fully consulted, but are demanding in return that the Canford Bottom roundabout be converted into a hamburger design with the A31 going straight though the middle. Later the roundabout may have a flyover across the middle. There is likely to be traffic chaos during this period.

3. The £40million link from the A338 to the Airport will not be built since there is not a large enough traffic forecast.

4. The industrial site at the Airport is being reduced from 40 hectares to 20. The public bus service will be inadequate. Much employment will be provided at the Ferndown Estate planned for 20 hectares.

5.            Still discussing whether Kingland Road will be closed between the bus station and the Lighthouse. Key is the road into the bus station. Kingland Road may be reduced to a single one- way road.

6.            The rail link to Swanage will be implemented; current cost £40million, but depends on Railtrack problems.

7.            The rubble from the Hamworthy site will be removed over the 2nd lifting bridge and then down Holes Bay Road.

With regards to the forecourt cars, they can be parked there but subject to the normal restrictions. The traffic wardens will be asked to patrol that area more frequently to ensure that these cars do not exceed the restriction, otherwise they will be ticketed.
In the case of (b), SA said that his concern was that the 3rd party insurance should cover all individuals working at the Sunken garden in Pinecliff Gardens. He feels that the Assn must have confirmation from the Council that this is the case.

Community Working Group (CWG): The next CWG meeting is fixed for 22/09/10. JS reminded members that an annual up-date on Sir Michael Pitt”s independent review & the IDeA Peer Review of planning matters in Poole is due to be presented to the Council Efficiency and Effectiveness Overview and Scrutiny Committee meeting on 23/09/10.

Roy Pointer referred to the Ward Walk Report and pointed out that there were no time scales/actions.    He will be following this up at the next CWG meeting
RP for consultation and comments are invited.

Poole Beaches and Coastal Defences: Roy Pointer pointed out that the Environmental Statement is out Council Tax 2010/11 & Council”s Budget Monitoring report: William Mutlow reported that the latest Corporate Financial Monitoring report for the period from 01/04/10 to 31/07/10 shows a surplus of £216K.
As a result of Government cutbacks and increased pressures such as Adult Social Services, reduction in Planning Services/Building Regulations Service fees etc, the revised General Fund pressure has risen from £8,434m for June 2010 to £9.986 for July 2010 but total reductions found to date have increased from £8,616m to £10,202.
The capital projects currently in hand will continue but the prospect for new capital projects will, of course, depend on the finance being available.
TS reported that the Council are organising a Financial Workshop for representatives of all Residents’ Associations to discuss next year”s Budget in the Committee Suite at the Civic Centre on 24 September 9.30 – 12.30/13.00.
Cllr Leverett will be writing to shortly to invite their attendance. The number of representatives per Residents” Assn has yet to be announced.

Poole Partnership: –

JS reported that the Stronger Communities Partnership meeting scheduled for 08/09/10 was cancelled.
There are likely to be some important developments over this month and October which could have an influence on the work of the Stronger Communities Partnership, including the governments spending review and developments with their Big Society agenda. As a result, it was felt that it would be more useful to meet later in the year, once a better understanding is known how these issues will affect this group.
The outcome of the Poole Partnership Management Board which met on 02/09/10 has yet to published in the public domain.
TS asked JS if he would like to say a word about the Local Enterprise Partnership (LEP).
The LEP was lodged with the Department for Business Innovation and Skills on Monday and was endorsed by the Cabinet at their meeting last night. Following the dissolution of the Regional Development Agencies, Poole, Dorset and Bournemouth Councils have got together to submit an Expression of Interest in forming a LEP.    This will have an independent chairman – Gordon Page (who heads up Hamworthy Engineering).
NS said that the LEP will supersede the Wessex Multi-Area Agreement which is a multi-faceted enterprise. HC asked if a copy of the Expression of Interest is available on the BOP website. JS said he will enquire. Roland Cunnell said that Mr Page used to be Leader of the Dorset Training Enterprise Council

Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden):

MH reported that £30,000 has been allocated for the play area but MH is putting in a bid for more money from the s106 funds.    It is hoped to install one or two adult keep fit equipment, if funds allow. It is anticipated that the childrens” play equipment if unlikely to be installed until next spring and should be available for use by next summer
WH said he is currently waiting to hear from Cllr Mrs Deas about another proposed meeting with Simon Legg in connection with the sunken garden in Pinecliff Gardens.
Policy for financially supporting objectors to Planning Applications: JS said that to start off the discussion on this item, SA had made a number of suggestions as follows..

1. Case by case decision by Sub-committee reported to membership at meeting a.s.a.p.

2. Normally maximum £1000 but not exceeding 50% of costs, anything larger to be discussed at a meeting and approved.

3. Must be member but immediate joining would have to be allowed.

4. If above complied with and outside our area, must get consent of local Residents” Assn, if any.

5. Reconsider this policy when we have spent £10,000 or after 2 years

6. Above applies to applications. Only applicable to appeals if we take passive role but individuals not precluded from action on their own account.

The Assn must be kept in picture so that it doesn”t support any events that happen and the Assn has “egg on its face”.
NS said that the Assn should only contribute in exceptional cases.    The decision of who to support should be subject to a strict vetting procedure by a small sub committee made up of the chairman, the planning officer, and A N Other. Their recommendation would then be put to the meeting.
William Mutlow felt the Assn should set strict guidelines.
Martin Heath pointed out that there was only a limited time scale for objecting to planning applications but JS pointed out that if the application is red-carded representations can be lodged right up the date of the Planning Committee Meeting.
Roy Pointer felt that we should only support applications in our own area.
It was agreed that JS, KA & Roy Pointer would get together to agree a resolution to be put at the next meeting.

Public Liability Insurance (PLI) – JS is pursuing.

Poole Council”s Business Transformation/Efficiency Review Programme:

An updated report on this programme is due to be presented to the Council Efficiency and Effectiveness Overview and Scrutiny   Committee meeting in February 2011.

Funding for Westbourne Medical Centre and the NHS Dental Practice in Westbourne: JS reported  that he had received a letter dated 25/08/10 from Anne Swan, Interim Chief Executive of NHS Bournemouth and Poole.
“Thank you for your recent letter in support of the Westbourne Medical Centre requesting a premises extension. The Primary Care Trust has undertaken a comprehensive review of the health needs of the local population, reviewed existing services provided by the practice and the practice”s plans to develop services in the future.
I am extremely pleased to advise that we have agreed to fund an extension to the Westbourne Medical Centre and we are now in the process of agreeing the detail of this plan with the practice.
I hope this will reassure you of our commitment to develop services outside of hospital and we look forward to working with the practice as they take their plans forward.”
As members will be aware, Jim Wilson would also like the Assn to send a letter of support for the Westbourne Dental Practice. JS has suggested to JW that it might be politic if the Manager of the Westbourne Dental Practice could send JS a note confirming that he/she is being paid at a lower rate per treatment than similar dentists in the area and that he/she is happy for us (BPCCRA) to take up this matter with the PCT.

BPCCRA Autumn 2010 Magazine: The deadline date for material is last week in September. Hazel Clifton said that she would be submitting an article about the Canford Cliffs Village Hall.

JS understands that this is on the basis that Seven Developments” appeal (APP/Q1255/A/10/2126736) against the Planning Committee”s refusal on 25/03/10 of the application for a block of 5 apartments and associated garages is withdrawn.

60A Kings Avenue (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council”s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.

6.    ACCOUNTS TO DATE

JS reported that the total funds as at 31st August amounted to £36,298.47.
JS said that he had met with Paul Fearnley this afternoon who is anxious to make the Assn”s financial procedures as efficient as possible. There are several ideas that PF has in mind…
1. Encourage as many as possible of the Assn”s payments made and received to be processed electronically. This will reduce the considerable time spent in handling cheques.
2. Close the Alliance and Leicester account (formerly Gyro) account but this will involve requesting many members to change their Standing Order details.
3. At present members pay an annual sub when they want to. It has been suggested that the Assn would have much more control over the receipt of subs if they were all due to be paid at the same time of the year. 4. Allocate every member with a unique reference number.
SA said that he was not opposed to the idea of a unique reference number but thought that it might be a good idea to introduce this gradually for new members only.
It”s been decided that whatever changes are made in due course, no precipitate changes will be made until members have had time to consider this over the coming months.

7.    ANY OTHER BUSINESS

Parkstone Children”s Centre & Alexandra Park Lodge – JS reported that the Cabinet at last night”s meeting had re-affirmed its decision to go ahead with the building of this centre subject to the approval of the planning application which is to be determined at tomorrow”s Planning Committee meeting. Chairman”s Note: I”m told that the Planning Committee unanimously voted to refuse this application, apart from Cllr. Mrs Stribley who abstained

Canford Cliffs Village Hall – Hazel Clifton asked if the Assn would consider making a donation to the Village Hall towards its ever increasing maintenance expenditure. This year the Trustees have had several unexpected repairs. Firstly, three separate floods due to old clay pipes being cracked and blocked by tree roots. The pipes have had to be replaced with plastic ones and the “runways” cleared at cost of £3000. Secondly, the two boilers that run the heating for the main Hall and the Bridge Club below have been “condemned” and the Trustees are having to replace both boilers and remove asbestos, make good, etc. at a cost of £6000 .
Both these expenses were unexpected and the Trustees had already committed themselves to an extension to the store room to give extra space for storage of short mat bowls mats.
The Trustees do not receive any funding from the Council. The Canford Cliffs Land Society have been generous in the past but it needs to go to an EGM before it can give the Trustees any extra funding. The Hall”s takings just about cover its running costs and therefore the Trustees” funds are getting quite low.
SA suggested that if the Association makes a donation we should have the free use of the hall for the Assn” AGMs.    HC will pencil in Saturday 14th May 2011 for the meeting but JS wonders if this will clash with the Conservation Group Councillors Annual Meeting which is always held on the second Saturday in May.    MH to make enquiries.
Roy Pointer asked, if provision was being made for the storage of short mat bowls mats, could the club make a contribution but HC said that no club had been approached yet.
In answer to a question from SA, HC said that the Canford Cliffs Land Society had already made a recent contribution of £50,000.
TS suggested a donation of £3,000 and this was unanimously agreed by a show of hands.

Parking in Shore Road – MH said that she had received complaints from residents living in Shore Road and Brudenell Avenue about camper vans being used as “beach-huts” & overnight sleeping and watersports vans parking 24/7 in Shore Road by taking advantage of Beach Parking Permits. Residents feel that this is not fair, particularly as the water sports vans are running a commercial enterprise . MH has organised a petition which she invited members to sign and plans to present at next week”s Full Council Meeting.

Community Working Group (CWG) :

Report from last meeting: Roy Pointer reported on matters that had been discussed at the CWG meeting on 28/07/10, in which members may be interested. RP feels that the Assn. should encourage everybody to make representations on the West Quays development as Stephen Thorne says that, in the case of the West Quay Marina site he only had two letters about this. TS pointed out that the Assn. is quite remote from this site, and therefore it seems that people in this area may have no interest.

There will be a presentation from the Council to the CWG at its next meeting on the changes to Planning Regulations which have come forward from the Government, and RP suggested that whoever does the presentation should be invited to our Assn. meeting as this group may be interested. This is likely to come out sometime in the Autumn. Consultation on the Site Specific Allocations and Development Management Policies (which will replace the majority of current ‘saved’ policies in the Poole Local Plan First Alteration) and has now commenced and details are available on the BoP website

JS said that Bill Gordon who is managing the consultation has offered to meet representatives of the Assn shortly after the commencement of the consultation period. The consultation extends to

the 1st October. Members living within in the Avenue Conservation Area have some strong views about making sure that the policies which are in the current plan are saved. JS invited Martin Heath to this meeting.

There is a new initiative called the Community Engagement Forum which gives the opportunity for developers to consult with local communities before planning applications are lodged, and RPasked JS to suggest to Stephen Thorne that developers of the land at West Quay Road might beinvited to seek local opinions about this development by using the format as a ‘pilot’.

The next Newsletter from the CWG is due out shortly and RP said that it will include a piece on the role and constituency of the CWG. It was important to think about succession well before the Group is reviewed in the March next year. JS was hoping to circulate this with the Minutes.

The South East Dorset Transport Strategy (Third Local Transport Plan 2011 – 2016) – Further consultation on the recommended transport strategy and the associated implementation programme will take place in September 2010. TS said that he is registered as a stakeholder?

Assn members were encouraged to engage since most of the options affect Branksome Park area.

TS pointed out that as well as the Site Specific consultation there is also a consultation on Poole’s Infrastructure Development Plan Documents and responses to this have to be in by October 9.

Poole Beaches and Coastal Defences:

Shoreline Management Plan – RP reported that the Poole Bay, Poole Harbour and Wareham Flood and Coastal Erosion Risk Management Strategy portion looked at flood risk and erosion between Hengistbury Head and Durlston Head. There is now another document – The Strategic Environmental Assessment. This takes the Shoreline, Management Plan and looks at it from an environmental point of view. Council Tax 2010/11 & Council’s Budget Monitoring report: William Mutlow reported that there as no new Council Budget Monitoring report at the moment but he reported that generally the Council is endeavouring to find various cuts and these need to be sustainable in future years. The

budget will have to be rebalanced for this year to find these cuts. No detailed information has been published yet, but we expect to see a lot more over the coming months.

TS reported that he had had a meeting with the Leader of the Council, Cllr Dr Brian Leverett, who is hoping to set up a meeting for Residents’ Assn. representatives with himself, John McBride and Liz Wilkinson, the Head of Financial Services, towards the end of September, when

representatives will be able to comment on options the Council has for cutting £29M from the Medium Term Financial Plan over the next four years.

JS reported that this is a great improvement over the usual procedure, where Residents’ Assns are presented with the budget in February, when it was all ‘cut and dried’.

Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden)

Canford Cliffs Play Area Hazel Clifton reported that Canford Cliffs project should start in the Autumn.

Pinecliff Gardens (Sunken garden) CD reported that she, WH and Daphne Howell had met with Simon Legg from Leisure Services and he indicated that the Council is willing to let Canford Cliffs residents take over the management of the ‘Sunken garden’, as there is no funding for plants. We shall be the first area in the Borough to be granted a ‘Green Pennant’. This will incur a cost to the Assn of approx £200 (per annum) for an insurance premium to cover injuries to any of the residents working on the garden. The Council is willing to support this venture in taking away rubbish etc., and there will probably be a small annual charge i.e. a ‘peppercorn’ rent. CD said that she had had very positive feedback from residents and hopefully the garden will be brought back to how it used to be a few years ago, instead of the sorry state that it is in now.

WH stated that he had already e-mailed the documentation to JS and asked if there were any thoughts on funding of plants. CD said that she hoped that the funding the Assn. were going to provide to the Council for this project, were the Council to go ahead, would still be available. She also suggested that maybe local businesses would be willing to sponsor some of the costs. Carol thinks that this is a really good idea and will help promote some ‘community spirit’. Flat dwellers, for instance, with no gardens of their own to work on should welcome the opportunity to meet other people down at the garden. SA thought this is a marvellous idea but it will undoubtedly incur ongoing costs and there are insurance implications if we take over the lease. He suggested that there needs to be a Steering Committee from the Assn. as the project won’t run itself. JS asked WH would he be prepared to project manage this, and he agreed. There was a show of hands to see if this project should be carried forward. It was agreed that it would be.

Poole Council’s Business Transformation/Efficiency Review Programme –

Funding for Westbourne Medical Centre and the NHS Dental Practice in Westbourne –

Awaiting further communication next month from Anne Swan, Interim Chief Executive of NHS Bournemouth and Poole, as promised in Angela Schofield, Chairman, Bournemouth and Poole Teaching Primary Care Trust letter dated 12/07/10.

Overhanging Hedge at Kenilworth Court, 3 Western Road –

MH reported that the Council had sent a confirmation letter to Kenilworth Court that this problem has to be dealt with before the end

of the year and the managing agent will comply with this.

Parking in Ravine Road

– MH reported that the Mazda car showroom on the corner of Haven and Ravine Roads are allowed to have delivery of cars from a transporter, but that showroom cars are not allowed to park there as they currently do. The Council have agreed to ask the Traffic Wardens to visit this area regularly to see what the showroom actually does. So she advises us to ‘watch this space’.

3. NEW HOUSING DEVELOPMENT

In the absence of Keith Alcroft, JS reported that no letters of objection had sent on behalf of the Association since the last meeting. Roland Cunnell expressed the view that he thought the Assn might be more pro-active in relation to planning applications. RC is particularly concerned about

8 Buccleuch Road – CD reported that she had had a meeting, at his request, with a developer who wants to build a chalet bungalow on the land at this site, and asked for the support of the Ward Councillors.

SA said that he knows the site well and thinks that applications have been rejected in the past as the site is slightly less than the minimum size, although things have now changed. The site also contains many trees that have Preservation Orders on them and SA feels it would be impossible to

build on the site without felling trees. MH reported that this road was visited on the last Ward Walk. The land in question does not only have a TPO on it, but there is in fact a Woodland Preservation Order. She will alert the Planning Department to keep an eye on this plot as it is so easy to fell the trees and pay the fine.

NS said that he would be very worried about creating a precedent on this controversial site by supporting an application. JS was of the view that the Assn. should just ‘sit on the fence’. However, SA proposed that theAssn. should take the stance that this is a site not to be developed. JS asked for a show of hands that the Assn. would oppose any development plans for 8 Buccleuch Road. This was agreed.

Confirmation awaited that the Council’s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.

Brian Cox – JS reported that Brian Cox’ death notice appears in today’s Daily Echo. Brian was the former Chairman of the Canford Cliffs Land Society. His Funeral Service is to be held at All Saints’ Church, Branksome Park, Poole on Monday 23rd August at 2pm.

BPCCRA Autumn 2010 magazine – JS asked for material for the magazine by the end of this month.

Policy for financially supporting neighbour objections to Planning Applications NS reminded JS that this matter has yet to resolved. It was agreed that this would be discussed at the Assn’s next meeting.

Information messages from Dorset Police, distributed by Neighbourhood Watch – JS said that he had recently received two messages which he thought would be of interest to members and would

include these in the Minutes.

1. Dorset Police have received a large numbers of calls from members of the public across the County advising them of suspicious telephone calls they have received. The callers have been asking occupants questions about their home security and what type of property they live in. A

large number of them have also been asked for their age and on some occasions they have been asked for bank details and offered alarm systems for sale. The callers appear to be targeting older residents. Please do not give out personal details to

callers over the phone. Do not accept offers of alarm fitting over the phone. If you wish to purchase an alarm, wherever possible seek personal recommendations. Some companies operate high pressure selling tactics so do not be bullied into allowing them to visit you at home.

If you would like security advice please contact your local Safer Neighbourhood team.

2. Dorset Police would like to advice you of a scam two Dorset residents have reported to Trading Standards. Letters or calls are received from persons claiming to be calling on behalf of SKY offering satellite system insurance. Residents are asked for banking details and direct debits amounts are then taken monthly from their accounts. The telephone number provided by the caller and the insurance policies do not exist. If you receive a call please check the callers’ identity by asking for verification of the company for whom they work before agreeing to anything over the phone.

Do not give out personal banking details over the phone; if they are legitimate they should already have your details on record.

An earth moving unit is on site and some ground work undertaken. JS has contacted the Planning Enforcement Officer as there are a number of conditions which should have been complied with before this development commenced.

19 Mornish Road (Tree replacement) – This is still under discussion and actions are underway

138 Canford Cliffs Road NS reported that he had seen a report in the Bournemouth Echo of a successful proceedings brought by the Council against the developers, Poole Property Ltd, about their unauthorised felling of a protected tree at 138 Canford Cliffs Road. The Court fined Poole Property Company £11,000 (the maximum fine for the felling of a single tree is £20,000) Even though NS thinks this is a paltry sum in comparison to the value of the site, he thinks it is substantial enough to send the correct message that Poole Council intend to act in these circumstances.

55 Canford Cliffs Road (Removal of the gates, railings, fence and hedge, and the erection of a low stone wall with planting behind) – A Breach of Condition Notice against Barrington Homes required work to be completed by 29/06/10.

Bella Rosa, 37 Haven Road (Erection of blue oblique glass screens positioned around the timber decking area located at the front of the property) – The smoked glass screens have been removed..

15A Westminster Road (Erection of railings over 1 metre high partly along the frontage of 15a Westminster Road, being adjacent to a highway. The boundary treatment then changes to a double close boarded fence over 1 metre high which continues along the frontage of Westminster Road,being adjacent to a highway and then turns South-West and continues down the boundary with Dalkeith Road being also adjacent to a highway)– No new developments

2 Compton Avenue & 93 Lilliput Road (Boundary treatment) – A new hedgerow will be planted once the work at 4-6 Compton Avenue has been completed.

Community Working Group (CWG), Progress re Sir Michael Pitt”s recommendations & IDeA Report: JS reported that the date of the next CWG meeting had been changed to 28/07/10 and if any member had an issue to raise would he/she liaise with Roy Pointer.

Poole Beaches and Coastal Defences: No new developments

Council Tax 2010/11 & Council”s Budget Monitoring report: In the absence of William Mutlow, JS reported that, as part of the £1bn saving announced by the Coalition Government last month, Poole had suffered in-year grant cuts of £2.9m pa. As a result, the Council have introduced a number of austerity measures to make sure it under-spends this year – it will need that leeway because it is unlikely that it will feel the full effect of the permanent cuts with only 6 or 7 months of the year remaining.

At the Southern Poole Chairmens” Liaison Group meeting on 28/06/10, John McBride, Poole”s Chief Executive, told those present that the Leader of the Council, Cllr Brian Leverett, is proposing a meeting with Residents” Associations in September 2010 to discuss next year”s Budget.

TS pointed out that ANY questions can be raised by Residents’ Associations, as long as the question is registered beforehand.

All expenditure over £500 is due be posted on the BoP website but, as JMcB said, this will have to be fine-tuned as individual Adult Social Care costs, for instance, are likely to be covered by the Data Protection Act. J McB also spoke of the idea of “Armchair auditors”- residents with access to the Internet monitoring the Council”s expenditure.. JMcB feels that this will act as a powerful deterrent to wasteful expenditure.

TS said that he is very impressed that JMcB has taken on board the current government’s ‘Big Society’ belief in moving as much power as possible down to local level, thus giving Residents’ Associations the opportunity to make constructive suggestions

Poole Partnership: JS reported that, last Tuesday he had attended a Poole Partnership Local Development Framework meeting in his capacity as Poole Partnership Steering Group representative for Residents” & Tenants” Assns and Community Groups. At this meeting, Nicolas Perrins, Senior Planning Officer, Planning and Regeneration Services gave a presentation by entitled “New direction of travel of Government policy for Planning and implications for Poole”. JS said that he would include the text of the Powerpoint presentation in the Minutes…

Direction of change

Decentralisation and Localism Bill – handing power back to local government and communities (Big Society):

1.   Slim downed National Planning Guidance focus on sustainable development (No definition of Sustainable Development);

2.   Scrapping of Regional Spacial Strategies (RSS);

3.   Planning and Housing decisions to rest locally;

4.   Compulsory consultation on development plans and planning applications;

5.   Recent revision to PPS3 (Planning Policy Statement 3) – re-classification of garden land as Green field – to stop “garden grabbing” (Core Strategy seeks to do this);

6.   New designation to protect green space above that of Public Open Space;

7.   Permissive approach to planning applications once National Framework in place;

8.   Third Party right of appeal;

9.   Abolition of Government Offices and introduction of Local Enterprise Partnership (Economic Development Role) – joint working across sub-regions;

10.   However, LDF (Local Development Framework) work is set to continue within new framework

…The revocation of RSS is not a signal for local Authorities to stop making plans for their area. Local Planning Authorities should continue to develop LDF Core Strategies and other DPDs reflecting peoples aspirations on important issues such as climate change, housing and economic development” (CLG, 6th July 2010)

Issues

  • Major legislative reform to planning system to follow – will take time!
  • Local authorities to ensure housing, commercial and social needs are met but how will this be managed?
  • What will be put in place to ensure proper strategic planning to ensure cross-boundary co-ordination?
  • How will regionally significant infrastructure be co-ordinated?
  • What of s106/CIL (Community Infrastructure Levy) and development mitigation?
  • How will authority manage greater public involvement?

Chairman”s note: Wayne Hancock kindly attended the first meeting of the newly formed Poole Partnership Vision Group (which replaces the Poole Partnership Steering Group) in my place and his report is set out below.

Report on the Poole Partnership Vision Group meeting 22 Jul 2010 Civic Centre, Poole

Although Richard Dimbleby had expressed his desire to stand down as chairman, he agreed to chair the meeting and it was hoped that a volunteer would come forward to take his place.

Adrian Dawson was elected Vice Chairman for the meeting and will consider whether to accept the role more permanently.

With the pressure on services due to cuts in government funding, the strategy document 2010 to 2026 will have to be changed and some items removed. Great emphasis was made of working together and sharing resources wherever possible. However, this should not to be at the expense of retaining a ‘Poole’ identity.

This partnership is to run from 2010 to 2026 and it is not yet known what will be the requirements in, say, five years time owing to the recent change in government. At the moment, new policies are appearing quite quickly, i.e. David Cameron’s ‘Big Society,’ where it is envisaged that local authorities and local groups will have their say and even be empowered to run local services which were previously run by the government. It is a turbulent time.

The big three issues are :

1. Deficit reduction

2. Decentralisation

3. Localism – localism – localism

A large number of ‘Target’ driven services are being decentralised and power is being handed down to local communities, i.e. PCTs. The government is removing the barriers and burdens currently standing in the way of local communities carrying out tasks. There is no ‘blueprint’- what works for one area may not work for the one next door. Issues that concern people will not just ‘go away’, but they will now have the means to do something about them. There are NO RULES – what you want you will try to get. It appears to be a ‘power to the people’ move. How will it really work? No-one knows at this stage.

Councils are expecting to supply a smaller number of services and it will be up to the local community to provide those no longer provided, i.e. libraries run by volunteers. Obviously this will have an impact on jobs – are people are saying ‘will I lose my job to a volunteer?’.

Social Enterprise is a new way of arranging to provide a service. For example, a church may set up and run a prison. However, Social Enterprise should not be at the cost of local people losing their jobs to organisations farming out the work to other areas. Concern was expressed at companies like BUPA and Virgin obtaining contracts at the expense of local businesses.

Government policy will drastically change the way things are done and poses the question who is responsible for what? Where will the power go?

Concern was expressed as to whether volunteers could be found to carry out the tasks required and, if so, would they have the knowledge and where-with-all to be able to carry them out satisfactorily? Also,

what happens if the services which are supposed to be provided are not, or are poorly managed?

It was the feeling of the meeting that the role of the vision group (PPVG) would be to set out the ideals; it would then be the responsibility of the management group (PPMG) to make things happen.

It was also felt that the role of the partnership program was to provide a forum for local communities. However, that requires all local community groups to be contacted and made aware of the partnership and how the partnership can assist them with their goals. A question was raised – how does the partnership report back to the local groups, communities and residents?

Finally, three papers were made available :-

1. HM Treasury – The Spending Review – June 2010

2. HM Government – The Coalition: our programme for government

3. Conservatives – Control Shift – Returning power to local people – Responsibility Agenda, Policy Green Paper No 9

Item 2.5 of the HM Treasury document lists 9 criteria for the allocation of resources.

Canford Cliffs Village & proposal to plant trees in Haven Road : MH reported that she had attended last Wednesday”s Canford Cliffs & Penn Hill Area committee meeting where it was said that before any decisions, fund-raising etc. it is necessary to determine exactly where services and utilities are, as there is no definitive map of these. In order to do this, an exploratory trench would need to be dug at a cost of approximately £700.

Roy Pointer mentioned that it should be known by law exactly where the utilities are.

MH said that discussions she had had with the traders on Haven Road had come ‘full circle’ as they deem the loss of car parking space is not desirable, and they suggest that trees should be planted in tubs.

KA pointed out that the plan calls for only one parking place to be lost.

SA reported that he had detected opposition to this scheme, at the Area Committee meeting, from people other than the traders on Haven Road.

When asked what kind of trees were intended, KA answered that it wasn’t known yet, that he had been told by Mr. Osborne at the Council that this would be decided when the scheme was definite.

There was some discussion as to whether in the present climate was it correct to be spending money on something not essential. Mike Parkin, a regular user of Haven Road, suggested that in the making of car parking in Haven Road more difficult, there was a negative safety aspect to be considered.

JS suggested that we had a show of hands as to whether to proceed with this scheme or not.

Westminster Road end of Dalkeith Road – Officers are meeting with local residents on 26/07/10

Buccleuch Road to Lakeside Road – No new developments.

Bessborough Road – The Canford Cliffs Land Society have arranged the vegetation beside the footpath from Bessborough Road to Haven Road (next to the Electricity sub-station) to be cut back. MH said that, although the Land Society was organising this, the work is actually being done through the Community Pay Back Scheme and therefore the labour costs are nil.

Footpath 82 Spur – At special meeting of Canford Cliffs and Penn Hill Area Committee held on 19/07/10, Members granted the Definitive Modification Order to add this footpath to the Definitive Map.

Almost certainly, the Sandbanks Boatyard & Marina Co Ltd will appeal

Possible Charitable Status for Assn: JS has still to set up a small Sub-Committee to look at this.

Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden) MH reported that the Canford Cliffs Play Area is scheduled for 2001/2012. However, TS reported that Cllr Peter Adams had told him that this will not now be progressed. MH will double check to clarify this situation.

CD was not present to report on the current state of the sunken garden. However, JS said that Simon Legg was keen to set up a meeting.

Funding for Westbourne Medical Centre and the NHS Dental Practice in Westbourne

Jim Wilson believes that the withholding of funds from both the medical & dental practices may have possible serious implications on the ability of those two individual practices being able to continuing carrying on over the medium to long term, even in their present state. This, of course, is going to be subject to whatever occurs when the present governments plans for change come to fruition and whether either of those practices have been able to retain the patients that exist.

JS proposed that a meeting with the non-executive members of the board should be put under way.

Overhanging Hedge at Kenilworth Court, 3 Western Road. MH reported that after considerable discussions with the residents of of the block he Mr. Hertz(?) the representative of the Managing Agent at Kenilworth Court, managed to secure agreement from the majority to have the hedge removed in the next few weeks with replanting to take place 6 months later. One of the residents however, contacted the council and asked if it would be possible instead to keep the hedge in-situ until the replanting takes place. This was deemed to be a reasonable request and this is where MH left it for now – that the replanting MUST be carried out before Christmas.

MH will put it on record that this is the case, so that if it is not done, the council themselves can take action.

Former Cafe building, Compton Acres (Change of use of former cafe building A3 to playschool D1) – Temporary permission granted for two years from 28/06/10.

Chairman”s note: £41,258 capital funding from the “Early Years Quality & Access Capital Grant (2008-2011) is to be allocated to the Wise Owl Pre-school at Compton Acres following termination of the rental agreement for their current premises but applications must show the applicant’s sustainability and commitment to delivering a service for at least three years and this will be reflected in the funding agreement with the Local Authority.

6A Dalkeith Road (Demolish existing property and build new contemporary dwelling) – Application registered on 10/05/10 and letter of objection lodged on behalf of Assn on 25/05/10. Application withdrawn on 05/07/10.

Chairman”s Note: I omitted to cover this item in my efforts to conclude the business of the meeting quickly. The Guest Speaker was Poole”s Chief Executive, John McBride, and much of what JMcB had to say and other topics discussed have been reported elsewhere in the Minutes.

5.      REPORT RE CANFORD CLIFFS & PENN HILL AREA COMMITTEE MEETING (14/07/10)

Chairman”s Note: Again, I omitted to cover this item in my efforts to conclude the business of the meeting quickly.

The subject of the new cycle lanes in Penn Hill Ave was discussed at length, particularly as there is no room for cycle lanes at Woodside/Kingsbridge Roads end of Penn Hill Ave. Cllr Parker proposed a review of the scheme after it”s been operation for a while.

The mini-roundabout at the junction of Kingsbridge/Highbridge Road was also the subject of some concern, as pantechnicons using this route, which the Council, in its infinite wisdom, has designated as a Prime Transport Corridor between Poole & Bournemouth find it difficult to negotiate this roundabout.

One pantechnicon recently driving over the roundabout has caused the surface to break up.

One Penn Hill Ave resident, present at the meeting, suggested a one-way system using Balmoral Road, Sandecotes Road and Kingsbridge Road.

6.         ACCOUNTS TO DATE

JS reported that the total funds as at 30th June amounted to £36,023

Alexandra Park Lodge – The Council are planning to demolish this property and replace it with a single storey Childrens” Centre at a cost of £280,000. It is intended to submit an application with the intention of it being considered by Planning Committee on 19th August in order for the works to be completed in sufficient time for service delivery from March 2011.

The Children’s Centre will serve families living in the Parkstone, Penn Hill, and Canford Cliffs area.

There is to be two consultation events, both to be held at Alexandra Bowls Club at 10.00am 29th July and 6pm on 11th August. Flyers and information for local residents and parents will be delivered by the end of this week. There is a feeling that it is not just residents who back onto the park who need to be consulted but other groups that use the park on a daily basis. It is also felt that two short notice meetings at the Bowls Club notified by a flyer to residents at the end of this week does not constitute a proper consultation. It is suggested that this on a par with the letter the Council sent regarding the Playbuilder scheme which, again, was only posted to residents who actually backed onto

Bournemouth and Poole’s Building Schools for the Future (BSF) programme -TS said that there was some confusion over the BSF programme i.e.is Ashdown College still to be funded? MH reported that this case still has to be put forward, and the outcome is still uncertain.

Parkstone, Penn Hill & Canford Cliffs Safer Neighbourhood Team meeting & Canford Cliffs Christmas lights – MH reported two dates for the future.

The Safer Neighbourhood Team will meet on Wednesday July 28th 7.00pm at the Conference Room, Civic Centre, Poole and looking ahead, the Canford Cliffs Christmas lights will be switched on on Haven Road on November 12th.

Parking in Ravine Road – Mike Parkin asked if MH had had her chat with the Mazda Car showroom on Haven Road re their use of the car parking spaces on Ravine Road. MH said that this still has to be done.

24 Ravine Road – Mike Parkin gave an up-to-date report on the planning application, currently, under Appeal for 24 Ravine Road. A site visit by the Inspectorate scheduled for July 28 has now been postponed. The house on this site has now been demolished.

Roland Cunnell said that he had “phoned the Planning Inspectorate to enquire about the site visit by the Inspector to land adjacent to 1 Over Links Drive and had been told that tis had not yet been arranged..

Planning Enforcement, TPOs/Tree replacements – update:
JS reported…
Bella Rosa, 37 Haven Road (Erection of blue oblique glass screens positioned around the timber decking area located at the front of the property) – The smoked glass screens have now been replaced by clear glass.

55 Canford Cliffs Road (Removal of the gates, railings, fence and hedge, and the erection of a low stone wall with planting behind) – A Breach of Condition Notice against Barrington Homes requires work to be completed by 29/06/10.

19 Mornish Road (Tree replacement) – A tree replacement notice was served and the Local Planning Authority (LPA) have looked into taking legal action for failing to comply with it. However, it turns out that it is not a criminal offence to fail to comply with a Tree Replacement Notice but a civil matter. There is, at the moment, financial resource issues across the public sector and the unit does not have the resource to pursue this civil matter.
JS reminded members that, at the beginning of the Budget round last September, he wrote to the Leader of the Council, Cllr Dr Brian Leverett, stating that the Assn and other Residents’ Assns regarded it as an unacceptable step to reduce the number of officers performing non-statutory duties such as Tree
Protection, Planning Enforcement and Economic Development. As a result, the budget for the Planning & Regeneration Service Unit was treated as a special case.
It was, unanimously, agreed the Assn should write to the Head of Planning & Regeneration, again, saying that it was the residents’ wish to see the Council actively pursue the tree replacement at 19 Mornish Road to protect Poole’s environment.

15A Westminster Road (Erection of railings over 1 metre high partly along the frontage of 15a Westminster Road, being adjacent to a highway. The boundary treatment then changes to a double close boarded fence over 1 metre high which continues along the frontage of Westminster Road,being adjacent to a highway and then turns South-West and continues down the boundary with Dalkeith Road being also adjacent to a highway)– No new developments

2 Compton Avenue & 93 Lilliput Road (Boundary treatment) – A new hedgerow will be planted once all the work at 4-6 Compton Avenue has been completed.

Compton Acres – There is a small area of offices occupied by a company not associated with the gardens, However, due to the poor wording of planning consent 02/02998/039/F, permission for offices not necessarily ancillary to Compton Acres has been granted. This wording affectively undermines any enforcement action but as the offices let out are only a couple of rooms and, even if the permission was properly worded, it may well not of been expedient for the LPA to take action over such a small change of use.

Community Working Group (CWG), Progress re Sir Michael Pitt’s recommendations & IDeA Report: JS reported that Roy Pointer had attended the Community Working Group meeting on 05/05/10 and said that the Minutes of the meeting would be circulated with the Minutes of tonight’s meeting.
TS has asked for a copy of the draft Community Engagement Forum mentioned in the CWG minutes but has not yet received this. JS said that he would follow this up.
The next Community Working Group meeting is fixed for 21/07/10, 2-4:30pm in the Study, Upton House

Poole Beaches and Coastal Defences: No new developments

Council Tax 2010/11 & Council’s Budget Monitoring report: In the absence of William Mutlow, JS reported on the Council Budget Monitoring Report (01/04/09 – 31/03/10) presented    WM at last night’s Cabinet meeting, which shows a provisional surplus of £3,433m which will be allocated to 2010/11 unearmarked reserves. NS confirmed that this was largely as a result of ‘one offs’ such as the Planning Reward Grant and cannot be relied on for next year. Another windfall was a refund from HMRC of non-domestic rates on Council property.

Poole Partnership: JS reported that, this afternoon, he had attended the Stronger Communities Partnership Meeting. Topics under discussion included…
•    New coalition government ‘Big Society’ policy and implications for the stronger communities agenda
•    The Stronger Communities section of Poole’s Sustainable Community Strategy 2010 – 2026
•    Draft Community Cohesion Strategy
TS pointed out that Eric Pickles, the Secretary of State for Communities and Local Government, has issued a letter saying that future housing decisions should be devolved down to the relevant council, and he assumes that in future Poole Council will have control of major development sites, and asked JS if there was any comment on that at the meeting. JS replied that there had not been.
CD said that the Conservatives’ Green Paper on Planning was being issued as a White Paper and JS hoped that some of the proposals contained in this would, eventually, be implemented.
Martin Heath commented that it was important that Poole Council had robust policies, such as H4, in its Core Strategy and JS said that public consultation on the subject of ‘saved’ policies was due to take place soon. JS said he would let MH know when the consultation begins. He is already in touch with the appropriate officer about other ‘saved’ policies, namely, BE23 & H10.

Chairman’s note: It is anticipated that public consultation on the Issues & Options/Preferred Approach for proposed Development Management policies will commence on the 2nd August and close on the 1st October.

Canford Cliffs Village & proposal to plant trees in Haven Road: MH reported on progress regarding planting trees on Haven Road, in Canford Cliffs. MH handed out some plans for the planting. These showed four new trees. The two reasons for this are a) that they serve as a traffic calming measure and b) to make the shopping parade a more attractive area.    The arboriculturist says that there would have to be the loss of two car parking spaces in order to make room for the planting of the trees. At a Traders’ meeting yesterday, MH spoke about the scheme but, unfortunately, there is rather a lot of opposition to this from the traders.    May pointed out that the Council have no funding available to pay for this scheme and she will check the actual cost per tree at the meeting next week. Canford Cliffs Land Society will also not be contributing to this scheme.
MH asked the plan could be circulated with the minutes so that residents could feedback their comments and suggestions, before she has the next meeting next Thursday.
There was a lot of discussion from the floor about the proposed scheme – proximity of the bus stop, double parking, parking on double yellow lines etc.
JS wound up this discussion by thanking MH and Keith Alcroft for all the work they have done on

Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden) MH reported that she is still pursuing the Canford Cliffs Play Area. CD gave an update on the Pinecliff sunken garden. This is still going ahead, albeit slowly, and the Council seem to be very pleased that there is local interest in this. CD hopes to hear more this week.

Use of Assn’s Capital Reserve – No new developments but the Notice Board at the Canford Cliffs Library is being well used and is much appreciated by the library staff.

Public Liability Insurance (PLI) – JS is pursuing.

Poole Council’s Business Transformation Programme – No new developments.

BPCCRA Spring 2010 Magazine: JS said that he would like to thank John Gunton for the distribution of the Magazine. Approaches have already been received for advertisements in our Autumn 2010 edition.

Funding for Westbourne Medical Centre and the NHS Dental Practice in Westbourne – Chairman’s note: I omitted to refer to this at our meeting. Members will recall that Jim Wilson raised this at the Assn’s AGM. JW wrote to me on 30/05/10… “…Westbourne Medical partners are meeting with the CEO of the PCT on Tuesday and it is possible that may wish to come back to me. In the meantime, perhaps the (BPCCRA) can give some thought as to who amongst its membership would like to associate themselves by representing the Association on a small oversight committee of say a maximum of one or two persons.”

Vice- Chairman – JS reported that, following his plea for a Vice-Chairman at the Assn’s AGM, Wayne Hancock had volunteered to take on this role. JS thanked WH for agreeing to be Vice- Chairman and his appointment was, unanimously, approved with a show of hands.

Overhanging Hedge at Kenilworth Court, 3 Western Road – MH reported that the hedge encroaches onto the pavement, which is not wide to start with, leaving no room for two people to pass easily. She has arranged a meeting between herself, a Highways Enforcement Officer and a representative of Kennilworth Court. Where the hedge has already been cut back it looks rather unsightly, as Leylandii does not regenerate. Mike Parkin pointed out that these dead parts are quite dangerous as they are at eye level. JS expressed the hope that the Management Committee of Kenilworth Court might be willing to replace the existing hedge with another hedge.

Date of next meeting – This would normally be held on Wednesday 14th July 2010 but this clashes with next Canford Cliffs & Penn Hill Area Committee meeting. It was agreed to change the date of the Assn’s meeting to 21/07/10. This meeting will be concluded by ‘Wine & nibbles’ to enable members to meet socially.

Lilliput Medical Centre (LMC) – The Elms Estate Assn (EEA) would welcome members’ support for the Council’s proposal to make a modest extension to the existing yellow lines at the junction of Elms Avenue/Sandbanks Road; also, to impose No Waiting and No Loading [at any time] restrictions.
Details of the proposals have been posted close to the Lilliput Medical Centre and published in the Advertiser [03/06/2010]. Full details can be obtained from Transportation Services [Steve Dean]
Any objections against or support for the proposal must be submitted by 01/07/2010
EEA fully supports the proposal which is designed to [1] avoid congestion at the junction of a very busy main road [2] prevent tail back from the entrance to the LMC car park [3] improve sight lines at the entrance to the car park.
It is anticipated that the proposal, in conjunction with constructive and ongoing discussions between EEA, the LMC landlord and occupiers regarding better layout and management of the car park, and designed to create more tuning space, will encourage more visitors to use the carpark instead of Elms Avenue. It is often the case that parking spaces remain unused because visitors experience problems at the entrance/exit and/or moving around the car park.

3. AGM 2008 MINUTES:  Accuracy & Matters Arising

The Chairman reminded members that the Minutes of the AGM held on 2nd May 2009 had been included in the Autumn 2009 magazine.  The Chairman said that he had not been contacted about their accuracy and asked for a show of hands to approve the Minutes as no queries had arisen.  This was given and the Minutes were approved.

4. CHAIRMAN’S REPORT

The Chairman proposed to limit his report to the up-dating of items included in the Spring 2019 magazine as follows:

Canford Cliffs Village & Canford Cliffs Play Area

Proposal to plant trees in Haven Road: There has now been some movement on this.  Cllr Mrs May Haines and Keith Alcroft, the Association’s Planning Officer, attended a discussion on the options at the Council Offices.   The Council needs to have further discussions with Transportation Services, as it transpires that there will be a need to remove two or three of the car parking spaces on the North side of Haven Road to accommodate the trees.  The Assn is aware that this idea may not find favour with either the traders on Haven Road or the residents.

Canford Cliffs Play Area: At the last Canford Cliffs and Penn Hill Area Committee, it was agreed that the Planning Obligation Working Group together with Leisure Services reconsider the installation of the CC play area for the current municipal year as funding is already in place.

Quayside (former Dolphin Quays) development, former Poole Pottery & Swan Inn, Old Orchard House, Quay Thistle Hotel & former Poole Pottery factory buildings in Sopers Lane

Former Poole Pottery Site, Land at junction of Sopers Lane & York Road (Development of land at York Road to create a 116 bed care home with an associated Day Centre) – this application was  refused by the  Planning Committee meeting at their meeting on 25/03/10 and this is now subject to an appeal to be determined at a Planning Inquiry to be held in August or October 2010.  This key brownfield site has been designated for use as a Science Park.

Quay Thistle Hotel – The controversial application to demolish the existing hotel and erect a 149 bed hotel with 10 flats above; 133 flats in four blocks and a terrace of 11 houses was withdrawn, at the invitation of the Local Planning Authority, earlier this month.

Poole Borough Council – Committee Dates – At last Tuesday’s Full Council meeting, the current administration voted to change the start time of all Planning Committee meetings to 2.00pm. The new Vice-Chairman of the Planning Committee is Cllr Mrs Judy Butt.  Cllr Mrs Janet Walton has had to stand down from this Committee as she has been appointed Portfolio Holder for Children & Young Peoples’ Services to replace Cllr Tony Woodcock.

Use of Assn’s Capital Reserve – The Assn has funded the new noticeboard at the Canford Cliffs Library: It has also offered financial assistance for the extension of Canford Cliffs Library and plants at the Sunken Garden at Pinecliff Gardens.  It may offer financial assistance with the plant of trees in Haven Road.

Vice Chairman – the Chairman advised that the Association is still looking for a Vice Chairman and JS thanked the President, Terry Stewart, for covering this role and for his support during the year

5.            TREASURER’S REPORT AND APPOINTMENT OF AUDITOR

The Chairman advised there was nothing further to add to the Income and Expenditure Account included in the Spring 2010 magazine.

6.     APPOINTMENT OF AUDITOR:

Peter Schofield had audited the Accounts and has agreed to continue for a further year.  JS asked for approval by the meeting and this was given by a show of hands.

7.            ELECTION OF CHAIRMAN

Terry Stewart said how everybody must be immensely impressed, as to the thoroughness of John Sprackling as the Chairman of the Association, and even though there was some concern for John’s health in the future, he would like to propose that John continue as the Chairman, and asked for a seconder.  It was seconded by John Gunton and carried unanimously.

JS thanked everyone for their support and said that how much he enjoyed being the Chairman.  He went on to say that John Defty had had to resign from the Treasurer’s position to care for his wife

Funding for Westbourne Medical Centre and the NHS Dental Practice in Westbourne – Whilst our Guest Speaker setting up for his presentation, the Chairman invited Jim Wilson, a member of the Association, to speak about NHS financial support for two of its services in the area covered by the Association.

JW opened by telling the meeting that he was formerly Chairman of the Poole Primary Care Trust. Over the last few months, he has become increasingly concerned about the amount of money that is likely to be cut from NHS services in this area.  Despite what each of the political parties are saying major cuts are well underway.  Two examples of this locally are:

  1. The refusal by Bournemouth & Poole NHS Primary Care Trust to honour some of the Running Costs (excluding Capital costs) of the previously agreed extension to the Westbourne Medical Centre. The extension is to provide better medical services for residents in our area which are much needed and will be more so when the cuts start having some effect on our two local hospitals.
  1. Turning to the NHS Dental Practice in Westbourne, the PCT agrees that the practice does not receive the full cost tariff which is given to other dental practices in the nearby area. The Dental Practice has taken on nearly 1 million pounds of their own liability on premises to improve dental facilities and was previously given the indication that they would receive funding to support the dental practice.  However, doubt has now been expressed that this will be so.

JW believes it is in the Association’s interest to take an active interest in the Primary Care Trust’s decisions, and called for somebody in the Association to take on this responsibility.

The Chairman said that it would be put down on the Agenda for the Association’s next monthly meeting.

7.    PRESENTATION BY WARREN LEVER, POOLE COUNCIL’S ENVIRONMENT AND DESIGN TEAM   MANAGER.

Mr. Lever then took questions from the floor.

Dennis Riley opened by pointing out the awfulness of the area around Poole Bus Station.  Mr. Riley also pointed out that the density of Canford Cliffs was not being maintained; demolishing one house and building three or four in its place, or a block of flats for instance.

He also said that there was a trend to build blocks of flats higher than the three stories originally agreed.

Mr. Lever answered by saying that first of all the LPA recognises the shortfalls of the bus station area and is currently working hard to make changes.

In order to comply with the last Government’s building programme, tall blocks of flats need to be built, and all that the LPA can do is to try to ensure that they are the right design and in the right place.

JS asked Mr. Lever if he could comment on the sub division of plots in Canford Cliffs.

Mr. Lever replied that this is something for the LPA to look at.

Terry Stewart commented that he was glad that Mr. Lever admits that Poole does not have a vision for the future.

He pointed out that even though Poole Quay was a Conservation Area, the LPA have more or less  accepted a terrible design for the rebuilding of the Thistle Hotel site and asks when are we going  to get really good control of the design of our most historic sites within the borough.

Mr. Lever pointed out that approval had not been given by the LPA  to the design to rebuild the Thistle Hotel, but there is a Planning Performance Agreement, which is a different thing, and is essentially a project execution plan for an application not approval of the application as such.

Barry Weir asked Mr. Lever to confirm that the restraints on design do not apply outside of the Conservation Areas.

Mr. Lever confirmed that the restraints do not apply to demolition, although PPS 1 is overarching.

Roy Pointer asked Mr. Lever how the LPA deals with the situation where in previous years they have made a ‘mistake’ and allowed an unsuitable building to be built in a conservation area and an application is made for a similar design, quoting the previous one as a precedent.

Mr. Lever replied that this could be difficult; however, if the prevailing character of the street is red brick for instance, an application going against this should be fairly easy to defend.

John Gunton asked about the Third Party Appeal procedure, and Mr. Lever replied that he was probably not the right person to talk about this.

The Chairman then thanked Mr. Lever for his presentation.

ANY OTHER BUSINESS

The Chairman welcomed Mr. Robert Syms (MP) who then gave a short talk.

Mr. Syms opened by explaining the arithmetic of Parliament following the election i.e. how the parliamentary seat numbers added up and led to the present situation of a Conservative/Lib.Dem Coalition.  David Cameron had to put aside Party interests in favour of national interest. The arrangement will require give and take between the two parties and Mr. Simms wishes both David Cameron and Nick Clegg well in doing the best for our country.

Mr. Syms then went on to tell the meeting about a Conservative Green Paper for Planning which addresses many of the concerns of people at the meeting, and that he expects a White Paper will be produced soon, setting out changes to the Planning system. For example, it is anticipated the White Paper will give more power to Local Authorities, and increased fines may be introduced that reflect property values to prevent developers riding roughshod over the system. He hopes that the changes will benefit Poole.

He finished off by saying that there has been a detrimental effect on suburban areas, not only in Poole, by classifying them as brownfield sites leading to a lot of inappropriate development, and he is sure that the new government will do its best to protect our environment and inheritance.

Bella Rosa, 37 Haven Road (Erection of blue oblique glass screens positioned around the timber decking area located at the front of the property – Enforcement Appeal APP/Q1255/C/09/2112004) The Inspector dismissed both appeals on 05/03/10, upheld the enforcement notice served and varied the period of compliance from “14 days” to “two months”. This restaurant is currently being offered for sale for £100.000.

              Poole Beaches and Coastal Defences: No new developments

              Council Tax 2010/11 & Council”s Budget Monitoring report: NS reported that the current forecast underspend is £1.3m/£1.4m on a turnover of £100m, after of deduction of a “windfall” Housing & Planning Delivery Grant of £1.1m.

              Poole Partnership: JS reported that he had attended the Stronger Communities Partnership meeting on  03/03/10.  The principle item on the Agenda was the update of the Sustainable Community Strategy, following on from the State of the Area Debate.

              Canford Cliffs Village & proposal to plant trees in Haven Road: KA reported that Cllr May Haines is trying to arrange a meeting, but this is unlikely to happen before Easter.

              Public Rights of Way:

              Westminster Road end of Dalkeith RoadThe Authority has made the decision to improve the lower section of the path as the unmade section meets the tarmac. The works will be carried out on 20/03/10. At this time the stones that have been erected will be moved to the side but left on site for collection by the owner, the kerb stone and ditches will be removed to create a 2.5m wide section of ramped footpath suitable for pedestrian use and DDA compliant (Disability Discrimination Act).

              The works will photographed and catalogued and should in the future these works be damaged, the stones re-erected or any other obstruction placed on this or any other section the Authority will recover their reasonable costs from the person/s responsible

              Buccleuch Road to Lakeside RoadSA said he is “chasing”  This has been ongoing for 3 years; last year SA was informed “ “they” thought it was a highway and that someone vaguely remembered driving down it in the past”  Local residents want it to be registered as a footpath or byway.  SA will continue to remind the council every year.

              NS commented that there is only one Rights of Way officer, so action does not happen swiftly!

              Bessborough Road – No new developments.

              Possible Charitable Status for Assn: JS has still to set up a small Sub-Committee to look at this.

              Canford Cliffs Play Area/Pinecliff Gardens (Sunken garden): JS reported that the plants that five different plant species been selected for the two beds in the sunken garden.

              The cost will be £469.41 for 115 plants total (5 different plant species selected to make up this 115) and the Council were hoping that this could be funded by the Assn.

              Daphne Howell informed the meeting that she is very disappointed by how Pinecliff Gardens looks now, she outlined the history of the gardens, which were previously lawns with borders and then planted with colourful flowers each year.  More recently the flower beds had been replaced with ‘Mediterranean’ style planting, which has not flourished and now looks very bedraggled.

              DH suggested that all the plants should be removed, the soil covered by black plastic and pebbles with just a few attractive colourful drought resistant plants. After some discussion it was agreed that CD should liaise with DH and arrange a meeting with the officers and report back.

              The possibility of a volunteer group to either assist with the planting, and maybe maintain the garden was also discussed.

              It was agreed to defer a decision on whether the Assn should contribute to the planting until the other options had been investigated.

              Canford Cliffs Play area –  CD is still chasing this, but it will not be done until some time next year.

              NS commented that the upgrade of 22 play areas identified under the Playbuilder Scheme has to be completed by 2011, so these play areas have to be dealt with first.

              Use of Assn”s Capital Reserve & Canford Cliffs Library Noticeboard:  JS reported that the Canford Cliffs Library noticeboard is now in place but disappointment has been expressed about the legibility of the recognition.

              Members agreed that the Assn should request the wording to be changed to black or some other colour which is more legible

              Public Liability Insurance (PLI) –  JS is pursuing.

              3.  NEW HOUSING DEVELOPMENT

              24 Ravine Road (Demolish existing dwelling and erect replacement dwelling with integral garaging. (Revised scheme) Amended plans received 08/12/09 and 25/01/10) – Application refused under delegated authority on 29/01/10 is now the subject of appeal (APP/Q1255/A/10/2122302) to be determined by Written Representations. The final date for Statements & representations is 29/03/10.

              JS suggested that Members might like to write to the Planning Inspectorate (using the on-line facility available via the Planning Inspectorate”s website <http://www.planningportal.gov.uk/england/public/planning/appeals/search/>) to show the strength of local feeling.

              4 Lawrence Drive (Demolish existing buildings and erect 1 block of 8 apartments with assoc parking) – Application refused on 05/03/10.

              24 Cliff Drive (Extension to existing beach hut & relocate steps (revised Scheme) – Letter of objection lodged on behalf of Assn on 08/01/10.

              Canford Cliffs, Promenade 2 (a) Construction of 18 new beach huts – Application No: 08/24380/005/F & (b) Conservation Area application to demolish 8 beach huts (nos 99-106) adjacent to Canford Cliffs Chine. Application No: 08/24380/007/U The applications were registered as long ago as 22/01/08 &13/02/08 respectively.  MH will keep the Assn advised of any further developments.

              4-6 Compton Avenue (Non material amendment of planning permission 06/12687/005/F to extend basement parking, an additional staircase, two roof lights, convert half gable window to full height) – Application registered on 14/10/09.  There is a technical issue regarding the minor amendment, in relation to correctly linking the amendment scheme to the section 106 agreement of permission 07/12687/006/F which the LPA are trying to sought out with the agent.

              8 Shore Road – BPCCRA will continue to monitor possible tree work application.   An entrance has been created on the Haven Road side of this property.  This property is up for sale at is “offers” in excess of £2m.

              60A Kings Avenue (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council”s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.

              4. ACCOUNTS TO DATE – JS thanked John Defty who stepped down at this meeting having served as Hon Treasurer for eight years and presented a “bottle” as a token of the Assn”s appreciation.

              John Defty”s role is being taken over by Paul Fearnley.

              Chairman”s Note: JD has sent a signed copy of the Terms of Engagement to Schofields.  I should have sought agreement to the change in bank signatories but I will need to action this at our next meeting.

              5.                ANY OTHER BUSINESS

              Warning about external post boxes: A letter had been circulated by Dorset Police warning residents about a spate of ID theft after post has been stolen from external post boxes in the wall or at the gate of large houses in the area. The letter makes particular reference to large properties however external post boxes are often used for blocks of flats and apartments where residents prefer the security of restricted access.

              CCTV – The Oasis, Lindsay Road has suffered several thefts of bicycles from its “compound” at the rear of the premises. CCTV has recently been installed, which has proved extremely effective in assisting the police to identify, and subsequently apprehend, the miscreants.

              National Organisation of Residents” Associations AGM – JS reported that he attended the National Organisation of Residents” Associations AGM in London and the Guest Speaker was Robert Upton, Deputy Chair of the Infrastructure Planning Commission (Chairman: Sir Michael Pitt) which started its work on 01/03/10.

              Poole Council”s Business Transformation Programme – One of our members, Mr Gell, is taking a great interest in this project, which has now been running three years and is concerned about the poor communication about this project to residents.

              BPCCRA Spring 2010 Magazine: – Copy required by 29th March in order to have the magazines ready for distribution during the week commencing 19 April.

              Friends of Poole Park AGM – To be held at the Civic Centre on 22/03/10 at 7.00pm

              Minutes Secretary – JS thanked Val Short who stepped down at this meeting having served as Minutes Secretary for six years and presented a pot of primroses as a token of the Assn”s appreciation.

              Val Short”s role is being taken over by Carol Parkin.

              Planning Enforcement, TPOs/Tree replacements – update:

              JS reported

              75 Canford Cliffs Road – Planning application for alterations to existing entrance to form new vehicular access with gates was lodged on 12/10/09. Once agreed, the owner will not be able to make subsequent changes without the risk of formal action being taken against him under the article 4 direction

              15A Westminster Road – Lowering of both the railings and the fence adjacent to the highway to 1 metre or remove them in their entirety was due to be completed by 03/10/09. The Planning Officer has written to the developer’s agent requesting some details on a revised boundary treatment, which, in principle, is acceptable. It is felt that, as this is a corner plot, it would be unfair on the current owners to require them to remove the existing boundary treatment (as required in the enforcement notice) without an alternative scheme to replace the existing so that they can secure their land, that is why the Local Planning Authority (LPA) are still trying to negotiate a solution.

              Other current planning enforcement issues

              Bella Rosa, 37 Haven Road – Retrospective application to erect glass screens to front and side of decking at front of property was refused on 03/07/09. Subject to ‘Written representation’ appeal (APP/Q1255/A/09/2108355) The deadline for statements/representations was 28/08/09.

              2 Compton Avenue & 93 Lilliput Road – Hedging to be replaced but the Head of Planning Enforcement is seeking clarification to see if owners are waiting until the dormant season at the end of October.

              51 Chaddesley Glen – A new planning application has been requested due to noticeable alterations to the double garage located to the rear of the property. The Agents had asked for the proposal to be treated as a minor amendment to that previously approved on 27/12/07.

              JS reported that he had had a meeting last week with Mark Hitchcott, one of the Planning Enforcement officer and both he and Mr Hitchcott had found the meeting very helpful.

              JS had commented that some residents still mistrust the planning process and he was asked to encourage residents to contact the Planning Enforcement Team directly so that they can explain their actions face to face. This will assist the Council in overcoming residents’ mistrust of the system and demonstrate to residents that the Council do take residents’ concerns seriously and attempt to resolve them even if they sometimes fall outside their sphere of influence.

              Mr Hitchcott accepted that enforcement action can seem painfully slow but, if all else fails, the Council do prosecute transgressors. So far this year, the Council have prosecuted two persons for not complying with Enforcement Notices upheld on appeal at 85 Ringwood Road and rear of 115-121 Commercial Road, and, most importantly, after these prosecutions we have secured compliance with the Notices.

              Supporting evidence is needed if the Assn. is asked to represent individuals in matters concerning planning enforcement. NS offered to look into any suspect planning applications, but he, also, can only act on evidence, not rumours.

              MH advised that Bella Rosa (formerly BH13) have appealed, so until the appeal is heard Planning Enforcement are unable to act.

              Community Working Group, Progress re Sir Michael Pitt’s recommendations & IDeA Report: JS reported that the next CWG meeting has been fixed for 25/11/09 and Roy Pointer will attending as the Assn’s representative.

              Poole Beaches and Coastal Defences: The Poole & Christchurch Bays Shoreline Management Plan Review – Key Stakeholder Group meeting on 26/11/09. Again, Roy Pointer will attending as the Assn’s representative

              Council Tax 2010/11 & Council’s Budget Monitoring report: Wlliam Mutlow gave a brief outline of the presentation made at the Newtown & Parkstone Area Committee meeting on 28/10/09, which will also be given at the forthcoming Canford Cliffs & Penn Hill Area Committee meeting.

              The forecasts contained in the presentation are concerned mainly with next year’s budget, rather than looking at the long term (4-5 years) It states that “the rate of Council Tax will be assumed at no more than 5% in any given year in the MTFP (Medium Term Financial Plan) period for financial planning purposes”’ – the average increase reported in the national press was 1.6%. The average increases for Unitary Authorities is forecast to be the highest at 2.63%

              Following some discussion on the need for an increase in Council Tax, NS commented that efficiency savings are being looked at, but that the problem still remained of Poole being the 3rd lowest funded authority in the country. It does not cost any less to fund services in Poole, yet we are awarded less per head for essential services e.g. education. The average wage in Poole is low and the average house price is high, 15 times higher than the average wage, thus making it difficult for local people to buy homes.

              It was suggested that the Council should make every effort to ensure that all members of the public are aware of the lack of funding from Central Government.

              Poole Partnership: JS reported that will be attending a breakfast meeting of the Poole Partnership tomorrow (to review the Sustainable Community Strategy)

              Canford Cliffs Village & proposal to plant trees in Haven Road: No progress had been made on the proposal to plant trees.

              The Christmas Lights in the Village will be switched on by the Mayor at 6.00 p.m. on Friday 13th November 2009. There is a mulled wine reception at the Kitchen Haven showroom from 5.30 p.m. to which everyone is welcome.

              Public Liability Insurance (PLI) – JS is pursuing.

              Mobile ‘Phone Mast, Elgin Road: Chris Stracey reported that Richard Dunk from Vodafone had seen one of Poole’s Planning Officer last week and discussed the proposed works. The proposal is to increase the height of the existing mast from 12 metres to 13.7 metres and that O2 will put an aerial transmitter on to the mast as well. This means that the mast will be wider at the base because of the additional height and O2 will put another cabinet to house the new equipment at the base alongside the Vodafone cabinet. Richard Dunk said that the Planning Officer was receptive to the idea as O2 want more masts and this sharing idea would save O2 having to put up its own mast.

              CS feels sure that our local Residents will not be too happy about this as this seems like “the thin edge of the wedge” and could lead to more and more transmitters being added to existing masts. He will be speaking to Dr Goodridge in Elgin Road. His house is right next to the mast and he organised the protest when the original mast went up. Although the original action failed, CS thinks that this is a development which is very unwelcome as what is to stop more and more transmitters being added to the mast?

              Masts of 13.7m will require planning consent and so residents will have to opportunity to lodge letters of objection. On the matter of health, it is believed that the highest risk exists where the rings of radiation from two or more masts meet.

              Roland Cunnell said that he had concerns about Land adj 1 Over Links Drive (Sever land and erect a new detached house (Revised Scheme) – Letter of objection registered on behalf of Assn on 03/04/09. Application was expected to be considered at the Planning Committee meeting on 19/11/09 but this had, again, been deferred.

              This application is in Penn Hill Ward, it has been ongoing for several years and the latest deferral is due to an arboriculturalist’s report having been received. All relevant documents are available to view on line. It was suggested that Mr Cunnell personally arrange a meeting with the Head of Planning & Regeneration, Stephen Thorne to discuss the matter.

              JS reported that he had attended a meeting of the Local Development Framework Working Group the previous evening and, at this meeting, up-dates were received on…

              1. SE Dorset Multiple Modal Transport Study by Rick Clayton, Transportation Services – RC provided us with a high level analysis of responses to Survey questionnaire.

              2. Site Specific Allocations by Bill Gordon, Strategic Planning – There has been 51 responses which areavailable on BoP website. Officers are now looking at the remaining 200 ’saved’ Development Control policies and hope to reduce these to 40/50. This will be subject to further informal consultation.

              3. Sustainable Community Strategy Review by Hilary Evans, Community Planning Manager.- The present Strategy covers 2006 to 2012 and needs to be longer term.  Project Team are reviewing this.

              4. IDeA – Peer Review by Nigel Jacobs, Planning Policy&Imp. Manager – A meeting with Service Unit Heads was held last week to discuss a more co-ordinated approach to planning. Quarterly Newsletter is being progressed.

              JS said that he and his wife had attended the Planning Inquiry re 20 Balcombe Road Demolish existing and erect 3 detached houses (Revised Scheme) – Application refused on 27/05/09) the previous day and today

              In addition to challenging the refusal for the three properties, the appellants challenged the requirement for a contribution for around £12,000 under the South East Dorset Transport Contributions Scheme Adopted 2009. An article in yesterday’s Daily Echo reported that the Planning Inspector questioned the Recreational and Transportation contributions re 147 Banks Road.

              4-6 Compton Avenue (Demolish existing and erect 2 blocks of flats (10 in total) with basement parking,bin and cycle stores. (Revised Scheme Block A). Revised plans received 05.02.2008) Application was registered as long ago as 18/12/07. The revised scheme application has not yet been approved, This is being held up because the section 106 agreement cannot be agreed and because of changes in ownership. The main building remains substantially the same as previously approved, but there are some additional out buildings, changes to the basement and additional ventilation shafts from the original approval, these may be subject to future enforcement action if the Local Planning Authority (LPA) cannot secure appropriate planting/landscaping, Planning officers are currently considering these changes. This property was purchased only three months ago and the LPA are in the process addressing the outstanding matters with the new owners.

              8 Shore Road – BPCCRA will continue to monitor possible tree work application. An entrance has been created on the Haven Road side of this property.

              60A Kings Avenue (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council’s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.

              East Cliff and Bournemouth Town Centre Residents’ Association – Chris Stracey attended the meeting of this Assn at the Ocean View Hotel on Saturday

              The meeting was chaired by former Cllr David Clutterbuck and was attended by four local Councillors Anne and Michael Filer, David Kelsey and David Smith (who is on the Bournemouth Town Planning Board) and about 50 residents.

              The possibility of having one or more of the Assn’s meetings on a Saturday morning or afternoon was ‘floated’ but this was left for further discussion at a later date.

              CS reported that matters discussed at the meeting included..

              • · Improvements to Bournemouth Seafront, Surf Reef at Boscombe, Boscombe Pier & “Lump of Granite” art work by Boscombe Pier – People cycling in a dangerous manner along the seafront and the cliff top There is 7 miles of sea front, obviously a massive task. A good start has been made at Boscombe with the construction of the Surf Reef and it was generally felt that the whole area by Boscombe Pier has improved, good cafes, new shops etc. Some doubt was expressed about the cost of the Reef (£3mil) and whether it was any good and there was a general thumbs down in respect of the art work generally known as “the lump of granite” (Shades of the art work at Penn Hill????) on the roundabout by the pier. Some further improvements to the Pier were suggested (no facilities) and complaints made about wet suits obstructing the area. More beach huts are required, possibly 1000.Other comments concerned improvements to Bournemouth Pier, Happylands looks awful, Westover Rowing Club lease (£37 pa!!!!) runs out this year and Toft steps by the lift needs attention.
              • · People cycling in a dangerous manner along the seafront and the cliff top – Same problem as Sandbanks Sea front.
              • · Shelters and seats on the Cliff Top – More seats and shelters are required but Residents worried about these being used by alcoholics and drug users/pushers. One Clifftop shelter destroyed by bad weather 4 years ago has not been replaced
              • · Parking meters – Parking meters have been delayed by technical and procedural problems. Apparently they fill up with water when there is rain. Amusing point raised in that people pull off the “Not in Use” Yellow stickers on the meters and put money in and then get very upset when there is no sign of a ticket!  DOH! However, ”meters are go” for the end of this month.
              • · Road and verge cleaning and maintenance & Litter problems – Many Residents complained about the lack of street cleaning esp. leaves and maintenance of the verges. Litter everywhere and many verges destroyed by parking cars.
              • · Cliff End Hotel adjoining Keviston Court & Normandy Hotel – Usual problems with these two Hotels in that Developers are supposed to be carrying out works/demolition there are failing to do so (probably no money because of the recession) and the sites have become dumping grounds for all kinds of rubbish. What’s David LLoyd up to? No one knows.
              • · Proposed Drug Management Centre in Lansdowne Road (Crime Reduction Initiative programme) – Many objections raised by Residents and Businesses  in respect of the proposed Centralised Drug Facility at the Lansdowne. One main objection is that addicts will be sent there from all over the country, especially from London. Where will they stay? Will their friends come with them? Who is going to pay for their accommodation? Matter to be debated in the Town Hall on the 8th Dec at 10 a.m. Council is against the proposal, Police are for it.
              • · Work to turn Holdenhurst Road into a Boulevard – Work is proposed to turn Holdenhurst Road into a Boulevard with centre of the road Pedestrian Islands and Trees. (Sounds like Canford Cliffs proposal??).
              • · Speeding in Kynveton Road – A mobile speed camera will be made available on non specified days for two weeks
              • · Budgets – All the above will be subject to budgetary constraints. Suggestions made by Councillors that Residents could take better ownership of problems such as litter clearance and could take responsibility for clearing minor items of rubbish on verges/pavements outside their properties/businesses. Pointed out that Residents could be prosecuted under Health and Safety laws if sweeping of leaves off pavements by residents caused a slippery surface and passers-by fell over.

              Canford Cliffs Library Notice BoardTS had met with the Library Manager and it was agreed that the noticeboard would be placed on the wall at the bottom of the library. It would be large enough to display 16 A4 sheets and the library staff will be responsible for putting up the posters. It was cheaper to attach the noticeboard to the wall than to mount it on posts.

              Car parking in Whitecliff Road A proposal to put double yellow lines along the north side of Whitecliff Road had been turned down, but a small length of double yellow lines on the corner of Sherwood Avenue was accepted.

              Night economy in Lower ParkstoneThere is a need for a taxi rank in Lower Parkstone due to the night economy of Poole being centred in Ashley Cross. Apparently patrons of the Parkstone venues subsequently travel by taxi to Bournemouth in the early hours of the morning. A suitable site for a taxi rank is being discussed.

              S106 Transport & Recreational Contributions In answer to a question from William Mutlow about how much is received and spent in each area, TS commented that this had been asked previously and that there was a document available giving this information. There are different types of contributions ,e.g. Recreation and Leisure, Transport.

              The Recreational Contributions have to be spent in the ward or an adjoining one, e.g. a play park may extend into an adjoining ward, although some Recreational contributions could be spent in Poole Park or Upton Park.

              Developers query why they should pay Transport contributions which cover other areas in Dorset, but the Council have to stand firm on this ruling. It was suggested that any queries about Transport contributions should be addressed to Steve Dean in the first instance.

              Town Green ApplicationsBranksome Recreation Ground is being processed, although there is a possibility of a Public Inquiry. Baiter and Harbourside Park will not be looked at until Branksome has been decided, but there will be no upgrades or improvements in the meantime.

              There being no other AOB, JS closed closed at 8.45pm.

              JS reported that the 27 page Improvement & Development Agency (IDeA) Report has been posted on the BoP website. The report comments that the Local Planning Authority should engage with all residents and groups and not just those who are the most vocal.

              TS said that Stephen Thorne is very happy with conclusions of the independent audit of planning processes – not such a clear set of recommendations as Sir Michael Pitt, but various ways of improving the Planning Committee, including re-arranging the layout in the room and improvements to sound so that everyone can see and hear clearly.

              JS said that he would set out the 15 Key recommendations in the Minutes

              Achieving outcomes

              1. Ensure better awareness and ownership of the Core Strategy among officers and Members through a range of means.
              2. The senior management team needs to ensure that the planning and regeneration service acts itself and is seen by other council services to act as a service to deliver the corporate regeneration agenda.

              Integration and collaboration

              1. Ensure that front line staff have appropriate information and training to apply the policy framework effectively and consistently
              2. Plan and launch a comprehensive customer focus and engagement cisco 640-816 programme

              Leading and engaging the community

              1. Linked to the above, map out improved processes for engagement between planning officers and the asset management service to ensure that planning advice is being actively sought prior to the preparation of disposal details for council sites
              2. Review the operation of the Planning Committee to improve the service it provides for the community.
              3. Develop a more comprehensive approach to engagement with customers and stakeholders that is corporately led through officers and members
              4. Consider the use of the existing Area Committees as an additional forum for engagement with the local community including looking at models of area committees elsewhere which deal with planning matters

              1. Ensure that the Head of Planning has the resources to complete the restructure and create sufficient support that allows him to play a more strategic role to lead the service through the required change
              2. In line with recommendation 4 above, strengthen the service customer focus through a range of initiatives,
              3. Ensure better monitoring of S106 obligations through a specific policy and processes, allocating responsibility for S106 monitoring to one dedicated officer, and the introduction of a corporate S106 monitoring group

              RP reported that he had attended the Community Working Group (CWG) meeting on 30/09/09. Key points arising…

              • Agenda and Minutes to be posted on BoP website in due course. Keith Pegram is updating site.
              • Ward Walks planned by Stephen Thorne to get local Councillors out into the wards to review key planning, transport, environment, social issues. A Ward Walk took place toady; Residents’ Assns to notify issues of interest to their Ward members. As It is an exercise designed for listening rather than debating. it was felt that the event should be confined to Officers and Members.
              • Quay Thistle development – request for special Planning Committee not progressed as yet.
              • Web Access Module (WAM) being upgraded. Should allow Pre-Application meeting notes to be added to application files. CWG concern that this should be done before a decision is taken, not merely as an historical record. ST to investigate the practicalities.
              • Trees on application sites – decisions are taken in accordance with British Standard; covers amenity value, visibility, health, life cycle, crown thinning etc. Key dimensions are, not less than 2m from the edge of canopies and foundations to be clear of root zone.               • Town and village greens – building on. Chinese wall in Council between Licensing Committee. that decides on appropriation of land to be developed and Planning. Committee. that decides on the merits of a planning application. Relevant to Branksome Rec. and Broadstone Rec.
              • Householder Planning Appeals – HM Planning Inspectorate decreed that for small developments. eg. extensions, the Inspector will simply review the file papers as they were at time of original decision and will not take further reps. No ‘second bite at the cherry’.
              • Planning Committee voting. Coloured cards now in use; R,Y,G to be stencilled on for the colour blind. Room arranged so that members face public. Method to be continued for the time being. Not recording votes but public free to sit in and note down votes. Medium term plan to get meeting web cam so that proceedings can be viewed on web. ST has agreed idea with Chief Executive but budgets to be sorted etc. Keith Pegram will action.
              • Political-v-Quasi judicial role and membership of Planning Committee. Pro-rata political seats is common practice and no chance of changing in ST opinion.
              • Flooding risks – lot of confusion in responsibilities from Environment Agency downwards. ST keen to get more clarity on roles/responsibilities/funding. Also the move for design risk from 1/50 to 1/100 to 1/200 year flood event needs to be clarified. ST will pursue and apprise us in due course.
              • New information on Planning Applications – Residents’ Assns keeping up to speed. Decisions are due 56 days from a valid deposit of an application. Plan to use WAM to generate e-mail to relevant RAs when new/updated information received. Clearly depends on WAM implementation.

              Minutes – target to issue them a week after the meeting.

              Ward Walks – NS said that he & MH had taken part in a Ward Walk with Richard Genge and a tree officer, they looked at Salter Road and Grasmere Road where new properties have to be built up 1m for flood protection, making them higher than existing properties. Chester and Eaton Roads are at present largely unspoilt and ideally should be kept that way. The most important aspects are landscaping and trees. Planners should require developers to leave space for good landscaping, often this is not the case. Also looked at Lakeside Road and Haven Road from Loch Fyne to Flaghead. The intention of the walk was to provide a general overview of the area.

              Poole Beaches and Coastal Defences: The Poole & Christchurch Bays Shoreline Management Plan Review – Key Stakeholder Group meeting has been postponed to 26th November

              Council Tax 2010/11 & Council’s Budget Monitoring report: In the absence of WM, JS reported on the financial reports presented at last night’s Cabinet meeting.

              JS said that Cllr Leverett had outlined the assumptions and principles to be observed in the on-going development of next year’s Budget, one of which is that the increase in Council Tax will be levied at no more than 5%.

              JS said that he would include the assumptions and principles in the Minutes (see below)

              (i) the assumption of an on-going revenue contribution to capital of £1m per annum over the period of the MTFP (Medium Term Financial Plan) subject to work now on-going to review the capital strategy

              (ii) to minimise the use of Supported Borrowing Approvals as much as possible further to (sic)

              (iii) that Council Tax will be levied at no more than 5% in any given year over the period of the MTFP

              (iv) that the balance of released reserves not needed for other purposes may be used to fund one-off costs pressures in 2010/11 subject to Cabinet approving the relevant requests for growth through Stage 2 of the on-going MTFP process

              (v) the organisation will avoid building growth into the base budget position for 2010/11 that it could not reasonably expect to sustain over the remainder of the MTFP period.

              The latest Council 2009/10 Budget Monitoring report shows a projected year-end surplus of £209k.

              There is also a reduction in 2009/10 Capital Programme of £13,395m. This is the result of re-profiling of around £15m to future years (£8m Poole Bridge £6.5m in the schools area and 0.5m of waste strategy). There is no associated Personnel impact.

              Local Economy including Transportation – Saving of (£114,000)

              Due to a combination of both lower journey numbers and reimbursement rates compared to budget, it is now estimated that the Council will underspend by £114k on the £2.7m Concessionary Fares budget. However the reduction in reimbursement rates is a consequence of the Council removing the cap on

              average fares an action that has resulted in a bus operator submitting a capacity claim amounting to £0.5m (this potential liability has not been factored into the forecast and is the subject of further discussions).

              Resources – Saving of (£137,000)

              As part of the July Council Budget monitoring report it was established that when resources within Service Units are identified as available due to the consequence of changing circumstance, be that due to one-off events or due to lower actual provisions for price or volume increases than was assumed within the base budget, they will be redirected in support the Council’s Medium Term Financial Plan (MTFP).

              During the month there has been a further adjustment due to the provision made for energy costs.

              Poole Partnership: JS reported that he had attended the Poole Partnership Steering Group meeting on 30/09/09.

              A review of the Partnership Governance Arrangements is being carried and changes are being recommended which include “increased representation by elected members, non-executive directors and representation across the equality strands.”

              During a discussion of the allocation of Poole’s Performance Reward Grant, members of the Steering Group representing the Bournemouth & Poole Primary Care Trust (PCT), Fire & Rescue etc cautioned embarking on any new projects which involved revenue expenditure as they are facing ‘zero growth’ budgets for the forthcoming year.

              There was a lively discussion about joint working across the conurbation. Both the Police and the PCT have already combined their resources.

              JS pointed out that a joint meeting of Poole and Bournemouth Partnerships in 2007, we were told that the Bournemouth Borough Council and the Borough of Poole had adopted a ‘Convergence Model’ whereby the presumption between the two Councils was that they would always work together unless there was any compelling reason why they should not. He went on to say that he thought there was scope for more joint working but Councillors would need to take the initiative because officers would want to maintain the ’status quo’. Predictably, John McBride took exception to this and pointed to the Multi-Area Agreement, Schools for the Future etc.

              In response, JS pointed there has been no progress report from the ‘Jointly Commissioning Building Consultancy Services Working Party’. This was announced at the Cabinet meeting on 10/02/09 but no timescale for this initiative was set out in the officer’s report. He is sure that there are other areas where a similar approach could be adopted. For instance, Libraries etc, do we really need two Heads of Cultural Services?

              JS said that members may recall that he mentioned that Comprehensive Area Assessments were being introduced from April 2009 at the Assn’s meeting on 08/07/09. To quote…

              By way of background, the new system of Comprehensive Area Assessment introduced from April 2009 requires Local Authorities and other public agencies to account collectively for how well they are doing. An area risk assessment into the prospects for the area and the quality of life for local people forms a key part of the comprehensive area assessment.”

              Martin Green (Audit Commission) gave an up-date and said that the results for all Local Authorities will be posted on the website on 10/12/09.

              A small task group to include the Chair and representatives of the Borough of Poole, Dorset Police, NHS Bournemouth & Poole, Dorset Fire and Rescue and Poole CVS is reviewing Poole’s Sustainable Community Strategy. suggested that areas which need addressing are…

              Sustainable Communities Act – TS asked for an up-date.

              NS replied that Poole and Bournemouth are working together on the Comprehensive Area Assessment which is designed to improve the whole community and improve efficiency and economy. Local govt need to prioritize tasks as there are so many requirements that they are fast approaching an ‘overload’ situation.

              TS said that he felt Poole’s response to the Sustainable Communities Act was dominated by elected representatives, whereas this was supposed to be members of the public.

              Canford Cliffs Village & proposal to plant trees in Haven Road: MH met with Warren Leaver, who is arranging for sketches to be put together showing a total revamp of the whole shopping area, and an initial draft proposal. MH will chase this.

              Chairman’s Note: £30,000 has been allocated to provide a ‘natural play’ area for young children at Canford Cliffs Chine.

              Use of Assn’s Capital Reserve: JG is still collecting ideas for possible use of capital reserve – so far suggestions include an extension to Canford Cliffs Library, art for public display and the sunken garden in Pinewood Gardens.

It states at 3.2 ‘Distributions’ of the Administrators’ Progress Report for Ravine Lifestyle dated 21/07/09 that “Clydesdale, the secured lender also had cross guarantees in place over 57 Haven, 4 & 6 Compton, 101 Lilliput and Future 3000.               4. REPORT RE CANFORD CLIFFS & PENN HILL AREA COMMITTEE MEETING – Steph Quinn, Project Co-ordinator, Age Concern Bournemouth, was due to give a short presentation on Project Purple, Poole, which is a new initiative in Poole aiming to provide a range of social and health

              improving activities for the over 55’s across the Borough but this was cancelled at short notice.

              5. ACCOUNTS TO DATE – JD reported that the total funds at the end of September amounted to just over £34,100.

              6. ANY OTHER BUSINESS

              Noticeboard at Canford Cliffs Library – TS reported that, since the refurbishment of the library the available space for notices, etc was not so good, so it was proposed to provide a freestanding noticeboard the cost of which had originally been £500, but had suddenly become £1,000. There is to be a meeting with Cllr. Atkinson, TS & SA on 10/11/09.

              SA commented that, if the Assn is to make a donation towards the cost of the board, this should clearly show some recognition of this. A donation of £1,000 was approved by all present but JS said that he had asked the Canford Cliffs Land Society if the Society might be willing to contribute £500 towards this.

              The Axe Factor – JS said that the Daily Echo has launched a campaign called the Axe Factor, looking at the financial pressures on councils and other public bodies and savings they could make. A two page spread looking at Bournemouth Council will appear tomorrow (Thursday), with a similar feature on Poole next week.

              The Assn had been asked to put forward suggestions. Suggestions received prior to the meeting included

              • Reduce the number of Poole B.C. employees by 5 or 10%. This would be in line with other businesses.
              • Avoid employing expensive Consultants. Hopefully there’s enough ‘brain’ power already within P.B.C. to sort out their own problems.
              • Reduce the number of the co-ordinators, out-reach workers involved with racial integration etc.
              • They could save a lot of money at Hamworthy Outdoor Education Centre. It is losing more money this year than ever before
              • There are probably office jobs that could be cut or scaled down (i.e. from full time to part time etc)…but we are not in a position to assess specifics….but given that labour is the biggest ongoing cost scaling to part time is always a way to cut costs without dropping the job…but I doubt they’d entertain that option!

              And a plea for a service to be started/restored – removal of weeds from Poole’s pavements. Strong enough weed killers are now banned from our streets (illegal apparently) and weeds can only be removed manually. It is feared that the “streets will get worse and become quite tatty etc!”

              TS mentioned cost of cycleways, Penn Hill crossing and public art – none of which are funded by council tax

              Peter Dulieu thought that the Poole News was a waste of money, but that NS said that the cost is now being partially offset with advertising and commented that residents appreciate knowing how their money is being spent.

              Roy Pointer thought that we should challenge the rise in council tax. No justification for increase in the current economic climate. Significant savings could be made by having single units for several large depts.(e.g. IT) for the whole conurbation. MH commented that this could create problems of confidentiality for the two authorities.

              Town Green Application for Whitecliff Recreation Ground and Baiter Park – This was registered by Parkstone Bay Assn (PBA) with the Council on 09/07/09. PBA would welcome the Association’s support for this application.

              JS said that the Branksome Rec application is to be concluded first because it was the first to apply.

              This will almost certainly go to a formal inquiry and the estimated cost is £25,000.

              The Open Spaces Society believe that the Town Green status would NOT prevent the present maintenance regime or enhancements to improve public enjoyment of the open space but this is based on the opinion of Paul Clayden (Open Spaces Society 2007) and has no weight in law.

              TS said that he had discussed this with Cllr Don Collier as it is a Licensing Committee decision. There have been other applications for Town Green status. There is a three month delay from submission of the application which creates fears of a hidden agenda. DC has promised to arrange for clear guidelines of how this type of application will be processed.

              TS went on to say that we should try to protect parks and open spaces and would therefore support other Residents’ Associations, if asked to do so. It was agreed to support PBAs Town Green application for Whitecliff Recreation Ground and Baiter Park in principle, although it was felt that there were higher priorities for the Council to resolve first, not least next year’s Budget.

              If the Poole Town Football Club (PTFC) Stadium is built on Branksome Rec it will be in breach of Policy L9 of the Poole Local Plan. Local residents are forming an Branksome West Residents’ Association. There is to be a special Planning Committee meeting on 26/11/09 at Lighthouse to determine the PTFC application. One compromise being suggested is that 17% of Branksome Rec should be allocated for the Stadium and 83% given ‘Town Green’ status.


              6 St Osmonds Road – Rose Rogers believes that this property has been sold to Dave Wells. There appears to be lots of young people there which is causing local concerns. RR said that Andy Dearing, the Head of Planning Enforcement is investigating.

              Progress re Sir Michael Pitt’s recommendations following independent report into the control of development at the Borough of Poole: The Head of Planning & Regeneration provided an up-date on the key actions taken in relation to Sir Michael Pitt recommendations at the Council Efficiency and Effectiveness Overview & Scrutiny Committee meeting on 03/09/09.

              3rd recommendation: The Council should accelerate the planned remodeling of the membership of its Planning Committee and/or Cabinet in order to strengthen the Planning Committee’s independence and comply fully with the advice of the Audit Commission contained within the Corporate Assessment 2008.

              • Training completed 09/06/09 and all Member training organised for 11/08/09

              Although it was recommended that Cabinet members should not sit on the Planning Committee, Cabinet members continue to sit as susbstitutes. At the Planning Committee meeting on 27/08/09, two of the seven members were Cabinet members.

              4th recommendation: The Council should review the standing of the Planning Committee within its political structure and invite the independent Panel on Members Allowances to more fully recognise the responsibilities and workload of Chair and Members.

              • · The Annual Council considered nominations to Planning Committee at its Full Council meeting on 12/05/09
              • · At member level, the issue of Members Allowances has been considered inappropriate to pursue in an Economic Recession and will be re-visited in 2011.

              5th recommendation: The Council should review the way minutes of the Planning Committee are presented and when decisions are not unanimous, a record should be kept of Councillors abstaining and voting for and against the motion.

              • · The Head of Planning & Regeneration has recommended in consultation with Chair/Vice Chair Planning, Solicitor to the Council, Democratic Services and the Communities Working Group that a pilot scheme of showing a red, green or amber card at the point of vote to record whether the member is voting for, against or abstaining from the motion. Trialled 18/06/09. This has been seen by all parties to be a favourable compromise to the recommendation of a recorded vote and does not require a change to the constitution. Committee members can request a record of the votes.
                • ‘The Head of Legal and Democratic Services has considered this issue and at present sees no reason as to why the style to the Minutes of the Planning Committee should be changed.

              The Head of Legal and Democratic Services’ decision is disappointing in view of the problems arising from the 7 Excelsior Road case which was referred to the Local Government Ombudsman.

              6th recommendation: Given the challenges within the Borough, the Council should commission a comprehensive review of its arrangements for controlling development conducted by an experienced, senior and qualified Planning Officer. The terms of reference of the review should take into account the contents of this report.

              7th recommendation: That the Administration seeks an urgent and permanent resolution to the on-going disagreements within the Group.

              Both Cllrs Mrs Carole Deas and David Gillard are qualified to sit on the Planning Committee but they are now ‘Independent’ and, unless more ‘Independent’ candidates are elected in May 2011, they are not eligible to sit on the Committee because of the requirement to maintain political balance.

              The Council nominated the Council Efficiency & Effectiveness Scrutiny Committee to oversee the implementation of the Action Plan following Sir Michael Pitt’s report and the Head of Planning & Regeneration up-dated Members on this at the Committee’s meeting on 03/09/09.

              Poole Beaches and Coastal Defences: Roy Pointer has kindly agreed to attend the Poole & Christchurch Bays Shoreline Management Plan Review – Key Stakeholder Group meeting on 28/09/09.

              Chairman’s note: Due to delays in the programme the meeting will now be held on 9th November by which time the draft Shoreline Management Plan document should be available.

              Council Tax 2009/10 & Council’s Budget Monitoring report: JS reported that the Budget for 2010/11 and MTFP for 2010/11 to 2012/13 is to be reported to Cabinet at it’s next meeting in October 2009.

              Some residents are very concerned about a likely large increase in household tax, especially people in certain parts of the ward who are on fixed incomes.

              NS commented on increasingly tough times due to the current economic climate. Portfolio Holders were meeting with Heads of Service to discuss possible economies, ahead of the October/November Cabinet meeting. Savings already made, which include two positions in the Planning Dept. not filled, had been offset by £¼m in costs for an additional nine children taken into care.

              WM suggested that, when looking at the Medium Term Financial Plan, the Council should consider ‘zero’ budgeting and there was a need to make hard choices. This month’s report predicts a slight surplus at the end of year, but this is achieved by the use of £3.8m held in un-earmarked reserves. WM felt that just moving around large sums of money on paper, disguises the true state of the Council’s financial position.

              Poole Partnership: JS reported that last night’s Cabinet approved the Performance Reward Grant Allocation Process. Consideration of potential priorities for such funding will be considered at the Poole Partnership Steering Group meeting on 30/09/09.

              The Poole Partnership Governance arrangements and structures are currently being reviewed in the light of the good practice guidance from the Audit Commission. Proposals are to be presented to the next Steering Group meeting on 29/09/09 which will seek to deal with the two way communication about the Partnership and the roles of the Performance Management Group and the Steering Group and will include the need for a communication strategy and for the Steering Group to be more widely representative as well as a more clearly defined role of the Performance Group.

              On the communication theme, a revised website is now operative and Poole Partnership are seeking to include more regular Partnership articles in Poole News as well as the current use of press releases and various forums and community engagement.

              Canford Cliffs Village & proposal to plant trees in Haven Road: MH reported that the Christmas Lights would be switched on, with refreshments and entertainment, at 5.30 – 6.00 pm on Friday 13th November.

              This will be preceded by carols in the afternoon by Lilliput 1st School.

              Ray Wylde asked why no progress was ever reported. SA said that, in spite of numerous calls to the relevant dept. no progress had been made, as each time he ‘phoned, he spoke to a different member of staff, all of whom said they would look into it, but then never called back.

              Chairman’s note: SA has since received a note from the Technical Administrator, Transportation Services to say that the path from Buccleuch Road to Lakeside Road is actually already adopted highway, thus it actually has a higher status of protection than a public footpath/bridleway.

              He goes on to say “It is still possible to add the path to the definitive map, but it would not be high on the council’s ‘to do’ list because with its current classification it is already safeguarded against development/encroachment, etc..”

              Possible Charitable Status for Assn: JS has still to set up a small Sub-Committee to look at this.

              Canford Cliffs Play Area: MH & NS explained that the Council could Canford Cliffs Play Area: MH & NS explained that the Council could only provide so much funding for the play area, so the Canford Cliffs Land Society (CCLS) had agreed to ‘top it up’. CCLS had spoken to mothers in the area and a petition had been raised. The decision that there is a need for a play area was taken at an Area Committee Meeting. The play area will take up only a small area of the green.

              Use of Assn’s Capital Reserve: No new developments

The objectors may be meeting up with the Head of Planning & Regeneration tomorrow to discuss the implications of this decision in relation to future applications in the Branksome Park Conservation Area.

              11 Leicester Road (Demolish existing & Outline application to erect a 59 bedroom care home (class C2) with associated parking (15 spaces), bin & cycle store (revised scheme) – Applications refused on 20/08/09.

              Application refused on 27/05/09) – Application subject to Public Inquiry (APP/Q1255/A/09/2107902) to be held on 10/11/09 at 10.00am at the Civic Centre.

              4-6 Compton Avenue (Demolish existing and erect 2 blocks of flats (10 in total) with basement parking,

              bin and cycle stores. (Revised Scheme Block A). Revised plans received 05.02.2008) Application was registered as long ago as 18/12/07. Most recent posting on BoP planning Application website is a letter from the Agents dated 19/08/08 referring to the outstanding signed Section 106 Agreement which was due to be “issued to Poole Borough Council shortly.” The flats have been largely constructed but it appears that no further work has been carried out on this site since the demise of Ravine Lifestyle. It states at 3.2 ‘Distributions’ of the Administrators’ Progress Report for Ravine Lifestyle dated 21/07/09 that “Clydesdale, the secured lender also had cross guarantees in place over 57 Haven, 4 & 6 Compton, 101 Lilliput and Future 3000. Due to significant shortfalls for the secured creditors in these companies no further realisations were possible for Clydesdale.”

              8 Shore Road – BPCCRA will continue to monitor possible tree work application. An entrance has been created on the Haven Road side of this property.

              60A Kings Avenue (Tree Replacement Notices to replant 3 Scots Pines) – Confirmation awaited that the Council’s Arboriculturist visited both 60 and 60a to check tree issues and that letters sent to the owners requesting planting under Treework/Planning conditions.

              4. ACCOUNTS TO DATE – In the JD’s absence, JS reported that funds at the end of August amounted to approx £34,230.

              JS said that JG has been in touch to say that he is hoping that the Autumn 2009 magazine will be ready for distribution by Friday 16 October.

              5. ANY OTHER BUSINESS

              Mobile ‘Phone Mast, Elgin Road – Chris Stracey Had spoken to a Surveyor (Richard Dunk of Tyco Electronics UK Infrastructure Ltd) at the Pottery Road/Elgin Road mast site who had informed him that Vodaphone are carrying out a national survey of all masts as they need more powerful ones. It is possible that he will be in contact with the Local Planning Authority in the coming weeks about replacing the existing masts with taller ones.

              Chairman’s note: Depending on these discussions any pre-application consultation that may result will include the Residents Associations.

              Private sewers – Mrs Shirley Critchley raised a question about sharing the cost of clearing a blockage of drain where this is connected to a private sewer. Following an emergency problem with the private sewers shared by seven properties in Links Road, Mrs Critchley had paid Wessex Water in advance to do the repairs, she had subsequently been re-imbursed by all except one of the other residents. In this instance, the amount outstanding was small, but Mrs Critchley was concerned that there could be a serious problem in the future if a large amount was involved. It was suggested by members that Mrs Critchley could contact the Small Claims Court, or the Land Registry as the shared responsibility would be in the Deeds. From 2011, water companies will be responsible for private sewers, but most probably costs would be passed on.

              There being no other AOB, JS closed closed at 8.20pm.
